A RESOLUTION OF THE MIAMI CITY COMMISSION, WITH ATTACHMENT(S),
BY A FOUR -FIFTHS (4/5THS) AFFIRMATIVE VOTE, PURSUANT TO SECTION
18-92 OF THE CODE OF THE CITY OF MIAMI, FLORIDA, AS AMENDED
("CITY CODE"), AFTER AN ADVERTISED PUBLIC HEARING, RATIFYING,
APPROVING, AND CONFIRMING THE CITY MANAGER'S FINDING OF A
SOLE SOURCE; WAIVING THE REQUIREMENTS FOR COMPETITIVE
SEALED BIDDING PROCEDURES AND AUTHORIZING THE PURCHASE OF
FIVE (5) SA30820SBL-LE SNIPER RIFLES WITH ACCESSORIES FROM MILE
HIGH SHOOTING ACCESSORIES, LLC , FOR THE CITY OF MIAMI'S POLICE
DEPARTMENT ("MPD"), FOR THE APPROXIMATE PRICE OF THIRTY-SIX
THOUSAND NINE HUNDRED EIGHTY SEVEN DOLLARS AND SEVENTY
CENTS ($36,987.70), ALLOCATING FUNDS FROM MPD'S GENERAL FUND
ACCOUNT NO. 00001.191501.667000.0.0, AND OTHER SOURCES OF
FUNDS; SUBJECT TO THE AVAILABILITY OF FUNDS AND BUDGETARY
APPROVAL AT THE TIME OF NEED; AUTHORIZING THE CITY MANAGER TO
NEGOTIATE AND EXECUTE ANY AND ALL DOCUMENTS, INCLUDING ANY
AMENDMENTS, RENEWALS, AND EXTENSIONS SUBJECT TO ALL
ALLOCATIONS, APPROPRIATIONS, PRIOR BUDGETARY APPROVALS, AND
COMPLIANCE WITH APPLICABLE PROVISIONS OF THE CITY CODE,
INCLUDING THE CITY OF MIAMI'S PROCUREMENT ORDINANCE, ANTI -
DEFICIENCY ACT, AND FINANCIAL INTEGRITY PRINCIPLES, ALL AS SET
FORTH IN CHAPTER 18 OF THE CITY CODE, IN A FORM ACCEPTABLE TO
THE CITY ATTORNEY, AND IN COMPLIANCE WITH ALL APPLICABLE LAWS,
RULES AND REGULATIONS, AS MAY BE DEEMED NECESSARY FOR SAID
PURPOSE.
WHEREAS, the Miami Police Department's ("MPD") Special Weapons and Tactics
Team ("SWAT") has a need to replace their outdated sniper rifles that are solely manufactured
by Accuracy International of North America, Inc. ("Al") and exclusively distributed by Mile High
Shooting Accessories, LLC ("MHS"); and
WHEREAS, the new rifles MPD seeks are an updated version of the rifles that have
been used by SWAT for the past sixteen (16) years and feature a free-floating barrel, a
magazine capacity of ten (10) rounds, and an aluminum chassis system, which ensures
insensitivity to temperature and humidity; and
WHEREAS, the procurement of the updated rifles will enhance the defensive and
offensive capabilities of SWAT, thereby enhancing the protection provided to City of Miami's
("City") residents, visitors, and business owners; and

WHEREAS, these rifles operate on the same performance platform as SWAT's existing
rifles and would allow for a seamless transition, enhancing safety, consistency of performance,
and readiness in the high -liability environment SWAT's Officers operate within; and
WHEREAS, Al's sniper rifles, exclusively distributed by MHS, are the only existing item
and source which are compatible with the needs of the MPD SWAT; and
WHEREAS, pursuant to Section 18-92 of the Code of the City of Miami, Florida, as
amended ("City Code"), the Chief Procurement Officer has made a finding that MHS is the sole
source distributer in the United States of Al sniper rifles and accessories; and
WHEREAS, the City Manager and the Chief Procurement Officer ("CPO") recommend
that the requirements for competitive sealed bidding procedures be waived and that the
procurement of the above system, as specified, be approved; and
WHEREAS, the finding of the CPO has been approved and adopted as the finding of the
City Manager, attached and incorporated as Exhibit "A"; and
WHEREAS, following a published notice made fifteen (15) days prior to the award, the
City Commission is ratifying and approving, by four -fifths (4/5ths) affirmative vote, the waiver of
competitive sealed bidding procedures as a sole source;
NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY OF
MIAMI, FLORIDA:
Section 1. The recitals and findings contained in the Preamble to this Resolution are
adopted by reference and incorporated as if fully set forth in this Section.
Section 2. By a four -fifths (4/5ths) affirmative vote, pursuant to Section 18-92 of the City
Code, after an advertised public hearing, the City Manager's finding of a sole source, is ratified,
approved, and confirmed, the requirements for competitive sealed bidding procedures are
waived, and the request to purchase sniper rifles and accessories from MHS, is approved.
Section 3. Funds are to be allocated from the MPD Account No.
0001.191501.667000.0.0, and other sources of funds, subject to the availability of funds and
budgetary approval at the time of need.
Section 4. The City Manager is further authorized' to negotiate and execute all other
documents, including any amendments, renewals, and extensions, subject to all allocations,
appropriations, prior budgetary approvals, and compliance with all applicable provisions of the
City Code, including the City's Procurement Ordinance, Anti -Deficiency Act, and Financial
Integrity Principles, all as set forth in Chapter 18 of the City Code, all in a form acceptable to the
City Attorney, and in compliance with all applicable laws, rules, and regulations, as may be
deemed necessary for said purpose.
Section 5. This Resolution shall become effective immediately upon its adoption.
The herein authorization is further subject to compliance with all legal requirements that may be
imposed, including but not limited to those prescribed by applicable City Charter and City Code
provisions.
