HomeMy WebLinkAboutSEOPW-CRA-R-01-0137N W cm RESOLUTION NO.SEOPW ITEM 6 December 11, 2001 A RESOLUTION OF THE BOARD OF DIRECTORS OF THE SOUTHEAST OVERTOWN/PARK WEST (SEOPW) COMMUNITY REDEVELOPMENT AGENCY (CRA) AUTHORIZING THE CITY ATTRONEY TO AMEND FEE AMOUNT FROM $15,000, AUTHORIZED BY MOTION-01-23, TO RETAIN SPECIAL COUNSEL JEFFREY BERKOW OF BERKOW & RADELL ASSOCIATES TO RESOLVE ISSUES RELATED TO THE SEOPW DEVELOPMENT OF REGIONAL IMPACT (DRI); AND BRING THE CRA INTO COMPLIANCE WITH THE DOWTOWN DEVELOPMENT OF THE REGIONAL IMPACT DEVELOPMENT ORDER, TO AN AMOUNT NOT TO EXCEED $22,000. WHEREAS, the City Commission approved the SEOPW DRI in February of 1988; and WHEREAS, said SEOPW DRI approved specific land uses in the form of three (3) Increments; and WHEREAS, Increments I has expired and Increment II, in December of 1999, was extended to November 20, 2004; and WHEREAS, Increment I development was under utilized; Increment II, though extended, should be re-evaluated and amended to reflect the current market realities; and Increment III build out date should be amended by an extension; and WHEREAS, the scope of the amendment is subject to whether it is considered a `substantial deviation'; as the required action is based on the extent of the deviation from the original Development Order (DO); and WHEREAS, the CRA wishes to file a Notification of Proposed Change (NOPC) or an Amended Application of for Development Approval (AADA) which ever is befitting; and WHEREAS, Motion M-0-23 from the CRA Board Meeting of February 2, 2001 instructing special counsel Jeffrey Bercow to work with the City staff and the CRA staff; and SEOPW/CRA Al � r.d ITEM 6 December 11, 2001 WHEREAS, Bercow and Radell Associates specializes in these matters and the CRA desires to resolve outstanding issues related the SEOPW DRI and bring the CRA into compliance with the terms of the Miami Downtown Development of the Regional Impact order; and NOW THEREFORE, BE IT RESOLVED BY THE BOARD OF DIRECTORS OF THE COMMUNITY REDEVELOPMENT AGENCY OF THE CITY OF MIAMI, FLORIDA: Section 1. The recitals and findings contained in the Preamble to the Resolution are incorporated herein as if fully set forth in this Section. Section 2. The CRA Board of Directors authorizes the Executive Director to retain Jeffrey Bercow Associates to resolve outstanding SEOPW DRI matters for an amount not to exceed $15,000 wishes to increase total compensation not to exceed $22,000. Lewis RECOMMENDATION INTER -OFFICE MEMORANDUM ITEM 6 December 11, 2001 DATE: December 11, 2001 FILE: SUBJECT: Amendment of fees of Jeffrey Bercow for Maters relating to the REFERENCfZA DRI ENCLOSURES: It is recommended that the Board of Directors of the Southeast Overtown/Park West Community Redevelopment Agency of the City of Miami (the "CRA") approve the attached Resolution, which increases the fees granted to Jeffrey Bercow from $15,000 to $22,000 for matters relating to the CRA DRI issues. BACKGROUND At the Board Meeting of February 26, 2001, Motion M-01-23 was passed to retain Jeffrey Bercow; of Bercow and Radell Associates, to work with the City and CRA staff to resolve pending issues related to the SEOPW CRA DRI and to bring the CRA into compliance with the terms of the Miami Downtown Development Regional Impact Development Order. Included in the motion was the stipulation that fees were authorizgd to a limit of $15,000.
