HomeMy WebLinkAboutSEOPW-CRA-R-02-0177y SEOPW/CRA ITEM 4 RESOLUTION NO 0 177 A RESOLUTION OF THE BOARD OF DIRECTORS OF THE SOUTHEAST OVERTOWN/PARK WEST COMMUNITY REDEVELOPMENT AGENCY ("CRA") AUTHORIZING THE EXECUTIVE DIRECTOR TO DISBURSE FUNDS, IN A TOTAL AMOUNT NOT TO EXCEED $6,908.18, TO SETTLE DELINQUENT PROPERTY TAXES, IN AN AMOUNT NOT TO EXCEED $5,836.18, AND SPECIAL ASSESSMENT FEES, IN AN AMOUNT NOT TO EXCEED $248.00, WHICH ARE OUTSTANDING AGAINST REAL ESTATE THE CPA HAS PREVIOUSLY REQUESTED THE CITY OF MIAMI TO PURCHASE, LOCATED AT 842-48 NORTH WEST 3rd. AVENUE, MIAMI, FLORIDA, FOLIO NUMBER O1 01030401010; FURTHER AUTHORIZING THE EXECUTIVE DIRECTOR TO SEEK REIMBURSEMENT FROM THE FLORIDA DEPARTMENT OF TRANSPORTATION ("FDOT") IF SAID PROPERTY IS LATER UTILIZED SOLELY FOR `TRANSPORTATION' PURPOSES BY THE FDOT. WHEREAS, SEOPW Resolution No. 02-17, passed and adopted January 28, 2002, authorized the Executive Director to request that the City of Miami immediately and expeditiously acquire three parcels of land for public right of way, open space plaza and parking and future Florida Department of Transportation ("FDOT") use, pursuant to the 9th Street Pedestrian Mall plan and Chapter 163, Florida Statutes; and WHEREAS, in April of 2002, FDOT indicated that since there was an existing `transportation' purpose that there was an availability of funds to acquire 842-48 North West 3rd Avenue, SE®PW! CRA 02- 177 Miami, Florida. Upon receipt of this notification, the CRA agreed that it should proceed with the acquisition; and WHEREAS, in September.of 2002, FDOT requested funds for tax relief for the payment of delinquent taxes and special assessment fees pertaining to the acquisition of the property. NOW, THEREFORE, BE IT RESOLVED BY THE BOARD OF DIRECTORS OF THE SOUTHEAST OVERTOWN/PARK WEST COMMUNITY REDEVELOPMENT AGENCY OF THE CITY OF MIAMI, FLORIDA: Section 1. The recitals and findings contained in the Preamble to this Resolution are incorporated herein as if fully set forth in this Section. Section 2. The Board of Directors authorizes the executive director to disburse funds, in a total amount not to exceed $6,908.18, to settle delinquent property taxes, in an amount not to exceed $5,836.18, and special assessment fees, in an amount not to exceed $248.00, which are outstanding against real estate the CRA has previously requested the City of Miami to purchase, located at 842-48 North West 3rd Avenue, Miami, Florida, folio number 01 01030401010. Section 3. The Executive Director is further authorized to seek reimbursement from the Florida Department. of Transportation ("FDOT") if said property is later utilized solely for `transportation' purposes by the FDOT. In September of 2002 FDOT requested funds for `tax relief' for the payment of delinquent taxes and special assessment in the acquisition of the property. Based upon the ultimate usage by FDOT the CRA will seek reimbursement for any and all funds expended if appropriate. We understand that the property has a transportation purpose and that there may be funds available for advanced acquisition. Subject to the availability of these funds, the Florida Department of Transportation can proceed with the purchase of the property. In the event that the property can be shared between the Department and the CRA, the CRA would reimburse the Department for a pro-rata share of the total acquisition expenses.
