SEOPW/CRA R-01-111 A RESOLUTION OF THE SOUTHEAST OVERTOWN/PARK WEST COMMUNITY REDEVELOPMENT AGENCY (THE "CRA") AUTHORIZING THE CRA TO AMEND THE CRA BUDGET TO INCLUDE A LINE ITEM IN THE AMOUNT OF ONE HUNDRED FIFTY ONE THOUSAND AND 00/100 DOLLARS ($151,000.00) WHICH REPRESENTS THE BUDGETED AMOUNT FOR LEGAL SERVICES TO BE PROVIDED AND COSTS TO BE INCURRED BY HOLLAND & KNIGHT LLP ("H&K") IN CONNECTION WITH THE SAWYER'S WALK PROJECT DECLARATORY JUDGEMENT ACTION, WHICH AMOUNT IS TO BE ALLOCATED BETWEEN FISCAL YEARS 2001 AND 2002 IN THE AMOUNTS OF $90,000.00 AND $61,000.00, RESPECTIVELY. WHEREAS, the City of Miami approved and adopted the Southeast Overtown/Park West Community Redevelopment Plan pursuant to Resolution Nos. 82-755 and 85-1247 (the "Redevelopment Plan"); and WHEREAS, the CRA is responsible for carrying out community redevelopment activities and projects in the Southeast Overtown/Park West Redevelopment Area (the "Redevelopment Area") established pursuant to the Redevelopment Plan; and WHEREAS, the CRA desires to amend the CRA budget to include a line item in the amount of $151,000.00 which represents the budgeted amount for legal services provided and costs to be incurred by H&K in connection with the Sawyer's Walk Project declaratory judgement action, which amount is to be allocated between Fiscal Years 2001 and 2002 in the amounts of $90,000 and $61,000.00, respectively. NOW, THEREFORE, BE IT RESOLVED BY THE BOARD OF DIRECTORS OF THE COMMUNITY REDEVELOPMENT AGENCY OF THE CITY OF MIAMI, FLORIDA: Section 1. The recitals and findings contained in the Preamble to this Resolution are incorporated herein as if fully set forth in this Section. Section 2. The CRA is hereby authorized to amend the CRA budget to include a line item in the amount of $151,000.00 which represents the budgeted amount for legal services provided and costs to be incurred by H&K in connection with the Sawyer's Walk Project declaratory judgement action, which amount is to be allocated between Fiscal Years 2001 and 2002 in the amounts of $90,000.00 and $61,000.00, respectively. Sawyers Walk Case No. 00-28860 CA-00 Our File No. 27387.112 The following is an estimate of the legal fees and costs that are likely to be incurred for the captioned matter based on the existing pleadings and current rates: PLEADINGS Prepare pleadings $ 7,000 Respond to same DISCOVERY Written discovery 8,500 Witness interviews 8,500 Document review (including that produced by third parties) 10,000 DEPOSITIONS 20,000 MOTIONS/HEARINGS Motion practice (including routine, and preparation and argument on motions to disqualify, bifurcate -and summary 25,000 judgment) RESEARCH Legal research and preparation of memoranda 12,000 MEDIATION Prepare and attend 5,000 Ul- � SE0PWs ' May 10, 2001 Page 2 INAL HE.'—'V.'LNG Pretrial Catalog Final hearing (including preparation) if bifurcated 10,000 if tried together or 25,000 TOTAL FEES $106,000-121,000 Costs should not exceed $15,000, however, this number is based on the single highest expense, i.e., court reporters and transcripts. Since we have not yet been able to determine how many depositions the defendants may take, this number is somewhat speculative. The other large cost could be an expert witness if it is determined that one is necessary. I would suggest budgeting $15,000 for this.
