A RESOLUTION OF THE MIAMI CITY COMMISSION, WITH ATTACHMENT(S),
ACCEPTING, ALLOCATING, BUDGETING, AND APPROPRIATING
COMMUNITY DEVELOPMENT BLOCK GRANT MITIGATION FUNDS IN AN
AMOUNT NOT TO EXCEED ONE MILLION TWO HUNDRED SIXTEEN
THOUSAND NINE HUNDRED SIXTY-THREE DOLLARS ($1,216,963.00) FROM
THE FLORIDA DEPARTMENT OF ECONOMIC OPPORTUNITY ("FDEO") TO
BE UTILIZED FOR ROADWAY IMPROVEMENTS ON NORTHWEST 17
STREET, MIAMI, BETWEEN NORTHWEST 27 AVENUE AND NORTHWEST 37
AVENUE, TO MITIGATE FLOODING, LAND EROSION, AND POLLUTION BY
INSTALLING A DRAINAGE SYSTEM, EXFILTRATION TRENCH, STORM
INLETS, ACCESSIBILITY RAMPS, AND SWALES, WITH NO MATCHING
FUNDS; AUTHORIZING THE CITY MANAGER TO EXECUTE A GRANT
AGREEMENT WITH FDEO IN A FORM ACCEPTABLE TO THE CITY
ATTORNEY; FURTHER AUTHORIZING THE CITY MANAGER TO NEGOTIATE
AND EXECUTE ANY AGREEMENTS, AMENDMENTS, AND ALL OTHER
NECESSARY DOCUMENTS, ALL IN FORMS ACCEPTABLE TO THE CITY
ATTORNEY, FOR THE ACCEPTANCE, ADMINISTRATION OF, AND
COMPLIANCE WITH THE GRANT AWARD IN SUPPORT OF OFFICE OF
CAPITAL IMPROVEMENTS PROJECT NOS. 40-13183611 AND 40-13183611A.

WHEREAS, the City of Miami's (City) Office of Capital Improvements ("OCI") has been
awarded Community Development Block Grant Mitigation Funds ("Grant Award") from the
Florida Department of Economic Opportunity ("FDEO") in a total amount not to exceed One
Million Two Hundred Sixteen Thousand Nine Hundred Sixty -Three Dollars ($1,216,963.00) to be
utilized for the mitigation of flooding on Northwest 17 Street, Miami, between Northwest 27
Avenue and Northwest 37 Avenue, with no matching funds required from the City; and
WHEREAS, qualifying mitigation activities are those activities that increase resilience to
disasters and reduce or eliminate the long-term risk of loss of life, injury, damage to and loss of
property, and suffering and hardship by lessening the impact of future disasters; and
WHEREAS, the Grant Award will fund improvements to this critical section of roadway to
enhance its resilience and the resilience of the surrounding community to future natural
disasters through the installation of a drainage system, exfiltration trench, storm inlets,
accessibility ramps, and swales; and
WHEREAS, it is appropriate for the City to accept the Grant Award, authorize the City
Manager to negotiate and execute a corresponding grant agreement ("Grant Agreement"), in a
form acceptable to the City Attorney, and to negotiate and execute any agreements,
amendments, and all necessary documents, all in forms acceptable to the City Attorney, for the
acceptance, administration of, and compliance with the Grant Agreement and to allocate,

budget, and appropriate the Grant Award in support of OCI Project Nos. 40-B183611 and 40-
B 183611 A;
NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY OF
MIAMI, FLORIDA:
Section 1. The recitals and findings contained in the Preamble to this Resolution are
adopted by reference and incorporated as fully set forth in this Section.
Section 2. The City Manager is hereby authorized' to accept the Grant Award to be
utilized for the roadway improvements on Northwest 17 Street, Miami, between Northwest 27
Avenue and Northwest 37 Avenue.
Section 3. The Grant Award is hereby allocated, budgeted, and appropriated to be used
in support of OCI Project Nos. 40-B183611 and 40-Bl83611A.
Section 4. The City Manager is hereby authorized' to negotiate and execute the Grant
Agreement, in a form acceptable to the City Attorney, with FDEO.
Section 5. The City Manager is further authorized' to negotiate and execute any and all
renewals, extensions, modifications, amendments, and all other necessary documents, all in
forms acceptable to the City Attorney, for the acceptance, allocation, budgeting, appropriation,
administration of, and compliance with the Grant Agreement.
Section 6. This Resolution shall become effective immediately upon its adoption and
signature of the Mayor.2

' The herein authorization is further subject to compliance with all legal requirements that may be
imposed, including but not limited to those prescribed by applicable City Charter and City Code
provisions.
2 If the Mayor does not sign this Resolution, it shall become effective at the end of ten (10) calendar days
from the date it was passed and adopted. If the Mayor vetoes this Resolution, it shall become effective
immediately upon override of the veto by the City Commission.
