HomeMy WebLinkAboutExhibit BCity of Miami F�G`�� oF•� City Hall 3500 Pan American Drive Legislation Miami, FL 33133 www.miamigov.com AIPP Resolution: AIPP-R-21-013 File Number: 9235 Final Action Date: 7/19/2021 A RESOLUTION OF THE MIAMI ART IN PUBLIC PLACES BOARD, WITH ATTACHMENT(S), RECOMMENDING APPROVAL TO THE MIAMI CITY COMMISSION TO ADOPT AND AMEND THE APPLICABLE SECTIONS OF THE MIAMI DADE COUNTY PUBLIC ART MASTER PLAN IN ACCORDANCE WITH ARTICLE 11 OF THE MIAMI 21 CODE AND CHAPTER 62, ARTICLE XVI OF THE CITY CODE TITLED ART IN PUBLIC PLACES; CONTAINING A SEVERABILITY CLAUSE AND PROVIDING FOR AN IMMEDIATE EFFECTIVE DATE. WHEREAS, on January 12th, 2017, pursuant to Ordinance No. 13656 and 13657 the Miami City Commission enacted Phase I of the Art in Public Places Program; established the Art in Public Places Program, the Public Art Fund, and the Art in Public Places Board (AIPPB), with its functions, duties, and powers. WHEREAS, Pursuant to Section 62-655(c)(1)(2), the AIPPB, with the assistance and recommendation of the Planning Department, Public Art Division, and all other City Departments, as necessary, shall have the function, duties, and powers "To recommend the public art program guidelines and amendments to the public art program guidelines thereto to the city commission"; and "To recommend the public art master plan and amendments to the public art master plan thereto to the city commission". WHEREAS, Pursuant to Article 11, Section 11.3, The Public Art Master Plan and the Public Art Program Guidelines shall be prepared by the Public Art Division and subject to approval of the City Commission, pursuant to a recommendation by the AIPPB. WHEREAS, on October 19, 2020 the Art in Public Places Board pursuant to Resolution No. AIPP-R-20-018 attached hereto as exhibit `A" approved with conditions the expenditure of one hundred twenty thousand dollars ($120,000.00) for consulting services for the execution of a citywide community driven Public Art Master Plan, Program Guidelines, and a new Arts, Culture and the Creative Economy Element to the Miami Neighborhood Comprehensive Plan ("MCNP"). WHEREAS, at the direction of the AIPPB, Planning staff has been working with the Procurement Department on drafting a comprehensive Request for Proposals (`RFP") for said consulting services which shall be release in the fall of 2021. WHEREAS, in the interim, Planning staff after consulting with the Office of the City Attorney is requesting that the AIPPB move to recommend to the Miami City Commission to adopt and amend the applicable sections of the Miami -Dade County Public Art Master Plan attached hereto as Exhibit "B", as the City of Miami Public Art City of Miami Page 1 of 3 File ID: 9235 (Revision:) Printed On: 212212022 File ID: 9235 Enactment Number: AIPP-R-21-013 Master Plan in accordance with Article 11 of the Miami 21 Code and Chapter 62, Article XVI of the City Code. WHEREAS, Planning staff has made the necessary amendments to the Miami - Dade County Master Plan, as applicable in accordance with the City Code which shall be known as the City of Miami "Public Art Master Plan". WHEREAS, Planning staff finds the amended Public Art Master Plan to be consistent with the intent and purpose for which the Public Art Sections of Code was adopted. NOW, THEREFORE, BE IT RESOLVED BY THE ART IN PUBLIC PLACES BOARD OF THE CITY OF MIAMI, FLORIDA: Section 1. The recitals and findings contained in the Preamble to this Resolution are adopted by reference and incorporated as if fully set forth in this Section. Section 2. The AIPPB recommends the Miami City Commission adopt and amend the applicable sections of the Miami -Dade County Public Art Master Plan, which shall be known as the City of Miami Public Art Master Plan with the following conditions: 1. The adopted and amended Public Art Master Plan is intended to be interim until the adoption and execution of the City's own Public Art Master Plan as a result of the RFP. 2. Section III of the Implementation Guidelines shall state that that each Professional Advisory Committee ("PAC") shall include three (3) members that are professional advisors in art selected by the AIPPB and one (1) community liaison appointed by the Commissioner of the district in which the artwork will be displayed. 3. Section 1(F) of the Master Plan shall state, "To provide equitable access to a diversity of artists and artistic experiences, with emphasis towards local artists." 4. Planning staff is directed to create "Section XIII. Grants" regarding the process for the issuance of grants in accordance with Section 62-661 of the City Code. 5. The following corrections shall be made: a. In the Introduction, the AIPPB shall be defined as the "Board" and referenced as such throughout the entire document. b. In the Introduction, "Section 62-655(c)(3)" shall be amended to "Section 62-655(c)." c. In Section IV(B)(2) of the Master Plan, "Beaches" shall be amended to "Waterfronts." d. In the Implementation Guidelines, the first reference to "PAC" shall be amended to "("PAC")". e. In the final line of the document, the "Board of County Commissioners" shall be amended to the "Board of City Commissioners." Section 3. This Resolution shall be effective immediately upon its adoption.
