ENTERPRISE FOR IMPACT FEES RELATED TO THE BUILD -OUT OF THE FACILITY LOCATED AT 1756 NORTH BAYSHORE DRIVE, MIAMI, FLORIDA, IN AN AMOUNT NOT TO EXCEED $29,000, SUBJECT TO THE AVAILABILITY OF FUNDS FROM ACCOUNT NUMBER 686001.590320.6.940; AND DIRECTING THE EXECUTIVE DIRECTOR THAT THE TRANSFER OF FUNDS SHALL BE SUBJECT TO W.H.E. ENTERPRISE EXECUTING A FORGIVABLE LOAN AGREEMENT, IN A FORM ACCEPTABLE TO THE CITY ATTORNEY, WITH THE CRA. WHEREAS, the Omni Community Redevelopment Agency (CRA) is responsible for carrying out community redevelopment activities and projects in the OMNI Community Redevelopment Area established pursuant to the CRA Redevelopment Plan; and WHEREAS, the CRA is committed to spurring development and job creation within the CRA Redevelopment district by providing incentives and/or waivers of certain impact fees; and WHEREAS, on December 11, 2001, the CRA Board of Directors adopted motion SEOPW/CRA M-01-35 which instructed the Executive Director to meet with Mr. Richard Haylor of W.H.E. Enterprises in connection with potential jobs to be created in the Omni 0M /CRA 02-- 024 Redevelopment District and to return to the CRA Board at the next meeting with a recommendation; and WHEREAS, the CRA desires to transfer funds to the Miami - Dade County Water and Sewer Authority ("WASA"), for the benefit of W.H.E. Enterprise, for impact fees related to the build -out of the facility located at 1756 North Bayshore Drive, Miami, Florida. NOW, THEREFORE, BE IT RESOLVED BY THE BOARD OF DIRECTORS OF THE OMNI COMMUNITY REDEVELOPMENT AGENCY OF THE CITY OF MIAMI, FLORIDA: Section 1. The recitals and findings contained in the Preamble to this Resolution are incorporated herein as if fully set forth in this Section. Section 2. The Board of Directors authorizes the Executive Director to transfer funds to WASA, for the benefit of W.H.E. Enterprise, for impact fees related to the build -out of the facility located at 1756 North Bayshore Drive, Miami, Florida, in an amount not to exceed $29,000, subject to the availability of funds, from Account Number 686001.590320.6.940. Section 3. The transfer of funds to WASA shall be subject to W.H.E. Enterprise executing a forgivable loan agreement, in a form acceptable to the City Attorney, with the CRA. Enterprises in connection with potential jobs to be created in the Omni Redevelopment District and to return to the CRA Board at the next meeting with a recommendation; and WHEREAS, on February 14, 2002, the CRA Board of Directors adopted motion SEOPW/CRA M-02-19 which directed the CRA Executive Director to schedule at the February 25, 2002 Board meeting, consideration of a $15,000 loan, with not interest, and/or grant to Sax on the Beach to assist . with expenses related to Water and Sewer (WASA) impact fees, further conditioning said loan with having Sax on the Beach provide the CRA with proof that it has the funds to compete the expansion of its facility; and WHEREAS , the CRA desires to transfer funds to Water and Sewer Authority (WASA) in an amount not to exceed $29,000 subject to the availability of funds from account number 686001.590320.6.940, for the benefit of W.H.E. Enterprise for impact fees related to the build -out of the facility located at 1756 North Bayshore Drive, Miami, FL, subject to W.H.E. Enterprise entering into a forgivable loan agreement with the CRA. NOW THEREFORE, BE IT RESOLVED BY THE BOARD OF DIRECTORS OF THE COMMUNITY REDEVELOPMENT AGENCY OF THE CITY OF MIAMI, FLORIDA: Section 1. BACKGROUND On February 14, 2002, the CRA Board of Directors directed the CRA Executive Director to consider a loan or in -kind grant to W.H.E. Enterprise for WASA impact fees for the build -out of Sax on the Beach located within the OMNI Redevelopment Area pursuant to an agreement with W.H.E. Enterprise, encouraging job creation within the area and further directing the Executive Director to present a recommendation to the Board at the next CRA Board meeting. WHE needs to forward their plans to Miami Dade Water and Sewer Authority. Since they are proposing 80 Full Service Restaurant seats. The following is a breakdown as to what the proposed total cost of the Miami Dade Water and Sewer Fees. As per their schedule of daily rated galloonage for various occupancy as attached. The department current connection charges are $1.39 and $5.60per gallon per day for water and sewer respectively.
