A ORDINANCE OF THE MIAMI CITY COMMISSION A NDING THE CODE OF THE CITY OF MIAMI, FLO IDA, AS AMENDED, TO PROVIDE PROVISIONS TO A THORIZE AND FACILITATE THE COMMUNITY REDEV LOPMENT AGENCY'S MILLENNIUM "MIAMI MEDIA 1 UMINATION PROJECT" ALONG BISCAYNE BOULEVA WITHIN THE REDEVELOPMENT AREA OF THE OUTHEAST/OVERTOWN PARK WEST COMMUNITY EDEVELOPMENT AGENCY BOUNDED BY BISCAYN BOULEVARD ON THE EAST, NORTHEAST 2N AVENUE (EAST SIDE) ON THE WEST, NORTHEA 5TH STREET ON THE SOUTH, AND I-395 ON TH NORTH; DIRECTING THE CITY MANAGER AND THE CITY ATTORNEY TO INITIATE DRAFTING AND A OPTION OF REQUISITE STANDARDS AND CRI RIA TO BE UTILIZED BY RELEVANT CITY DE RTMENTS AND THE COMMUNITY REDEV OPMENT AGENCY, RESPECTIVELY; PROVIDING OR A SUPPLEMENTAL REDEVELOPMENT FEE; OVIDING FOR A REPEALER PROVISION; SEVERA ILITY CLAUSE AND EFFECTIVE DATE; AND PROVIDI FOR INCLUSION IN THE CITY CODE. WHEREAS, Biscayne Boulevard, a major vel%cular and pedestrian thoroughfare within the City of Miami (the "City"), pass s through the City Redevelopment Area of the Southeast Overtown/Park We Redevelopment Agency (the "CRA") and abuts properties currently blighted, i ppropriately developed, or undeveloped; and WHEREAS, the goal and mission of the CRA pursuant to ap)qli legislative findings of Chapter 163, part III, Florida Statutes (the "Act"), Ami- Dade County (the "County") and City Interlocal Agreement, County C City Charter, and Code of the City and County, is to eliminate blight and slum t�Ml�: �► conditions and advancing the welfare of the CRA neighborhood community, especially the needs of the children and the housing needs of the poor pursuant to a Redevelopment Plan approved by the City and the County and when properly implemented property values are substantially increased. WHEREAS, the creation of a special signage illumination display area in other locals, such as the one created in the area of the New York City "Times Square," clearly has had the effect of promoting redevelopment of a previously blighted area, increasing property values, enhancing tourism and providing the area with a positive image that cause additional redevelopment; and WHEREAS, the urban redevelopment agency for the redevelopment area that includes the New York City Time Square, played a pivotal role in its creation, as well as that of the adjacent "Theater Row," thereby demonstrating how an active and well -supported urban redevelopment agency can, in addition to serving the needs of the neighborhood community of the CRA Area, provide benefits to the general public guests of the surrounding area and tourism; and WHEREAS, it is the intention of this City Commission to approve and promote, through the auspices of the CRA, City, Downtown Development Authority and related jurisdictional boards and agencies, the creation of a distinctive media illumination display area adjacent to the Biscayne Boulevard, one of the main landmark vehicular transportation corridors of the City (the "Media Illumination Area") and, concomitantly, provide an additional CRA funding source to specifically support redevelopment and related activities SEOPW/CRA "_ " F� ` •J 2 =OC A--%5t a within the surrounding blighted and slum area of the Media Illumination Area of the CRA; NOW, THEREFORE, BE IT ORDAINED BY THE COMMISSION OF THE CITY OF MIAMI, FLORIDA: Section 1. The recitals and findings contained in the Preamble to this Ordinance are hereby adopted by reference thereto and incorporated herein as if fully set forth in this Section. Section 2. Notwithstanding any City Code provision to the contrary, the Code of the City of Miami, Florida, as amended, is hereby further amended by adding new provisions to said Code in the following particulars: Millennium Miami Media Illumination Project A. Millennium Miami Media Illumination Project created. For execution under the exclusive auspices of the Community Redevelopment Agency, the Millennium "Miami Media Illumination Project" (the "3MMP" or 3MMP Project") is hereby created for implementation in the Media Illumination Area of the Southeast Overtown/Park West Community Redevelopment Agency that is bounded by Biscayne Boulevard on the East, Northeast 2nd Avenue (East Side) on the West, Northeast 5th Street on the South, and I-395 on the North. B. Intent and purpose of the 3MMP. 7; SEOPWICxA,..