Min Deputy Attorney Review Completed 03/29/2022 5:32 PM Office of the City Attorney Victoria Mendez Approved Form and Correctness Completed 04/05/2022 10:31 AM Office of the City Clerk City Clerk's Office Rendered Completed 04/05/2022 11:53 AM of .�f City of Miami CityHall * iM°nr °°°rE° * 11 °° Legislation 3500 Pan American Drive g Miami, FL 33133 Resolution www.miamigov.com Enactment Number: R-22-0071 File Number: 11519 Final Action Date:2/10/2022 A RESOLUTION OF THE MIAMI CITY COMMISSION DIRECTING THE CITY MANAGER TO RELEASE ANY AND ALL REPORTS, BODY WORN CAMERA RECORDINGS, AND RECORDS PERTAINING TO THE JANUARY 5, 2022 VEHICULAR COLLISION INVOLVING A MIAMI POLICE DEPARTMENT ("MPD") OFFICER TO EACH MEMBER OF THE CITY COMMISSION AND TO THE PUBLIC AS SOON AS SAID MATERIALS ARE AVAILABLE CONSISTENT WITH STATE OF FLORIDA ("STATE") LAWS AND THE MPD'S PUBLIC RECORDS POLICIES; FURTHER DIRECTING THE CITY MANAGER, UPON THE CONCLUSION OF ANY PENDING INVESTIGATION BY AN OUTSIDE AGENCY, TO COMMENCE AN INTERNAL INVESTIGATION TO DETERMINE WHETHER ANY CITY OF MIAMI ("CITY") AND/OR MPD PERSONNEL VIOLATED ANY CITY ADMINISTRATIVE POLICIES OR ANY MPD DEPARTMENTAL ORDERS, STANDARD OPERATING PROCEDURES, OR STATE REGULATIONS PERTAINING TO OR STEMMING FROM THE INVESTIGATION OF SAID INCIDENT AND TO TAKE ANY APPROPRIATE ACTION UPON THE CONCLUSION OF THE INVESTIGATION. WHEREAS, Section 24 of the Florida Constitution and the Florida Public Records Act, Chapter 119, Florida Statutes, confers on the public the right to inspect and copy any records made or received by the City of Miami ("City") and its agencies in the course of official City business; and WHEREAS, the City, its employees, and its agencies must be dedicated to fostering an open and transparent process for the public to request, inspect, and copy non-exempt public records within a reasonable period of time; and WHEREAS, it is the will of the City Commission to proactively publish and make City records available to the public to enhance accountability and transparency; and WHEREAS, it is also the will of the City Commission to make the records pertaining to the January 5, 2022 incident readily available for inspection and copying by the public; NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY OF MIAMI, FLORIDA: Section 1. The recitals and findings contained in the Preamble to this Resolution are adopted by reference and incorporated as fully set forth in this Section. Section 2. The City Manager is hereby directed to release any and all reports, body worn camera recordings, and records pertaining to the January 5, 2022 vehicular collision involving a Miami Police Department ("MPD") officer to each member of the City Commission and to the public as soon as said materials are available consistent with State of Florida ("State") laws and MPD's public records request policies. Section 3. The City Manager is further directed, upon the conclusion of any pending investigation by an outside agency, to commence an internal investigation to determine whether any City and/or MPD personnel violated any City administrative policies or any MPD departmental orders, standard operating procedures, or State regulations pertaining to or stemming from the investigation of said incident and to take any appropriate action upon the conclusion of the investigation. Section 4. This Resolution shall become effective immediately upon its adoption.
