SEOPW/CRA R-00-64 A RESOLUTION AUTHORIZING THE COMMUNITY REDEVELOPMENT AGENCY (THE "CRA") TO ENTER INTO LEASES AT MARKET RATES WITH THE LANDOWNERS OF PARCELS P-1 THROUGH P-7 AND M-2 (THE "PARCELS"), WITH ANNUAL RENTS NOT TO EXCEED 10% OF THE APPRAISED VALUE OF EACH SUCH PARCEL, TO ALLOW THE CRA TO UTILIZE THE PARCELS ON AN INTERIM BASIS PENDING THE COMPLETION OF ACQUISITION PROCEEDINGS OR THE RESOLUTION OF TITLE ISSUES WHICH DELAY THE ABILITY OF THE CRA TO ACQUIRE THE PARCELS. WHEREAS, the City of Miami approved and adopted the Southeast Overtown/Park West Community Redevelopment Plan pursuant to Resolution Nos. 82-755 and 85-1247 (the "Redevelopment Plan"); and WHEREAS, the CRA is responsible for carrying out community redevelopment activities and projects in the Southeast Overtown/Park West Redevelopment Area (the "Redevelopment Area") established pursuant to the Redevelopment Plan; and WHEREAS, the CRA desires to enter into leases at market rates with the landowners of the Parcels, with annual rents not to exceed 10% of the appraised value of each such parcel, to allow the CRA to utilize the Parcels on an interim basis pending the completion of acquisition proceedings or the resolution of title issues which delay the ability of the CRA to acquire the Parcels. NOW, THEREFORE, BE IT RESOLVED BY THE BOARD OF DIRECTORS OF THE COMMUNITY REDEVELOPMENT AGENCY OF THE CITY OF MIAMI, FLORIDA: Section 1. The recitals and findings contained in the Preamble to this Resolution are incorporated herein as if fully set forth in this Section. Section 2. The CRA is hereby authorized to enter into leases at market rates with the landowners of the Parcels, with annual rents not to exceed 110% of the appraised value of each such parcel, to allow the CRA to utilize the Parcels on an interim basis pending the completion of acquisition 0- 6 proceedings or the resolution of title issues which delay the ability of the CRA to acquire the Parcels. Section 3. The resolution shall be effective upon its adoption. PASSED AND ADOPTED on this, 26th day of June, 2000. Of Op., Admin. & Development DATE: June 16, 2000 SUBJECT: Ground Use Agreements REFERENCES : NW 3' Ave. Historic Corridor ENCLOSURES: Resolution and Agreement FILE: RECOMMENDATION It is respectfully requested that the Board adopt the attached resolution authorizing the CRA to enter into "Ground Use Agreements" for a limited time period on certain strategic parcels which are crucial to the implementation of the redevelopment plan. BACKGROUND Resolution authorizing the CRA to enter into leases at market rates with the landowners of Parcels P-1 through P-6 , including the Ward Rooming House (M-2), to allow the CRA to utilize the properties on an interim basis pending the completion of acquisition proceedings or the resolution of title issues which delay the ability of the CRA to acquire respective parcels.
