A RESOLUTION OF THE BOARD DIRECTORS OF THE SOUTHEAST
OVERTOWN/PARK WEST COMMUNITY REDEVELOPMENT AGENCY (THE
SEOPW "CRA") AUTHORIZING THE EXECUTIVE DIRECTOR TO EXECUTE
A CHANGE ORDER IN THE AMOUNT OF $17,427.00 FOR ADDITIONAL
WORK REQUIRED ON THE FENCE AT FREDERICK DOUGLASS
ELEMENTARY SCHOOL; FURTHER AUTHORIZING THE EXECUTIVE
DIRECTOR TO EXECUTE.,.A TWO-PARTY CHECK TO EFFECTIVE
IRONWORKS, INC. AND TLMC ENTERPRISES, INC. PROVIDED THAT THE
CRA RECEIVE A FINAL RELEASE FROM EFFECTIVE IRONWORKS.
WHEREAS, the CRA entered into an agreement with general contractor TLMC Enterprises, Inc.
for the construction of parking lot P-2; and
WHEREAS, the CRA by resolutions SEOPW/CRA R-01-52 and R-01-87 expanded the scope of
work to include construction of a fence at Frederick Douglass Elementary; and
WHEREAS, construction of the fence has required performance of additional work by the
fencing subcontractor, Effective Ironworks, Inc., who has applied for a change order for the increased
cost of its performance; and
WHEREAS, H.J. Ross, the CRA's consulting engineer, has reviewed the request and approved
$17,427.00 of the requested changes; and
WHEREAS, the CRA and the general contractor are in not in agreement as to the amount owed
the general contactor under the original contract but agree the subcontractor is entitled to this change
order and have agreed to payment by two-party check.
NOW, THEREFORE, BE IT RESOLVED BY THE BOARD OF DIRECTORS OF THE
SOUTHEAST OVERTOWN/PARK WEST COMMUNITY REDEVELOPMENT AGENCY OF
THE CITY OF MIAMI, FLORIDA:
Section 1. The recitals and findings contained in the Preamble to this Resolution are
incorporated herein as if fully set forth in this Section.
Section 2. That Board of Directors of the CRA hereby authorize the Executive Director to
execute a change order in the amount of $17,427.00 for additional work on the fence at Frederick
Douglass Elementary and to execute a two party check to Effective Ironworks, Inc. and TLMC
Enterprises, Inc., provided that the CRA receive a final release from Effective Ironworks.

RECOMMENDATION:
It is respectfully recommended that the CRA Board of Directors adopt the attached resolution
authorizing a change order in the amount of $17,427.00 for additional work performed by the fencing
subcontractor at Frederick Douglass Elementary School; further, authorizing the Executive Director to
execute a two-party check to Effective Ironworks, Inc. and TLMC Enterprises, Inc., provided that the
CRA receive a final release from Effective Ironworks, Inc.
• JUSTIFICATION:
•
The CRA entered into an agreement with general contractor TLMC Enterprises, Inc. for the construction
of parking lot P-2. By Resolutions SEOPW/CRA R-01-52 and R-01-87 the CRA expanded the scope of
work to include construction of a fence at Frederick Douglass Elementary School. Construction of the
fence has required performance of additional work by the fencing subcontractor, Effective Ironworks,
Inc., who has applied for a change order for the increased cost of its performance. H.J. Ross, the CRA's
consulting engineer, has reviewed the request and approved $17,427.00 of the requested changes. The
CRA and the general contractor are in not in agreement as to the amount owed the general contactor

We reviewed the change order request from the contractor, TLMC Enterprises, Inc., and
its subcontractor Effective Iron Works, Inc., and offer the following iinformation and
recommendations:
Preamble
H.J. Ross Associates had no involvement in the design or construction administration of
this project; therefore, our summation and interpretation of the events is based solely on
information provided by Mr. David Hernandez (construction manager for CRA at the
time of construction), construction drawings (C-1 to C-3, undated), and the contractor's
Proposed Change Order #1 & #2 (dated May 16, 2002). The following items address the
contractor's requests and include requests from the fence subcontractor.
Request from the General Contractor (TLMC Enterprises, Inc.)
1) Footings in Path of Fence Posts: This was additional work from an unforeseen
condition; however, our estimation is that the work should have required only one
day to complete which should be about half of the amount requested.
Recommendation: Pay $1, 032.00 (half of the corrected amount)
2) Removal and Grading of Berm: The fence was to be installed approximately at
the back of the existing sidewalk along the school property line. The fence should
have followed the sidewalk slope, which would not require removal of any
substantial amount of embankment from the school property. In addition, a site
investigation prior to bidding would have provided the contractor any information
to determine how the fence would be installed and if any minor grading would

