Subject: Auth City Manager - Off -System Construction and Maintenance Agreement
Purpose of Item:
A resolution of the Miami City Commission authorizing the City Manager to execute an
Off -System Construction and Maintenance Agreement with FDOT for improvements on
SR-9-A, 1-95 ramps Southbound off Ramps to SW 25th Road, a portion of which
includes work on the following roads and not on the Highway State Systems.
Background of Item:
The Parties agree that the Department intends to undertake and complete project
number FPID# 443896-1-52-01 on SR 9A/ 1-95 ramps from a rigid pavement
rehabilitation project which includes widening and reconstruction of the existing roadway
with flexible and concrete pavement, replacement of signals, pull boxes, light pole
relocation, curb ramps reconstruction, and new drainage. The Project includes
improvements on SW 25th Road, a road not on the State Highway System, extending
from east of NB On -Ramp to I-95 to west of SB Off -Ramp from I-95. The improvements
include milling and resurfacing of the existing pavement, new drainage structures,
driveway reconstruction, curb ramp reconstruction, pavement markings, signage, and
adjustment of existing manholes and valves, new signal mast arms, controller cabinet,
conduits and pull as set forth in Exhibit A.

A RESOLUTION OF THE MIAMI CITY COMMISSION, WITH ATTACHMENT(S),
AUTHORIZING THE CITY MANAGER TO EXECUTE AN OFF -SYSTEM
CONSTRUCTION AND MAINTENANCE AGREEMENT, IN SUBSTANTIALLY THE
ATTACHED FORM, WITH THE FLORIDA DEPARTMENT OF TRANSPORTATION
FOR IMPROVEMENTS ON STATE ROAD 9A/INTERSTATE 95 SOUTHBOUND OFF
RAMPS TO SOUTHWEST 25TH ROAD, A PORTION OF WHICH INCLUDES WORK
ON SOUTHWEST 25TH ROAD THAT IS NOT ON THE STATE HIGHWAY SYSTEM.
WHEREAS, the Florida Department of Transportation (TDOT") has developed plans
under Project Number FPID# FM# 443896-1-52-01 for improvements on State Road 9A ("SR-
9A")/Interstate 95 (1-95") Southbound off ramp to Southwest 25th Road, which includes but is
not necessarily limited to widening and reconstruction of the existing roadway with flexible and
concrete pavement, replacement of signals, pull boxes, light pole relocation, curb ramps
reconstruction, and new drainage ("Project"); and
WHEREAS, FDOT intends to undertake and complete the Project, a portion of which
includes work on right(s)-of-way not on the State Highway System but City of Miami ("City")
right-of-way, specifically a portion of Southwest 251" Road; and
WHEREAS, the Project includes milling and resurfacing of the existing pavement, new
drainage structures, driveway reconstruction, curb ramp reconstruction, pavement markings,
signage, and adjustment of existing manholes and valves, new signal mast arms, controller
cabinet, conduits and pull boxes ("Local Roadway Improvements") and all activities associated
with, or arising out of the construction of the Local Roadway Improvements; and
WHEREAS, the Off -System Construction and Maintenance Agreement ("Agreement"),
attached and incorporated as Exhibit "A", establishes the terms, conditions, and responsibilities
of FDOT and the City to accomplish the Project and Local Roadway Improvements on the City's
right(s)-of-way; and
WHEREAS, the City finds that it is in the best interest of the City and its residents to
enter into this Agreement in order to allow the Department to construct and complete the
Project;
NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY OF
MIAMI, FLORIDA:
Section 1. The recitals and findings contained in the Preamble to this Resolution are
adopted by reference and incorporated as if fully set forth in this Section.
Section 2. The City Manager is hereby authorized' to execute an Off -System
Construction and Maintenance Agreement, in substantially the attached form, with FDOT for
improvements on SR-9A/1-95 Southbound off ramps to Southwest 25t" Road, a portion of which
includes work on Southwest 251" Road that is a City road and not on the State Highway System.
Section 3. This Resolution shall become effective immediately upon its adoption.

Pursuant to the resolution, this item became effective immediately upon adoption by the Commission.
The herein authorization is further subject to compliance with all legal requirements that may be

provisions.
