PZ-19-2851 08/28/19 /C Re: Comprehensive Plan Amendment (PZ-19-4165) and Rezoning (PZ49-2851) for the Property Located at 444 Southwest 2i" Avenue in the City of Mianti, Florida Dear Mr. Garcia, The Department of Real Estate and Asset Management ("DREAM") represents the City of Miami (the "Applicant") in relation to requests for a Miami Comprehensive Neighborhood Plan ("MCNP") amendment and rezoning of the property comprised of two tracts located at 444 SW 2"d AVE and 460 SW 2"d AVE, in the City of Miami, Florida (collectively, the "Property'). See Exhibit 1, Property Appraiser Summa))- Reports. The Applicant seeks two items: I. An MCNP amendment of the Property, from "Major Institutional, Public Facilities, Transportation, and Utilities (Major PUB FAC)" to "Restricted Commercial;" and, 2. A rezoning of the Property from Civic Institutional ("Cl") to 1'6-36B-0, Urban Core. Please, allow this letter to serve as the required letter of intent, in connection with the foregoing requests for the MCNP amendment and rezoning of the Property. Property. The Property is, approximately, 3.15 acres, located on the west side of SW 2"d AVE, between the Miami River and SW Yd Street. Specifically, the Property is located at the southwest corner of a signalized traffic intersection with four (4) pedestrian crosswalks. As mentioned above, the Property is zoned Cl and is abutting a property zoned T6-3613-0, to the north, and the Miami River Special Area Plan, to the south. See Figure A, below. The property directly north is zoned T6-36B-0 and is undeveloped. The property to the east is zoned Cl and has been developed with an FPL power plant. The property to the south is zoned T6-3613-0 and D3 - the Miami River Special Area Plan - and is undeveloped, but for a defunct restaurant which is situated along the River. Further, the properties located west of I-95 are designated Restricted Commercial, on the Future Land Use Map ("FLUM"), with the exception of the Property and the aforementioned FPL power plant, which have a future land use designation of "Major Institutional, Public Facilities, Transportation, and Utilities (Major PUB FAC)." PZ-19-2851 08/28/19 Request The Applicant brings forth this request, in order to allow for redevelopment of the Property which would provide a much -needed transition from the directly abutting T6-3613-0 transect, on the north, to the adjacent Miami River Special Area Plan. Article 7, Section 7.1.2.8.a.I of Miami 21 states, "When a Cl zoned property ceases to be used for Civic functions, the successional rezoning is determined by identifying the lowest Intensity Abutting' Transect Zone, and rezoning to that Zone's next higher Intensity Zone." Here, the Property is used as the City of Miami's administrative headquarters ("MRC"), which is a Civic function. Pursuant to the November 2018 referendum, the voters overwhelmingly approved the Applicant's request for the disposition of the Property to a private developer ("Lancelot"). The referendum approval was the culmination of a Request for Proposal ("RFP") process wherein Lancelot was selected as the most responsive, responsible proposer to acquire the Property. In its proposal, Lancelot offered to acquire the Property and redevelop the MRC at another location. The Applicant's rezoning of the Property is a condition to Lancelot's consummation of the acquisition of the Property. Accordingly, in an effort to fulfill is legal obligations vis-a-vis the RFP, effectuate the will of the people, and maintain uniform zoning and land use designation in this area, the Applicant respectfully requests the Property be rezoned to T6-3613-0 and for the land use description to be changed to Restricted Commercial. Here, not only does this proposal involve the extension of an existing transect boundary, discussed in the preceding paragraph, but the Property consists of, approximately, 137,125 square feet of land area. Therefore, the criteria, set forth above, has been satisfied, and rezoning of the Property should be favorably considered. Furthermore, an analysis, pursuant to Article 7, Section 7.1.2.8.c.2.(g) of Miami 21, is not required. Said analysis is only required when an application for rezoning is made by any person or entity other than the City Commission; the Planning and Zoning Appeals Board; and, any other department, board or agency of the City. Here, the Applicant is DREAM, which is a department of the City. As such, the analysis required by Section 7.1.2.8.c.2.(g) is not germane to this Applicant. Criteria. Article 7, Section 7.1.2.8.f. of Miami 21 states the criteria for amendments to Miatni 21. The section provides: (a) The relationship of the proposed amendment to the goals, objectives and policies of the Comprehensive Plan, with appropriate consideration as to whether the proposed change will further the goals, objectives and policies of the Comprehensive Plan; the Miami 21 Code; and other city regulations. (b) The need and justification for the proposed change, including changed or changing conditions that snake the passage of the proposed change necessary. The proposed amendment is consistent with the goals, objectives and policies of the MCNP. For instance, Objective LU-1.3 of the MCNP states, as follows: The City will continue to encourage commercial, office and industrial development within existing commercial, office and industrial areas; increase the utilization and enhance the physical character and appearance of existing buildings; encourage the development of well -designed, mixed -use neighborhoods that provide for a variety of uses within a walkable area in accordance with neighborhood design and development standards adopted as a result of the amendments to the Qy's land development regulations and other initiatives; and concentrate new commercial and industrial activity in areas where the capacity of existing public facilities