have been needed. This should have been included in the bid as an incidental part
of the fence work.
Recommendation: No additional compensation for this work.
3) Grading to Facilitate Sod Installation: As noted in Item 2 above, the fence was to
be installed approximately at the back of the existing sidewalk along the school
property line. No grading on the school site was shown on the plans, apparently
because no grading was needed. Any grading along the fence should have been at
the contractor's option to facilitate the work. In addition, a site investigation prior
to bidding would have provided the contractor any information to determine how
the fence should have been installed and if any minor grading would have been
required. This should have been included in the bid as an incidental part of the
fence work or site restoration.
Recommendation: No additional compensation for this work.
4) Sod Installation: Refer to Item 3 above. This should have been included in the
bid as an incidental part of the fence work or site restoration.
Recommendation: No additional compensation for this work.
Request from the subcontractor (Effective Iron Works, Inc.)
1) Increased Length of Rolling Gates and Concrete Footing: The gates had to be
made wider than shown on the plans due to setbacks needed to provide clearance
when the gates are fully retracted.
Recommendation: Pay full amount of $2,940.00
2) Remove and Reinstall North and East Fencing: The typical fence detail shown on
Sheet C-3 indicates a fairly level situation at the base of the fence. The
subcontractor apparently followed the back of sidewalk slope when installing the
fence and produced an uneven line at the top of the fence, which was not the
intent of the drawings. This required reinstallation of a portion of the fence.

Recommendation: Pay full amount of $10, 700.00.
3) Spacing of 2" x 2" Posts: The post spacing had to be reduced to stiffen the fence.
This required additional posts to be installed.
Recommendation: Pay full amount of $2, 700.00
4) Increased Size of Cross Rails: Based on the conditions noted in Item 3 above, the
cross rail needed to be increased for the reasons stated in the subcontractor's
letter.
Recommendation: Pay full amount of $1,087.00

Please be advised that the length of several gates needed to be
increased due to field directives stating to match the length of existing openings.
The openings affected and related cost are:

Please be advised, that due to grading and elevation considerations not shown on
the plans, we had to remove and then re -install the metal fencing in these areas.
The raising of the fencing, to accommodate the existing grades, pushed the top of
the fence connections into the concrete cap making the project less attractive.

Please be aware that the plans call for 8' spacing between posts. Upon fabrication,
-u,e noticed bowing and wealmess due to the 8' spans specified. We do not
guarantee that the 8' spans would meet Miami -Dade Public School Standards.
Thus the change to 6' spacings of the posts. Due to life safety and Miami -Dade
Public Schools requirements we would like for you to consider the following
upgrades in the structural components for our fence fabrication and installation.

Please understand, that in addition to Item # 3 mentioned above, additional
considerations needed to be addressed as the specified 1" x 1" cross rails could not
- carry the weight of the column to post spans. In addition, the usage of the 1 " x 2"
cross rails stabilized the fencing system to meet Miami -Dade Public School
Standards. Furthermore, the 1 " x 2" cross rails will add years of life and durability
as well as being more ethically pleasing architecturally.

Per your request, the City of Miami Building Department personnel performed a courtesy review
of the plans for the structural components of the proposed fence/columns project for Frederick
Douglas Elementary School. The plans meet the present South Florida Building Code
requirements, however, they have not been signed and sealed by the Architect/P.E. As routinely
done, they have been perforated for identification purposes.
Please note that, as stated above, the review of these plans was performed as a courtesy to you.
The Building Department does not have jurisdiction to issue permits, conduct inspections, and/or
review plans when it comes to the Dade County Public School System.

RESOLUTION NO. R-01-52 APPROVED ON MAY 21, 2001 TO
AUTHORIZE THE CRA TO RETAIN TLMC ENTERPRISES
("TLMC") TO CONSTRUCT NEW FENCING AROUND
FREDRICK DOUGLASS ELEMENTARY SCHOOL
PURSUANT TO ITS EXISTING CONTRACT WITH THE CRA
WHICH INCLUDES THE CONSTRUCTION OF FENCING IN
LIEU OF SEEKING COMPETITIVE BIDS, AND
AUTHORIZING THE EXECUTIVE DIRECTOR OF THE CRA
TO EXECUTE A CHANGE ORDER TO THE CONTRACT
WITH TLMC TO ADD THE CONSTRUCTION OF THE FENCE
TO THE SCOPE OF SERVICES IN THE AMOUNT NOT TO
EXCEED $200,000.00.
WHEREAS, the CRA is responsible for carrying out redevelopment activities and
projects in the Southeast Overtown/Park West Community Redevelopment Area established
pursuant to the CRA Redevelopment Plan; and
WHEREAS, pursuant to SEOPW Resolution No. R-01-52, the Board of Directors -of the
CRA has authorized the CRA to enter into a Use Agreement with the School Board of Miami -
Dade County with respect to the construction of new fencing around Frederick Douglass
Elementary School (the "Fencing"), and authorize the CRA to retain the contractor through
competitive bidding; and
WHEREAS, CRA desires to expedite construction of the Fencing so that the Fencing is
completed during the summer break; and
WHEREAS, the CRA would like to retain TLMC to construct the Fencing pursuant to its
existing contract with the CRA which was authorized by SEOPW/CRA Resolution No. 00-106
and SEOPW/CRA Resolution No. 00-107 and authorize Executive Director of the CRA to
execute a change order in an amount not to exceed $200,000.00 to the existing contract to
include the Fencing in lieu of seeking competitive bidding for the construction of the Fencing.
NOW, THEREFORE, BE IT RESOLVED BY THE BOARD OF DIRECTORS OF THE
SOUTHEAST OVERTOWN PARKWEST COMMUNITY REDEVELOPMENT AGENCY OF
THE CITY OF MIAMI, FLORIDA:
