HomeMy WebLinkAboutR-22-0335City of Miami Resolution R-22-0335 Legislation File Number: 12309 City Hall 3500 Pan American Drive Miami, FL 33133 www.miamigov.com Final Action Date: 9/13/2022 A RESOLUTION OF THE MIAMI CITY COMMISSION AUTHORIZING THE ACCEPTANCE OF ADDITIONAL STATE HOUSING INITIATIVES PARTNERSHIP ("SHIP") PROGRAM FUNDS IN THE AMOUNT OF $75,145.00 FOR FISCAL YEAR 2021-2022 FOR THE STRATEGIES UNDER THE CURRENT SHIP LOCAL HOUSING ASSISTANCE PLAN; FURTHER AUTHORIZING THE CITY MANAGER TO NEGOTIATE AND EXECUTE ANY AND ALL NECESSARY DOCUMENTS INCLUDING AMENDMENTS, EXTENSIONS, AND MODIFICATIONS, ALL IN FORMS ACCEPTABLE TO THE CITY ATTORNEY, SUBJECT TO ALL FEDERAL, STATE, AND LOCAL LAWS THAT REGULATE THE USE OF SUCH FUNDS FOR SAID PURPOSE. WHEREAS, in July 1992, the State of Florida enacted the William E. Sadowski Affordable Housing Act ("Sadowski Act") which allocates a portion of new and existing documentary stamp taxes, which were paid on the transfer of real estate, to local governments for the development and maintenance of affordable housing; and WHEREAS, the Sadowski Act provides a dedicated revenue source for affordable housing and it has created the Florida State Housing Initiatives Partnership ("SHIP") program; and WHEREAS, pursuant to Resolution No. 21-0343 adopted September 13, 2021, the City Commission accepted the amount of $2,088,221.00 for State Fiscal Year (TY") 2021-2022 for strategies under the current SHIP Local Housing Assistance Plan ("LHAP") allowing the City of Miami's ("City") continued participation in the SHIP program; and WHEREAS, on June 28, 2022, the Florida Housing Finance Corporation notified the City of an additional allocation for State FY 2021-2022 in the total amount of $75,145.00, for a total allocation of $2,163,366.00 for State FY 2021-2022; and WHEREAS, the City Administration recommends the acceptance of the additional SHIP program funds in the amount of $75,145.00 for State FY 2021-2022 for the strategies under the current SHIP LHAP; NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY OF MIAMI, FLORIDA: Section 1. The recitals and findings contained in the Preamble to this Resolution are adopted by reference and incorporated as if fully set forth in this Section. Section 2. The acceptance of additional SHIP funds in the total amount of $75,145.00 for State FY 2021-2022 for the strategies under the current SHIP LHAP is authorized.' The City Manager is authorized' to negotiate and execute any and all necessary documents, including amendments, extensions, and modifications, all in forms acceptable to the City Attorney, subject to all federal, state, and local laws that regulate the use of such funds for said purpose. ' The herein authorization is further subject to compliance with all legal requirements that may be imposed, including but not limited, to those prescribed by applicable City Charter and City Code provisions. 2 If the Mayor does not sign this Resolution, it shall become effective at the end of ten (10) calendar days from the date it was passed and adopted.
