R-21-0408, IN ORDER TO LIMIT SAID RESTRICTION ON THE DEPARTMENT OF POLICE AND ON THE DEPARTMENT OF FIRE -RESCUE TO ANY AND ALL MOVEMENTS OF MONIES IN EXCESS OF ONE HUNDRED THOUSAND DOLLARS ($100,000.00); PROVIDING FOR AN EFFECTIVE DATE. SPONSOR(S): Commissioner Manolo Reyes, Commissioner Christine King WHEREAS, the City Commission adopted Resolution No. R-21-0408 on October 1, 2021, during a special meeting, which, among other things, established a budgetary restriction on the Department of Police ("Police") and the Department of Fire -Rescue ("Fire -Rescue"); and WHEREAS, the budgetary restriction adopted in Resolution No. R-21-0408 on October 1, 2021, reads, in part, "requiring that notwithstanding anything in Resolution No. R-21-0402 or the Capital Plan to the contrary, an affirmative vote of the City Commission is required prior to any and all movements of monies that are different from the line item -budgets' approved amounts as adopted on September 13, 2021 for the Capital Plan and as adopted on September 23, 2021 for Resolution No. R-21-0402, for the departmental budgets of the Department of Police ("Police") and the Department of Fire -Rescue ("Fire -Rescue"), provided that such requirements shall not apply to Fire -Rescue for Urban Search and Rescue ("USAR") funds, Urban Security Initiative ("UASI") funds, or for movements of money pursuant to a catastrophic event" ("Restriction"); and WHEREAS, it is the desire of the City Commission to modify the Restriction so that the Restriction would only pertain to movements of monies in excess of one hundred thousand dollars ($100,000.00); and WHEREAS, the City Commission confirms that the Restriction is hereby modified so that an affirmative vote of the City Commission is required prior to any and all movements of monies, in excess of one hundred thousand dollars ($100,000.00), for the Police and Fire -Rescue departmental budgets; and WHREAS, this measure will greatly assist the Police and Fire-Recue Chiefs to expeditiously make lawful movements of monies on an administrative basis, which do not exceed one hundred thousand dollars ($100,000.00), and this will facilitate the Chiefs' ability to efficiently respond to departmental needs and initiatives which impact the delivery of services by these two (2) vital departments to residents and businesses of the City of Miami ("City"); and WHEREAS, except as described herein, the Restriction shall continue and shall not be otherwise impacted by this Resolution; and City of Miami Page 1 of 2 File ID: 12119 (Revision:) Printed On: 71512022 File ID: 12119 Enactment Number: R-22-0230 WHEREAS, except as described herein, there are no other modifications to any of the City's budget or related Ordinances or Resolutions for the Fiscal Year commencing October 1, 2021 through September 30, 2022; and WHEREAS, no provision contained in this Resolution shall be construed or interpreted to violate the Anti -Deficiency Act, as set forth in Sections 18-500 through 18-503 of the Code of the City of Miami, Florida, as amended ("City Code"), or the Financial Integrity Principles, as set forth in Sections 18-541 and 18-542 of the City Code; and WHEREAS, it is in the best interest of the City to adopt this legislation; NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY OF MIAMI, FLORIDA: Section 1. The recitals and findings contained in the Preamble to this Resolution are adopted by reference and incorporated as if fully set forth in this Section. Section 2. The City Commission amends the Restriction established pursuant to Resolution No. R-21-0408 in order to limit the Restriction on Police and Fire -Rescue to any and all movements of monies in excess of one hundred thousand dollars ($100,000.00). Section 3. This Resolution shall become effective immediately upon its adoption and signature by the Mayor.'
