WHEREAS, except for such changes as set forth herein, all previous appropriations remain authorized to continue as previously approved City of Miami ("City") capital projects (new, revised, and continued projects collectively, "Projects") according to the Fiscal Year 2022- 2023 Multi -Year Capital Plan adopted on September 10, 2022 pursuant to Resolution No. R-22- 0321 ("Capital Plan"), as may be amended from time to time; and WHEREAS, it is now necessary to de -appropriate park impact fee funds in the total amount of Three Hundred Thirty Thousand Dollars ($330,000.00) ("Funds") previously allocated to the West End Park Project, Project No. 40-13183505 ("West End Park Project"), and re - appropriate the Funds to the Badia Center Project at Flagami Park, Project No. 40-13203515 ("Badia Center Project'), all as set forth in Exhibit "A," attached and incorporated; and WHEREAS, it is now necessary to de -appropriate American Rescue Plan Act of 2021 ("ARPA") funds in the total amount of Three Hundred Thirty Thousand Dollars ($330,000.00) ("ARPA Funds") previously allocated to the Badia Center Project, and re -appropriate the ARPA Funds to the West End Park Project, all as set forth in Exhibit "A," attached and incorporated; and WHEREAS, the Secretary of the United States Department of the Treasury issued the final rule (31 CFR Part 35) to implement the Coronavirus State Fiscal and Local Fiscal Recovery Funds ("ARPA Funds") established under ARPA ("Final Rule"); and WHEREAS, the Final Rule establishes the guidance and eligible uses of the ARPA Funds; and WHEREAS, the re -appropriations are conditional and subject to the prior written approval by the City's ARPA Consultants as an eligible use of ARPA Funds under the Final Rule; NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY OF MIAMI, FLORIDA: Section 1. The recitals and findings contained in the Preamble of this Resolution are adopted by reference thereto and incorporated herein as if fully set forth in this Section. Section 2. The City Commission hereby approves and authorizes' the City Manager to de -appropriate the Funds previously allocated to the West End Park Project and re -appropriate the Funds to the Badia Center Project, all as set forth in Exhibit "A," attached and incorporated. Section 3. The City Commission hereby approves and authorizes' the City Manager to de -appropriate the ARPA Funds previously allocated to the Badia Center Project and re - appropriate the ARPA Funds to the West End Park Project, all as set forth in Exhibit "A," attached and incorporated, subject to final written approval by the City's ARPA Consultants. Section 4. Certain necessary actions by the City Manager and designated City officials and departments made in order to update the Capital Plan, relevant financial controls and computer systems in connection therewith, for project close-outs, and for grants and other funding sources in progress in connection herewith are ratified, approved, and confirmed.
