Background of Item: The Florida Department of Transportation ("FDOT") has developed design plans for State Road SR-972/Coral Way from south of 1-95 to east of SW 3rd Avenue for the reconstruction of the existing intersection to provide a roundabout, replacement of signals, pullboxes, new lighting, additional drainage, pier protection and landscaping. The project will include improvements on roadways not on the State Highway System, which requires an Off -System Construction and Maintenance Agreement between FDOT and the City. WHEREAS, the Florida Department of Transportation (TDOT") has developed design plans Financial Management (TM") Project No. FM 444450-1-52-01 for State Road ("SR") 972/Coral Way from south of Interstate 95 (1-95") to east of Southwest 3rd Avenue for the reconstruction of the existing intersection to provide a roundabout, replacement of signals, pullboxes, new lighting, additional drainage, pier protection, and landscaping ("Project"); and WHEREAS, FDOT intends to undertake and complete the Project, a portion of which includes work on roads not on the State Highway System but City of Miami ("City") right-of-way, specifically Southwest 15th Road/Broadway Street from Southwest 12th Street to Southwest 2nd Court, and on Southwest 3rd Avenue from Coral Way to Southwest 12th Street; and WHEREAS, the Project includes roadway reconstruction, sidewalk, curb, utility adjustments, raised medians, guardrail, driveways, pier protection, pedestrian ramps, pavement markings, signage, drainage structures, landscaping, and lighting ("Local Roadway Improvements") and all activities associated with, or arising out of the construction of the Local Roadway Improvements; and WHEREAS, the Off -System Construction and Maintenance Agreement ("Agreement"), attached and incorporated as Exhibit "A", establishes the terms, conditions, and responsibilities of FDOT and the City to accomplish the Project and Local Roadway Improvements on the City's Streets; and WHEREAS, the City agrees with the terms and conditions in the Agreement, in substantially the attached form; NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY OF MIAMI, FLORIDA: Section 1. The recitals and findings contained in the Preamble to this Resolution are adopted by reference and incorporated as if fully set forth in this Section. Section 2. The City Manager is authorized' to execute the Agreement, in substantially the attached form, with FDOT, for the Project on SR 972/Coral Way from south of 1-95 to east of Southwest 3rd Avenue, Miami, Florida, which includes improvements on roads not on the state highway system, and the Local Roadway Improvements. Section 3. This Resolution shall become effective immediately upon its adoption.
