City of Miami File ID: 12268 (Revision: 8) Printed On: 101512022 GX.,y OFF �r City of Miami Legislation Ordinance Enactment Number: 14088 File Number: 12268 Final Action Date: 9/13/2022 AN ORDINANCE OF THE MIAMI CITY COMMISSION, AMENDING CHAPTER 2, ARTICLE II, SECTION 2-33(I) OF THE CODE OF THE CITY OF MIAMI, FLORIDA, AS AMENDED, ENTITLED "ADMINISTRATION/MAYOR AND CITY COMMISSION/ORDER OF BUSINESS AND RULES OF PROCEDURE" TO PROVIDE FOR CONSIDERATION OF EMERGENCY MATTERS AT SPECIAL MEETINGS OF THE CITY COMMISSION; CONTAINING A SEVERABILITY CLAUSE; AND PROVIDING FOR AN IMMEDIATE EFFECTIVE DATE. WHEREAS, on occasion, the City Commission is unable to meet at its regularly scheduled time and date due to a lack of quorum or other emergency; and WHEREAS, on such occasions, the City Commission or the Mayor may call a special meeting to ensure that important matters are heard and decided in a timely manner and without delay; and WHEREAS, the City Commission is presently restricted from considering additional emergency items at a special meeting of the City Commission when those items were not expressly noticed; and WHEREAS, the City Commission finds it to be in the best interests of the citizens and residents of the City of Miami to amend its rules of procedure to provide for the flexibility of considering additional emergency items at special City Commission meetings when appropriate; NOW THEREFORE, BE IT ORDAINED BY THE COMMISSION OF THE CITY OF MIAMI, FLORIDA: Section 1. The recitals and findings contained in the Preamble to this Ordinance are adopted by reference and incorporated as if fully set forth in this Section. Section 2. Chapter 2, Article II, Section 2-33(I) of the Code of the City of Miami, Florida, as amended, titled "Administration/Mayor and City Commission/Order of Business and Rules of Procedure" is amended in the following particulars:' "CHAPTER 2 ADMINISTRATION ARTICLE II. MAYOR AND CITY COMMISSION ' Words/and or figures stricken through shall be deleted. Underscored words and/or figures shall be added. The remaining provisions are now in effect and remain unchanged. (1) Nothing in this section shall prohibit either the mayor, the commissioner designated as the presiding officer of the city commission, or three city commissioners from calling special meetings at any time provided that written notice of the request for a special meeting is delivered to the city clerk at least 72 hours in advance. The city clerk shall then notify the mayor, each member of the commission, the city manager, the city attorney, and the public of the special meeting including the business to be considered at the special meeting. No business shall be conducted or a vote taken at a special city commission meeting on business other than the subject(s) for which the special meeting is called unless the City commission by a majority vote deems such resolution or ordinance to be of an emergency nature and such resolution or ordinance has been reviewed by the Office of Management and Budget for any fiscal impact. *If Section 3. If any section, part of section, paragraph, clause, phrase or word of this Ordinance is declared invalid, the remaining provisions of this Ordinance shall not be affected. Section 4. If the Mayor vetoes this Ordinance, it shall become effective immediately upon override of the veto by the City Commission or upon the effective date stated herein. whichever is later.
