These said areas will be known Designated Children Play Area, which are exclusive playgrounds for children, prohibiting adults from designated areas unless accompanied by a child. Background of Item: City Code (Section 38-77 DESIGNATED CHILDREN PLAY AREAS) exist & this Resolution will allow us to enforce designated children only area's accompanied with chaperon/guardian. City of Miami *' ISS°°1 il°4I° °° Legislation Resolution Enactment Number: R-22-0396 File Number: 12252 City Hall 3500 Pan American Drive Miami, FL 33133 www.miamigov.com Final Action Date:10/13/2022 A RESOLUTION OF THE MIAMI CITY COMMISSION, WITH ATTACHMENT(S), DESIGNATING PLAYGROUND AREAS WITHIN CERTAIN CITY PARKS, AS FURTHER DESCRIBED IN EXHIBIT "A," ATTACHED AND INCORPORATED, AS CHILDREN PLAY AREAS PURSUANT TO SECTION 38-77 OF THE CODE OF CITY OF MIAMI, FLORIDA, AS AMENDED; DIRECTING THE CITY MANAGER TO TAKE ANY AND ALL ACTIONS NECESSARY TO IMPLEMENT THIS RESOLUTION. WHEREAS, play activity is vital to the beneficial development of children and research has indicated that outdoor play provides physical, emotional, social, and cognitive enrichment and advancement for children; and WHEREAS, many public parks provide play space for children and minors enhancing child development, social interaction skills, and the ability to engage in physical exercise; and WHEREAS, certain play areas are not intended for use by adults, excepting adults accompanying children, and are intended to furnish age appropriate recreational play equipment and open space to accommodate child's play when children are supervised by parents, guardians, caretakers, or other appropriate adults; and WHEREAS, Section 38-77 of the Code of the City of Miami, Florida, as amended ("City Code") provides the City Commission may designate certain areas within City of Miami ("City") parks as Designated Children Play Areas, which are exclusive playgrounds for children, prohibiting adults from said areas unless accompanying a child; and WHEREAS, the City's Parks and Recreation Department has identified certain areas within City parks, as further described in Exhibit "A," attached and incorporated, as exclusive playgrounds for children ("Play Areas"); and WHEREAS, the City Commission finds it necessary and proper to designate the Play Areas as Designated Children Play Areas pursuant to Section 38-77 of the City Code for the beneficial development of children in the community; NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY OF MIAMI, FLORIDA: Section 1. The recitals and findings contained in the Preamble of this Resolution are adopted by reference and incorporated as fully set forth in this Section. Section 2. The City Commission hereby designates the Play Areas, as further described in Exhibit 'A" as Designated Children Play Areas pursuant to Section 38-77 of the City Code. Section 3. The City Commission directs the City Manager to take any and all necessary actions to implement this Resolution, including the postage of signs informing the public of the designation. Section 4. This Resolution shall become effective immediately upon its adoption.
