A RESOLUTION OF THE MIAMI CITY COMMISSION GRANTING THE APPEAL
FILED BY BERCOW RADELL FERNANDEZ LARKIN & TAPANES, PLLC ON BEHALF
OF THE PROPERTY OWNER, MINOR STREET LP #1, ("APPELLANT") AND
REVERSING, WITH CONDITIONS, THE HISTORIC AND ENVIRONMENTAL
PRESERVATION BOARD'S DENIAL, PURSUANT TO SECTION 23-6.2(B)(4) OF THE
CODE OF ORDINANCES OF THE CITY OF MIAMI, FLORIDA, AS AMENDED, OF

WHEREAS, on September 1, 2021, the Historic and Environmental Preservation Board
("HEPB"), at a duly noticed hearing, considered Item No. HEPB. 1, pursuant to Section 23-
6.2(b)(4) of the City of Miami ("City") Code of Ordinances, as amended ("City Code"), the
application for a Special Certificate of Appropriateness ("SCOA") for the development of two
vacant lots located at approximately 7101 Northeast 10 Avenue and 1000 Northeast 72 Street,
with Folio Numbers 01-3207-032-1030 and 01-3207-032-0630 ("Property"), and
WHEREAS, the application for the SCOA regarding the Property was for the following:
subdivision into five (5) lots, reconstruction of the Prescott Mansion with new rear addition, new
construction of four (4) single-family residential properties, and site improvements
("Application"); and
WHEREAS, at the conclusion of the hearing, a motion to deny the Application resulted in
a vote of six to one (6-1) of the HEPB members, constituting a denial of the Application and
adopted Resolution No. HEPB-R-21-025; and
WHEREAS, Bercow Radell Fernandez Larkin & Tapanes, PLLC on behalf of the
Property owner, Minor Street LP #1, ("Appellant") timely filed an appeal to the City Commission
pursuant to Section 23-6.2(e) of the City Code; and
WHEREAS, for the reasons stated on the record during the public hearing, the City
Commission grants the appeal and reverses Resolution No. HEPB-R-21-025 as it pertains to
the SCOA for the Property;
NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY OF
MIAMI, FLORIDA:
Section 1. The recitals and findings contained in the Preamble to this Resolution are
adopted by reference and incorporated as if fully set forth in this Section.
Section 2. The City Commission grants the appeal and reverses the decision of the
HEPB as set forth in Resolution No. HEPB-R-21-025 and grants the Application, with
conditions
Section 3. This Resolution shall become effective immediately upon its adoption and
signature of the Mayor.'
APPROVED AS TO FORM AND CORRECTNESS:
If the Mayor does not sign this Resolution, it shall become effective at the end of ten (10) calendar days
from the date it was passed and adopted. If the Mayor vetoes this Resolution, it shall become effective
immediately upon override of the veto by the City Commission.