can meet or exceed the rninimum standards for Level of Service (LOS) adopted in the Capital Improvement Element (CIE) (Emphasis added). The Property is located within an area, designated on the FLUM as "Major PUB, FAC" use, with the Urban Central Business District overlay. The Applicant requests the abovementioned land -use amendment and rezoning, in order to enhance the commercial character of the Property. Namely, the Property is located in a rapidly changing area of the Urban Core which fronts the Miami River. To highlight the significance of the Property's location, the Applicant's request is consistent with the existing abutting Restricted Commercial designation to the north, as well as with the changing character of the neighborhood, including the development of the large mixed -use projects located in close proximity to the Property, such as the Miami River Special Area Plan, Riverside Wharf, Brickell City Centre Special Area Plan Amendment III, and One River Point. Additionally, the Property is locate 08/28/19 proximity to several Metrorail (Government Center and Brickell) and Metromover (Government Miami Avenue, Third Street and Riverwalk) stations. A positive recommendation of the Applic request will permit mixed -use development compatible with the surrounding area, which will help support the adjacent commercial, civic, and residential uses, as well as fulfill the Transit Oriented Development policies set forth in Policy LU-1.1.10, HO-1.1.9, and TR-1.1.5. consistent with Objective LU-1.3 of the MCNP, as cited above. Moreover, Policy LU-1.3.15 of the MCNP states, "The City will continue to encourage a development pattern that enhances existing neighborhoods by developing a balanced mix of uses including areas for employment, shopping, housing, and recreation in close proximity to each other." The Applicant's proposal furthers this Policy by encouraging a development pattern that better balances a mix of uses and, also, provides much -needed transitioning between intensities. The adjacent area has seen a shift towards higher density and mixed -use structures that often incorporate residential and commercial uses. The proposed requests recognize the existing development pattern in this area, and it would allow the Property to be developed in a manner consistent with how the location is growing. Thus, approval of this application encourages a development pattern that enhances the existing neighborhood by allowing for development that provides a balanced mix of uses. Conclusion. The Applicant respectfully requests the aforementioned rezoning and FLUM amendment, in order to allow for a more balanced mix of uses on the Property, Due to current initiatives in the City and County, there has been a revitalization of properties fronting the Miami River, such as the Property. The adjacent area has been and will continue to be economically revitalized and reenergized. See Exhibit 1, Property Appraiser Summary Reports. The Applicant seeks two items: An MCNP amendment of the Property, from "Major Institutional, Public Facilities, Transportation, and Utilities (Major PUB FAC)" to "Restricted Commercial;" and, 2. A rezoning of the Property from Civic Institutional ("Cl") to T6-3613-0, Urban Core. Please, allow this letter to serve as the required letter of intent, in connection with the foregoing requests for the MCNP amendment and rezoning of the Property. Pro e . The Property is, approximately, 3.15 acres, located on the west side of SW 2nd AVE, between the Miami River and SW 3rd Street. Specifically, the Property is located at the southwest corner of a signalized traffic intersection with four (4) pedestrian crosswalks. As mentioned above, the Property is zoned CI and is abutting a property zoned T6-36B-0, to the north, and the Miami River Special Area Plan, to the south. See Figure A, below. The property directly north is zoned T6-3613-0 and is undeveloped. The property to the east is zoned CI and is developed with an FPL power plant. The property to the south is zoned T6-3613-0 and D3 - the Miami River Special Area Plan - and is undeveloped, but for a defunct restaurant which is situated along the River. [The remainder of this page has been intentionally left blank.] DEPARTMENT OF REAL ESTATE AND ASSET MANAGEMENT 444 Southwest 2nd Avenue, 3rd Floor, Miami, Florida 33130 / (305) 416-1450 Figure A: Zoning Map Request The Applicant brings forth this request, in order to allow for redevelopment of the Property which would provide a much -needed transition from the directly abutting T6-3613-0 transect, on the north, to the adjacent Miami River Special Area Plan. Article 7, Section 7.1.2.8.a.1 of Miami 21 states, "When a Cl zoned property ceases to be used for Civic functions, the successional rezoning is determined by identifying the lowest Intensity Abutting' Transect Zone, and rezoning to that Zone's next higher Intensity Zone." Here, the Property is used as the City of Miami's administrative headquarters ("MRC"), which is a Civic function. Pursuant to the November. 2018 referendum, the voters overwhelmingly approved the Applicant's request for. the disposition of the Property to a private developer ("Lancelot"). The referendum approval was the culmination of a Request for Proposal ("RFP") process wherein Lancelot was selected as the most responsive, responsible proposer to acquire the Property. In its proposal, Lancelot offered to acquire the Property and redevelop the MRC at another location. The Applicant's rezoning of the Property is a condition precedent to Lancelot's consummation of the acquisition of the Property. Accordingly, in an effort to fulfill is legal obligations vis-a-vis the RFP, effectuate the will of the people, and maintain uniform zoning in this area, the Applicant respectfully requests the Property be rezoned to T6-36B-0. Moreover, Article 7, Section 7.1.2.8.c. of Miami 21 provides a rezoning of land will only be considered where the proposal involves an extension of an existing transect boundary, unless the rezoning 1 Abutting: To reach or touch; to touch at the end or be contiguous with; join at a border or boundary; terminate on. Abutting properties include properties across a street or alley. See Miami 21, Article 1, Section 1.2. 