� 3 D� _-->G� moScG I . ()WRIT,, i 0• The 3MMP is intended to allow, facilitate, and encourage the development of kinetic illuminated media displays utilizing signage, video and all other forms of animated illuminated visual message media within the Media Illumination Area of the Southeast/Overtown Park West Redevelopment Area. The 3MMP shall be used to achieve an overall effect and aesthetic consistency within the private -owned properties within the Media Illumination Area based upon criteria provided for and set forth in the implementing zoning district ordinance provisions and applicable provisions of Chapter 163, Part III, Florida Statutes referred to herein as the Community Redevelopment Act of 1969. It is the purpose of the 3MMP Project to visually enliven a major traffic corridor of the City by establishing a unique local, regional and national identity within the Media Illumination Area; to strengthen the economy of the City by encouraging the development and redevelopment of a depressed, blighted and slum area within a major redevelopment area within the downtown core of the City; and to provide a source of funds to be used exclusively within said redevelopment area for redevelopment related activities, and nothing else. SBOM/-��'D;5wX� v • The 3MMP shall exist solely in the Media Illumination Area of the Southeast Overtown/Park West Redevelopment Area, and nowhere else. C. ZONING APPLICATION. A corresponding Miami Media Illumination Project zoning district (the "Zoning District") for the proposed Media Illumination Area shall be established by ordinance following recommendations by the Planning and Zoning Department and Planning Advisory Board, with an additional optional period prior to the initial consideration by the City Commission and for necessary public comment. D. PERMITS. The review process for property owners to participate in the 3MMP shall be bifurcated. First, and as a condition precedent to further consideration, an applicant shall submit an application to the Executive Director (the "Director") of the Community Redevelopment Agency ("CRA") for review under guidelines and standards related to the legislative findings, purposes and powers set forth in Community Redevelopment Act of 1969, and applicable state, County and City regulations, which shall be formally adopted by the CRA. Upon review and approval of the application by the SEOPWI 5 � � Director, an applicant may then file for planning and zoning, and building approvals from the directors of the departments of Planning and Zoning, and Building. It is intended that the permitting process shall be streamlined to the greatest extent possible. Such review shall be based upon examination of data and information provided by the applicant to ensure that the requested Media Illumination Display meets the criteria requirements for placement in the Zoning District and the respective parcel of property. Any use of a particular property within the Media Illumination Area for a Media Illumination Display purpose pursuant to the requirements of this Ordinance will require the removal of any existing media signage that does not comply with this Ordinance or shall the Media Illumination Display be located on the property in a manner that will reasonably and fairly prevent the development of a Media Illumination Display by other property owners within the Media Illumination Area. (MORE TO COME) E. APPEALS. Within the implementing Zoning District ordinance, there shall be procedures for applicants, the CRA Executive 4? 6 SBOPW/CRA 6 Directive and the Planning Director of the City to appeal decisions on the issuance of subject permits directly to the City Commission for review, as well as criteria and standards used by the City Commission for its review of the appealed decision. F. FEES. There shall be an annual supplemental "Redevelopment Fee" required for participation in the 3MMP. There shall be an additional initial fee required for the kinetic illumination display (the "Illumination Display") permit(s) issued pursuant to the provisions of the Ordinance District. Said fees shall be established within the Zoning Ordinance. (MORE TO COME) The initial and annual Supplemental Fees are to be paid directly to the CRA and shall be utilized exclusively within the CRA's jurisdiction for the enhancement of the CRA area through redevelopment activities and promotion. (MORE TO COME) 3/PWIC" u p -� a---- r_ ✓ Section 3. All ordinances or parts of ordinances insofar as they are inconsistent or in conflict with the provisions of this Ordinance are hereby repealed. Section 4. If any section, part of section, paragraph, clause, phrase or work of this Ordinance is declared invalid, the remaining provisions of this Ordinance shall not be affected. Section 5. It is the intention of the City Commission that the provisions of this Ordinance shall become and be made a part of the Code of the City of Miami, Florida, as amended, which provisions may be renumbered or relettered and that the work "ordinance" may be changed to "section," "article," or other appropriate word to accomplish such intention. Section 6. This Ordinance shall become effective thirty (30) days after final reading and adoption thereof.1 PASSED ON FIRST READING BY TITLE ONLY this day of 2000. 1 This Ordinance shall become effective as specified herein unless vetoed by the Major within ten days from the date it was passed and adopted. If the Mayor vetoes this Ordinance, it shall become effective immediately upon override of the veto by the City Commission or upon the effective date stated herein, whichever is later.
