Background of Item: The Office of Capital Improvements is tasked with the responsibility to execute capital improvement projects. The Office of Management and Budget is tasked with the responsibility of preparing and presenting the Capital Plan. Pursuant to Chapter 18/Article IX/Divisions 1 and 2 of the City Code, entitled "Financial/Financial Policies/Anti-Deficiency Act/Financial Integrity Principles," the City is required to prepare a capital plan detailing improvements needed to support City services. The proposed capital plan identifies $3.718 billion in projects ($981.470 million funded, $291.590 million partially funded, and $2.445 billion unfunded) for the Fiscal Year plus five additional years. The six year plan includes 762 active projects. During the current Fiscal Year new capital appropriations totaling $48.292 million will be used to fund 44 projects as detailed in the capital plan. WHEREAS, a capital improvement programming process to support the Miami Neighborhood Comprehensive Plan is required pursuant to the Community Planning Act, specifically, Sections 163.3161 and 163.3177, Florida Statutes (2022), and Chapter 18/Article IX/Divisions 1 and 2 of the Code of the City of Miami, Florida, as amended, titled "Finance/Financial Policies/Anti-Deficiency Act/Financial Integrity Principles" (collectively, "Laws"); and WHEREAS, the City of Miami's ("City") Fiscal Year ("FY") 2022-23 Proposed Multi -Year Capital Plan as presented to the City Commission, filed with the City Clerk, and posted on the City's website on July 26, 2022 incorporates the FY 2021-22 Multi - Year Capital Plan set forth in Resolution No. R-21-0353 adopted September 13, 2021, as subsequently amended, including on October 1, 2021 pursuant to Resolution No. R- 21-0408, on November 18, 2021 pursuant to Resolution No. R-21-0459, and on March 24, 2022 pursuant to Resolution No. R-22-0130 (collectively, "Proposed Plan"); and WHEREAS, during the current FY, million will be used to fund 44 projects incorporated; and new capital appropriations totaling $48.292 as detailed in Exhibit 'A" attached and WHEREAS, the Proposed Plan is a policy and management tool to plan municipal borrowing and indebtedness over a period of time, to establish annual expenditures within a framework of long-range fiscal requirements, and to serve as an official statement of the City's development plans; and WHEREAS, the Proposed Plan shall incorporate all amendments thereto; NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY OF MIAMI, FLORIDA: Section 1. The recitals and findings contained in the Preamble to this Resolution are adopted by reference and incorporated as if fully set forth in this Section. Section 2. The Proposed Plan as presented to the City Commission, filed with the City Clerk, and posted on the City's website on July 26, 2022 is approved as required pursuant to the Laws to set forth the City's fiscal needs for capital improvements, subject to an annual plan review, to determine project priorities, to add new capital projects, and to modify funding allocations as necessary. Section 3. This Resolution shall become effective immediately upon its adoption and signature of the Mayor.' APPROVED AS TO FORM AND CORRECTNESS: &ina8/2912022. ' If the Mayor does not sign this Resolution, it shall become effective at the end of ten calendar days from the date it was passed and adopted. If the Mayor vetoes this Resolution, it shall become effective immediately upon override of the veto by the City Commission.
