A RESOLUTION OF THE MIAMI CITY COMMISSION PURSUANT TO CHAPTER
62/ARTICLE XIII/DIVISION 1/SECTION 62-521(13) OF THE CODE OF THE CITY OF
MIAMI, FLORIDA, AS AMENDED, TITLED "PLANNING AND ZONING/PLANNING
AND ZONING APPROVAL FOR TEMPORARY USES AND OCCUPANCIES; PERMIT
REQUIRED/TEMPORARY EVENT PERMITS/TEMPORARY EVENTS IN GENERAL,"
WAIVING THE TIME LIMITATION OF ONLY TWO (2) TEMPORARY EVENTS FOR A
MAXIMUM OF TWO (2) WEEKS EACH PER YEAR ON PRIVATE PROPERTY FOR
THE MAGIC CITY FLEA MARKETPLACE, A VINTAGE CLOTHING AND ARTISAN
CRAFT MARKET PLACE EVENT TO TAKING PLACE ON AUGUST 27, 2022 AT 350
NW 24 STREET, MIAMI, FLORIDA, WITH CONDITIONS AS STATED HEREIN.
WHEREAS, the property located at 350 Northwest 24 Street, Miami, Florida ("Property")
will have two Temporary Event Permits ("TEP") issued for Magic City Flea Marketplace Events
to be held in July of 2022; and
WHEREAS, pursuant to Section 62-521(b) of the Code of the City of Miami, Florida, as
amended ("City Code"), the number and time limitations for temporary events may be waived
upon affirmative vote of the City Commission; and
WHEREAS, private property may only have two (2) temporary events per year unless
the limitation is waived by the City Commission; and
WHEREAS, Magic City Flea ("Applicant") has been holding events to promote vintage
clothing and artisan crafts sales ("Event") in the City of Miami, Florida and wishes to have a third
on August 27, 2022; and
WHEREAS, these events attract and provide a sales outlet for local small business as
well as creating a gathering spot for the local community to enjoy these products and their
community; and
WHEREAS, this Event has brought the community together in the past and this Event
will prove no different through the sale of vintage clothing, crafts, and food; and
WHEREAS, notwithstanding the issuance of this waiver pursuant to Section 62-521(b) of
the City Code, all noise must comply with the requirements of Chapter 36 of the City Code; and
WHEREAS, three (3) or more violations issued at the Property related to noise or any
other violation of the City Code will result in an automatic rescission of this approval and this
waiver shall be deemed void;
NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY OF
MIAMI, FLORIDA:
Section 1. The recitals and findings contained in the Preamble of this Resolution are
adopted by reference and incorporated as if fully set forth in this Section.
Section 3. The Temporary Event Permit limitation to two (2) events per year, per private
property is waived for the Magic City Flea Event to be held at 350 Northwest 24 Street, Miami,
Florida on August 27, 2022. Applicant is still required to obtain permits and pay all fees for each
applicable Temporary Event.
Section 4. All noise must comply with the requirements of Chapter 36 of the City Code.
Section 5. Three (3) or more violations of the City Code will result in an automatic
rescission of this waiver.
Section 6. This Resolution shall become effective immediately upon its adoption.
