WHEREAS, except for such changes as set forth herein, all previous appropriations remain authorized to continue as previously approved City of Miami ("City") capital projects (new, revised, and continued projects collectively, "Projects") according to the Fiscal Year 2021- 2022 Multi -Year Capital Plan adopted on September 13, 2021 pursuant to Resolution No. R-21- 0353 ("Adopted Capital Plan"), as may be amended from time to time; and WHEREAS, it is now necessary to de -appropriate funds in the total amount of Four Million, Five Hundred Sixteen Thousand Dollars ($4,516,000.00) ("Funds") previously allocated to Office of Capital Improvements ("OCI") Project Nos. 40-Bl83505, 40-Bl73723, and 40- B40563, and re -appropriate the Funds to OCI Project Nos. 40-Bl83506, 40-1340563, 40- B50414, and 40-1350421, all as set forth in Exhibit "A," attached and incorporated; and WHEREAS, American Rescue Plan Act of 2021 ("ARPA") Funds are also included in this re -appropriation; and WHEREAS, the Secretary of the United States Department of the Treasury issued the final rule (31 CFR Part 35) to implement the Coronavirus State Fiscal and Local Fiscal Recovery Funds ("ARPA Funds") established under the American Rescue Plan ("Final Rule"); and WHEREAS, the Final Rule establishes the guidance and eligible uses of the ARPA Funds; and WHEREAS, the re -appropriation of the ARPA Funds to OCI Project Nos. 40-1350414 and 40-1350421 is conditional and subject to the prior written approval by the City's ARPA Consultants as an eligible use of ARPA Funds under the Final Rule; NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY OF MIAMI, FLORIDA: Section 1. The recitals and findings contained in the Preamble of this Resolution are adopted by reference thereto and incorporated herein as if fully set forth in this Section. Section 2. The City Commission hereby approves and authorizes' the City Manager to de -appropriate the Funds previously allocated to OCI Project Nos. 40-Bl83505, 40-Bl73723, and 40-1340563 and re -appropriate the Funds to OCI Project No. 40-Bl83506, 40-1340563, 40- B50414, and 40-1350421, all as set forth in Exhibit "A," attached and incorporated, subject to final written approval by the City's ARPA Consultants. Section 3. Certain necessary actions by the City Manager and designated City officials and departments made in order to update the City's relevant financial controls and computer systems, for project close-outs, and for grants and other funding sources in progress in connection with the Fiscal Year 2021-22 Capital Plan, Exhibit "A," attached and incorporated, and the Final Budget to implement the Projects in connection herewith are ratified, approved, and confirmed. Section 4. Z If the Mayor does not sign this Resolution, it shall become effective at the end of ten (10) calendar days from the date it was passed and adopted. If the Mayor vetoes this Resolution, it shall become effective immediately upon override of the veto by the City Commission.
