AN ORDINANCE OF THE MIAMI CITY COMMISSION AMENDING CHAPTER
18/ARTICLE III OF THE CODE OF THE CITY OF MIAMI, FLORIDA, AS AMENDED
("PROCUREMENT CODE"), TITLED "FINANCE/CITY OF MIAMI PROCUREMENT
ORDINANCE", MORE PARTICULARLY BY AMENDING PROCUREMENT CODE
SECTION 18-72, TITLED "APPLICATION AND EXCLUSIONS", SECTION 18-73,
TITLED "DEFINITIONS", AND SECTION 18-116, TITLED "PERSONS RETAINED AS
EXPERT CONSULTANTS", TO ADD THE WORDS "OR FIRMS"; CONTAINING A
SEVERABILITY CLAUSE AND PROVIDING FOR AN IMMEDIATE EFFECTIVE DATE.
WHEREAS, the City of Miami ("City") Department of Procurement ("Procurement') finds
it necessary and in the best interest of the City to amend Section 18-72, titled "Application and
Exclusions", Section 18-73, titled "Definitions", and Section 18-116, titled "Persons Retained as
Expert Consultants", of Chapter 18/Article III of the Code of the City of Miami, Florida, as
amended ("Procurement Code"), to add the words "or Firms";
NOW, THEREFORE, BE IT ORDAINED BY THE COMMISSION OF THE CITY OF
MIAMI, FLORIDA:
Section 1. The recitals and findings contained in the Preamble to this Ordinance are
adopted and incorporated as fully set forth in this Section.
Section 2. The Procurement Code is further amended in the following particulars:'

ARTICLE III. CITY OF MIAMI PROCUREMENT ORDINANCE
Sec. 18-72. Application and exclusions.
(b) Exclusions. This article shall not apply to:

Forthe purposes of this article, the following terms shall have the meanings ascribed to
them in this section:
Persons or firms retained as expert consultants means ir._iVi._11;i5 aGt;ng as
independent contractors retained by the city manager on a contract basis with a
specific term for the purpose of performing specialized defined tasks that require
knowledge, skills and training not otherwise available to the city by temporary or
permanent members of the classified or unclassified service and which tasks, by
their nature, require independent and autonomous judgment. Remuneration for
the services of such persons or firms shall not exceed one hundred twenty-five
thousand dollars ($125,000.00) in any one year, and shall be payable on a per
diem basis.
Sec. 18-1 16. Persons or firms retained as expert consultants.
The city manager shall have the authority and sole discretion to contract with persons
or firms retained as expert consultants, without city commission approval. No
employment emoluments shall be provided to persons or firms retained as expert
consultants.

Section 3. If any section, part of a section, paragraph, clause, phrase, or word of this
Ordinance is declared invalid, the remaining provisions of this Ordinance shall not be affected.
Section 4. This Ordinance shall become effective immediately upon its adoption and
signature of the Mayor.2

2 This Ordinance shall become effective as specified herein unless vetoed by the Mayor within ten (10)
days from the date it was passed and adopted. If the Mayor vetoes this Ordinance, it shall become
effective immediately upon override of the veto by the City Commission or upon the effective date stated
herein. whichever is later.
