A RESOLUTION OF THE MIAMI CITY COMMISSION, WITH ATTACHMENTS,
IN ACCORDANCE WITH ARTICLE 11 OF ORDINANCE NO. 13114, THE
ZONING ORDINANCE OF THE CITY OF MIAMI, FLORIDA, AS AMENDED,
AND CHAPTER 62/ARTICLE XVI OF THE CODE OF THE CITY OF MIAMI,
FLORIDA, AS AMENDED, APPROVING THE ADOPTION OF THE AMENDED
APPLICABLE SECTIONS OF THE MIAMI-DADE COUNTY PUBLIC ART
MASTER PLAN AS THE CITY OF MIAMI'S PUBLIC ART MASTER PLAN AND
PUBLIC ART PROGRAM GUIDELINES; PROVIDING FOR AN EFFECTIVE
DATE.

WHEREAS, pursuant to Ordinance Nos. 13656 and 13657, the Miami City Commission
enacted Phase I of the Art in Public Places Program on January 12, 2017, which established the
Art in Public Places Board ("AIPPB"); and
WHEREAS, pursuant to Section 11.3 of Ordinance No. 13114, the Zoning Ordinance of
the City of Miami, Florida, as amended ("Miami 21 Code"), "[t]he Public Art Division shall
prepare both a Public Art Master Plan and Public Art Program Guidelines as defined in Article 1,
Section 1.5."; and
WHEREAS, pursuant to Section 1.5 of the Miami 21 Code, the Public Art Master Plan is
"[a] plan adopted by the City Commission, pursuant to a recommendation by the AIPPB, which
shall identify Public Place locations for Art and establish a priority order to the City Commission,
and which shall be amended, as needed, to ensure that the Public Art Master Plan and the
Public Art Program as a whole remain coherent and consistent with the intents and purposes for
which Article 11 of the Code was adopted."; and
WHEREAS, pursuant to Section 1.5 of the Miami 21 Code, the Public Art Program
Guidelines are "[a] set of standards, criteria, policies, and procedures related to the submission,
donation, dedication, consideration, and acceptance of Art, which shall be adopted by the City
Commission, and amended as necessary, to ensure that the Public Art Program Guidelines and
the Public Art Program as a whole remain coherent and consistent with the intent and purposes
for which Article 11 of this Code was adopted."; and
WHEREAS, pursuant to Section 11.3 of the Miami 21 Code, "[t]he Public Art Master Plan
and the Public Art Program Guidelines shall be prepared and subject to approval of the City
Commission, pursuant to a recommendation by the AIPPB."'; and
WHEREAS, pursuant to Section 62-655(c) of the Code of the City of Miami, Florida, as
amended ("City Code"), "[t]he AIPPB, with the assistance and recommendation of the planning
department, public art division, and all other city departments, as necessary, shall have the
function, duties, and powers as follows: (1) To recommend the public art program guidelines
and amendments to the public art program guidelines thereto to the city commission; [and] (2)

To recommend the public art master plan and amendments to the public art master plan thereto
to the city commission; ..."; and
WHEREAS, pursuant to Section 62-656 of the City Code, "[t]he city commission, in
addition to its duties and obligations under the City Charter, the City Code, and other applicable
laws, shall have the following duties specifically in regard to the public art program:... (2) To
approve the public art program guidelines and amendments to the public art program guidelines
upon recommendation of the AIPPB; [and] (3) To approve the public art master plan and
amendments to the public art master plan upon recommendation of the AIPPB; ..."; and
WHEREAS, pursuant to Resolution No. AIPP-R-20-018, attached and incorporated as
Exhibit "A", on October 19, 2020 the AIPPB approved with conditions the expenditure of up to
One Hundred Twenty Thousand Dollars ($120,000.00) for consulting services for the execution
of a Citywide Public Art Master Plan, Design Guidelines, and an "Arts, Culture and the Creative
Economy Element" to the Miami Neighborhood Comprehensive Plan; and
WHEREAS, at the direction of the AIPPB, Planning staff has been drafting a
comprehensive Request for Proposals ("RFP") for said consulting services, which will be
released in the Fall of 2022; and
WHEREAS, in the interim, after consulting with the Office of the City Attorney, Planning
staff requested that the AIPPB recommend that the Miami City Commission adopt the amended
applicable sections of the Miami -Dade County Public Art Master Plan as the City of Miami's
Public Art Master Plan and Public Art Program Guidelines; and
WHEREAS, pursuant to Resolution No. AIPP-R-21-013, attached and incorporated as
Exhibit "B", on July 19, 2021, the AIPPB recommended with conditions that the Miami City
Commission adopt and amend the applicable sections of the Miami -Dade County Public Art
Master Plan, which shall be known as the City of Miami's Public Art Master Plan; and
WHEREAS, Planning staff has made the necessary amendments to the Miami -Dade
County Public Art Master Plan in accordance with the City Code, which shall be known as the
City of Miami's Public Art Master Plan and Public Art Program Guidelines, attached and
incorporated as Exhibit "C"; and
WHEREAS, Planning staff finds the amended Public Art Master Plan to be consistent
with the intent and purpose for which the Public Art sections of City Code were adopted.
NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY OF
MIAMI, FLORIDA:
Section 1. The recitals and findings contained in the Preamble to this Resolution are
adopted by reference and incorporated as if fully set forth in this Section.
Section 2. The City Commission hereby approves the adoption of the amended
applicable sections of the Miami -Dade County Public Art Master Plan as the City of Miami's
Public Art Master Plan and Public Art Program Guidelines.
Section 3. The adopted and amended Public Art Master Plan and Public Art Program
Guidelines are intended to be interim until the adoption and execution of the City's own Public
Art Master Plan and Public Art Program Guidelines as a result of the RFP.

Section 4. This Resolution shall be effective immediately upon its adoption and
signature by the Mayor.'

' If the Mayor does not sign this Resolution, it shall become effective at the end of ten (10) calendar days
from the date it was passed and adopted. If the Mayor vetoes this Resolution, it shall become effective
immediately upon override of the veto by the City Commission.
