HomeMy WebLinkAboutSEOPW-CRA-R-01-0008• ® ITEM 13 RESOLUTION NO. 0 1 - 08 A RESOLUTION OF THE SOUTHEAST OVERTOWN/PARK WEST REDEVELOPMENT AGENCY (HEREINAFTER REFERRED TO AS THE "CRA") ESTABLISHING CRITERIA, PROCEDURES AND A POLICY LISTING THE NAMES OF THE ONLY NEWSPAPERS WHICH THE CRA ARE TO IDENTIFY AS THOSE NEWSPAPERS TO USE FOR PUBLISHING PUBLIC NOTICES FOR ALL LAND ACQUISITIONS AND TRANSFERS OF REAL PROPERTY BY TITLE, LEASE OR ANY APPROPRIATE AGREEMENT AS REQUIRED BY THE FLORIDA COMMUNITY REDEVELOPMENT ACT OF 1969 (FLORIDA STATUTE SECTION 163.380); FURTHER IDENTIFYING THOSE NEWSPAPERS TO BE USED FOR CRA MEETING NOTICES; UTILIZING THE GENERAL MEDIA LISTS SET FORTH IN THE ENCLOSED TABLE, AS FURTHER CATEGORIZED BY CATEGORIES A,B, AND C, AS WELL AS THE ATTACHED LIST OF AFRICAN AMERICAN MEDIA SOURCES TO THIS RESOLUTION; USAGE OF SAID NEWSPAPERS SHALL BE CONDITIONED UPON ALL REQUIREMENTS IMPOSED, AND ALL POLICY AND GUIDELINES ESTABLISHED BY THE,CHAIRMAN OF THE CRA BOARD AND RATIFIED BY SAID BODY. WHEREAS, the Redevelopment Plan of the Southeast Overtown/Park West Community Redevelopment Agency (CRA) desires to assume that any public notices required by the Florida Community Redevelopment Act of 1969 (the "Act") within the CRA Redevelopment Area Overtown Subsection concerning African American Community properties be publicized as necessary in one or more of the categories identified in the enclosed Media List newspapers and determined by the Executive Director; and WHEREAS, the CRA seeks to formalize its advertising criteria, procedures and policy for newspapers which the CRA is permitted to use for publishing public notices and further sEOPW« of- 08 • 0 ITEM 13 listing the names of the only newspapers approved for said use; and WHEREAS, the following criteria and procedures are hereby established to be used for publishing public notices: (1) The newspapers must be well -established in the community and have been in continuous operation for a minimum of two years both locally and statewide, on an as needed basis, as more fully described in the enclosed table. (2) The newspaper must have a circulation of over 10,000 annually. (3) The newspaper must be based in the City of Miami with its primary circulation distributed within City limits and/or outside the City limits, depending on specific circumstances. (4) Any newspaper meeting the established criteria that wishes to be included in the list of newspapers used for publishing public notices may request to the Executive Director of the CRA for consideration; said newspaper shall present to the CRA a certified statement of circulation. In lieu of said certified statement, a sworn statement as to circulation average for the last year and specifically for the past two editions will be accepted. (5) Newspaper must be able to reach a targeted audience that communicates to residents of Overtown, former residents of Overtown, and/or heirs of the residents -of Overtown. NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY OF MIAMI, FLORIDA: Section 1. The recitals and findings contained in the Preamble to this Resolution are hereby adopted by reference thereto and incorporated herein as if fully set forth in this Section. The Executive Director is hereby authorized and directed to advertise all public notices required by the Florida Community Redevelopment Act of 1969 (the "Act") regarding at the acquisition of land and the transfer of land temporarily or permanently, by title, lease or any other appropriate agreement in one or more of the enclosed categories identified for media sources (i.e. newspapers and websites identified for real estate properties in African American Community of the Overtown subsection of the SEO/PW CRA Redevelopment Area and, pursuant to the intent of said "Act" by also any one or more of the newspapers set forth in Exhibit A as determined by the Executive Director. Parekh�Jj Executive DirectoY" RECOMMENDATION 0 0 CITY OF MIAMI, FLORIDA INTER -OFFICE MEMORANDUM DATE: February 20, 2001 FILE : SUBJECT General Media List for Publishing Public Notices In African Community Newspaper REFERENCES : Florida Community Redevelop — ment Act of 1969 City/County ENCLOSURES: Interlocal Agreement It is respectfully requested that its Executive Director of the Southeast Overtown / Park West Community Redevelopment Agency (the "CRA") be authorized by the attached Resolution to assure that public notices for all land acquisitions and transfers by title, lease or other agreements, as required by the Florida Community Redevelopment Act of 1960 ( the "Act"), be published in the newspaper, set forth in Exhibit B of the General Media List, of the African American Community newspapers for properties of the Overtown subsection of the CRA, and, as necessary under the Act, by one or more newspapers set forth in Exhibit: A attached to the Resolution. BACKGROUND The Act and the redevelopment plan of the CRA is required to publish all public notices in the manner set forth in the Act (Section 163.380, Florida Statutes) regarding the acquisition in and transfer of property of the CRA. The County and City Interlocal Agreement, dated march 31, 1982, requires participation by the CRA community in the community redevelopment projects of the CRA. Accordingly the publishing of public notices of real estates acquisitions and transfers plans within the newspapers of Exhibit B is significant in assuring participation in the execution of the CRA Phase I Development Plan approved by the • City and County.
