A resolution of the Miami City Commission to authorize the City Manager to accept
perpetual sidewalk easements from Rogelio Soto for 2931 SW 23rd Terrace for ongoing
Capital Improvement Project 40-1350420 in the construction phase.
Background of Item:
Perpetual sidewalk easements are required from the private property owner for the
abutting property having the street address 2931 SW 23rd Terrace listed on the
attached Exhibit A, allowing the City access and use of the property for the construction
and maintenance of various ongoing Capital Improvement Projects.

A RESOLUTION OF THE MIAMI CITY COMMISSION AUTHORIZING THE CITY
MANAGER TO ACCEPT A PERPETUAL SIDEWALK AND UTILITIES EASEMENT, IN
A FORM ACCEPTABLE TO THE CITY ATTORNEY, FROM THE PRIVATE
PROPERTY OWNER OF 2931 SOUTHWEST 23 TERRACE, MIAMI, FLORIDA,
ALLOWING THE CITY OF MIAMI ACCESS AND USE OF THE PROPERTY FOR THE
CONSTRUCTION AND MAINTENANCE OF OFFICE OF CAPITAL IMPROVEMENTS
PROJECT NO. 40-1350420 AND ENSURING PUBLIC INGRESS AND EGRESS.
WHEREAS, the City of Miami's ("City") Office of Capital Improvements Project No. 40-
B50420 ("Project") includes driveway approaches, sidewalks, curbs, a new drainage system,
milling and resurfacing, reconstruction, overbuild, pavement marking, and swale regrading and
sodding on Southwest 29 Avenue from Southwest 23 Terrace to Southwest 23 Street; and
WHEREAS, a perpetual sidewalk and utilities easement is required from the private
property owner of 2931 Southwest 23 Terrace, Miami, Florida to allow the City access and use
of the property for the construction and maintenance of the Project and to ensure public ingress
and egress;
NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY OF
MIAMI, FLORIDA:
Section 1. The recitals and findings contained in the Preamble to this Resolution are
adopted by reference and incorporated as if fully set forth in this Section.
Section 2. The City Manager is authorized' to accept a perpetual sidewalk and utilities
easement, in a form acceptable to the City Attorney, from the private property owner of 2931
Southwest 23 Terrace, Miami, Florida.
Section 3. This Resolution shall become effective immediately upon its adoption.
