WHEREAS, the City of Miami's ("City") Office of Capital Improvements Project No. 40- B50420 ("Project") includes driveway approaches, sidewalks, curbs, a new drainage system, milling and resurfacing, reconstruction, overbuild, pavement marking, and swale regrading and sodding on Southwest 29 Avenue from Southwest 23 Terrace to Southwest 23 Street; and WHEREAS, a perpetual sidewalk and utilities easement is required from the private property owner of 2931 Southwest 23 Terrace, Miami, Florida to allow the City access and use of the property for the construction and maintenance of the Project and to ensure public ingress and egress; NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY OF MIAMI, FLORIDA: Section 1. The recitals and findings contained in the Preamble to this Resolution are adopted by reference and incorporated as if fully set forth in this Section. Section 2. The City Manager is authorized' to accept a perpetual sidewalk and utilities easement, in a form acceptable to the City Attorney, from the private property owner of 2931 Southwest 23 Terrace, Miami, Florida. Section 3. This Resolution shall become effective immediately upon its adoption.
