ATTORNEY'S OFFICE. This document was prepared by the
Miami City Attorney to reflect mental impressions,
conclusions, and litigation strategy in pending civil litigation
cases and administrative proceedings involving Miami -Dade
County v. City of Miami and Southeast Overtown/Park West
Community Redevelopment Agency, Case No. 01-13810 CA
(08). This document is exempt from Public Records disclosure
as an attorney work -product until such time as all litigation
and administrative proceedings involving said parties have
been concluded. [Section 119.07(3)(1), Florida Statutes (2000)].
The purpose of this memorandum is to provide a preliminary analysis of
the above referenced matter.
The plaintiff, Miami -Dade County, filed an action on June 11, 2001,
against the defendants City of Miami and Community Redevelopment Agency
seeking to extinguish the interests of the defendants in three parcels of land
located within the Southeast Overtown/Park West Community Redevelopment
Project. These parcels, Blocks 36, 45N, and 56N, were conveyed to the City on
March 1, 1988, and, according to the complaint, set forth reversions to Miami -
Dade County in the event that certain development did not occur within a time
certain. The complaint further claims that development did not timely ensue and,
therefore, the parcels revert to Miami -Dade County.

Although the factual issues attendant this lawsuit are somewhat complex,
the legal issues are very defensible. When the complaint is formally served in
accordance with Florida statutory law, the City will respond accordingly.
