SEOPW/CRA ITEM 8 SEOPW/CRA 00- 134 A RESOLUTION OF THE BOARD OF DIRECTORS OF THE COMMUNITY REDEVELOPMENT AGENCY ("CRA") AUTHORIZING THE CRA TO ENTER INTO A LEASE AGREEMENT WITH BLACK ARCHIVES FOR THE PROPERTY LOCATED AT 801 NW 2ND AVENUE (P7) PURSUANT TO FLORIDA STATUTES SECTION 163.380 AND THE REDEVELOPMENT PLAN PROJECT FOR PRESERVING HISTORIC BUILDINGS AND THEIR USE FOR THE SURROUNDNG COMMUNITY. WHEREAS, the City of Miami approved and adopted the Southeast Overtown/Park West Community Redevelopment Plan pursuant to Resolution Nos. 82-755 and 85-1247 (the "Redevelopment Plan"); and WHEREAS, the CRA is responsible for carrying out community redevelopment activities and projects in the Southeast Overtown/Park West Redevelopment Area (the "Redevelopment Area") established pursuant to the Redevelopment Plan; and WHEREAS, the CRA desires to enter into a lease agreement with Black Archives for the property located at 801 NW 2nd. Avenue (P7) pursuant to Florida Statutes Section 163.380 and the Redevelopment Plan Project for preserving historic buildings and their use for the surrounding Community. (See Attachment) NOW, THEREFORE, BE IT RESOLVED BY THE BOARD OF DIRECTORS OF THE COMMUNITY REDEVELOPMENT AGENCY OF THE CITY OF MIAMI, FLORIDA: Section 1. The recitals and findings contained in the Preamble to this Resolution are incorporated herein as if fully set forth in this Section. Section 2. The Board of Directors of CRA hereby authorizes the Executive Director to take the necessary steps for transferring by a lease agreement with Black Archives for the property located at 801 NW 2na Avenue (P7) pursuant to Florida Statutes Section 163.380 and the Redevelopment Plan Project for preserving historic buildings and their use for the surrounding Community. 'it is recommended that the property mentioned above (P7) be leased to the Black Archive Foundation for parking and for locating an Air Condition System to be funded by a grant from the Department of State Division of Cultural Affairs. I also appreciate your advise that a City or one of its governmental units, such as the Miami CRA should use a lease agreement for transferring public property to protect the interest of the City should the subject property no longer be used the for the purposes agreed to in the Grant. In closing, the Miami CRA thanks the Department of Cultural Affairs for making available the subject Grant to the Black Archives Foundation (the "Foundation"). The CRA is doing everything possible to transfer sufficient property required for the use of the Grant by lease (at no consideration) in accordance with the Guidelines of the Cultural Affairs and in accordance with Chapter 163.380 of the Florida Statues regarding the transfer of property of the CRA and in accordance with the Interlocal Agreement (03-31-83) with the County that requires approvals of the City and the County and possibly an amendment of the Redevelopment Plan to transfer the property. We will then provide the Guidelines to our City Attorney to advise the CRA of the method of transferring property in accordance with the requirements discussed in the previous paragraph or by other suggestions from the City Attorney to achieve the goals of the CRA herein. The following is taken from the 2 001-2 002 Cultural Facilities Program Guidelines and Application, Tab *6, pages 34-35: TAB.6: OWNERSHIP OR LEASE OF PROPERTY/FACH.JTY Applicant organizations must document ownership or undisturbed use as follows: 1. Legal proof of unrestricted ownership of property and budding. Unrestricted shall mean unqualified ownership and power of disposition. Property that does not meet the unrestricted ownership criterion will not be eligible for match. Documentation may include a deed, title, or copy of a recent tax statement. Provisional sales contracts, binders, or letters of intent are not acceptable documentation of ownership. OR 2. UndhsW rbed use of property for a specific period of time. This specific period of time must begin no later than the deadline date for the application in which funding is requested, and must continue for the minimum period of time required according to the Project Scope. Documentation must include an executed copy of a lease and a written explanation of any easements, covenants, or other conditions affecting the use of the site or facility, or both. Remember, the owner/lessor must be a public entity governed by either a municipality or county, or a not -for -profit entity. The owner of the property must also sign. the "Owner's Page" of the Restrictive Covenants (Attachment C of the Grant Award Agreement).