2 of 4 involves at least 40,000 square feet of land area or 200 feet of street frontage on one street (Emphasis added). Here, not only does this proposal involve the extension of an existing transect boundary, as discussed in the preceding paragraph, but the Property consists of, approximately, 137,125 square feet of land area. Therefore, the criteria, set forth above, has been satisfied, and rezoning of the Property should be favorably considered. Further, an analysis, pursuant to Article 7, Section 7.1.2.8.c.2.(g) of Miami 21, is not required. Said analysis is only required when an application for rezoning is made by any person or entity other than the City Commission; the Planning and Zoning Appeals Board; and, any other department, board or agency of the City. Here, the Applicant is DREAM, which is a department of the City. As such, the analysis required by Section 7.1.2.8.c.2.(g) is not germane to this Applicant. Criteria. Article 7, Section 7.1.2.8.f. of Miami 21 states the criteria for amendments to Miami 21. The section provides: (a) The relationship of the proposed amendment to the goals, objectives and policies of the Comprehensive Plan, with appropriate consideration as to whether the proposed change will further the goals, objectives and policies of the Comprehensive Plan; the Miami 21 Code; and other city regulations. (b) The need and justification for the proposed change, including changed or changing conditions that make the passage of the proposed change necessary. The proposed amendment is consistent with the goals, objectives and policies of the MCNP. For instance, Objective LU-1.3 of the MCNP states, as follows: The City will continue to encourage commercial, office and industrial development within existing commercial, office and industrial areas; increase the utilization and enhance the physical character and appearance of existing buildings; encourage the development of well -designed, mixed -use neighborhoods that provide for a variety of uses within a walkable area in accordance with neighborhood design and development standards adopted as a result of the amendments to the City's land development regulations and other initiatives; and concentrate new commercial and industrial activity in areas where the capacity of existing public facilities can meet or exceed the minimum standards for Level of Service (LOS) adopted in the Capital Improvement Element (CIE) (Emphasis added). The Property is located within an area, designated on the Future Land Use Map, as "Major PUB, FAC," use. The Applicant requests the abovementioned land -use amendment and rezoning, in order to enhance the commercial character of the Property. Namely, the Property is located in a rapidly changing area of the Urban Core which fronts the Miami River. To highlight the significance of the Property's location, the Applicant's request is consistent with the existing abutting Restricted Commercial designation to the north, as well as with the changing character of the neighborhood, including the development of the large mixed -use projects located in close proximity to the Property, such as the Miami River Special Area Plan, Riverside Wharf, Brickell City Centre Special Area Plan Amendment III, and One River Point. Moreover, the intersection of SW 2nd AVE and SW 3`d Street includes several pedestrian crosswalks and a traffic signal to regulate traffic flow, which is an implicit indication the Property is located in an area that was expected to grow, as evidenced by the traffic infrastructure already in place. The Applicant's request will better utilize the already commercially designated area, by 3 of 4 permitting more compatible mixed -use development which will help to support the adjacent commercial, civic, and residential uses. Thus, approval of this application would encourage the development of a mixed -use neighborhood that provides for a variety of uses within a walkable area, which is consistent with Objective LU-1.3 of the MCNP, as cited above. Further, Policy LU-1.3.15 of the MCNP states, "The City will continue to encourage a development pattern that enhances existing neighborhoods by developing a balanced mix of uses including areas for employment, shopping, housing, and recreation in close proximity to each other." The Applicant's proposal furthers this Policy by encouraging a development pattern that better balances a mix of uses and, also, provides much -needed transitioning between intensities. The adjacent area has seen a shift towards higher density and mixed -use structures that often incorporate residential and commercial uses. The proposed requests recognize the existing development pattern in this area, and it would allow the Property to be developed in a manner consistent with how the location is growing. Thus, approval of this application encourages a development pattern that enhances the existing neighborhood by allowing for development that provides a balanced mix of uses. Conclusion. The Applicant respectfully requests the aforementioned rezoning in order to allow for a more balanced mix of uses on the Property. Due to current initiatives in the City and County, there has been a revitalization of properties fronting the Miami River, such as the Property. The adjacent area has been and will continue to be economically revitalized and reenergized. Accordingly, the changed and changing conditions make this request necessary in order to best utilize the Property as a mixed -use development to further benefit the neighborhood.
