A RESOLUTION OF THE MIAMI CITY COMMISSION OPPOSING SENATE
BILL 1024 ("SB 1024") AND HOUSE BILL 741 ("HB 741") (COLLECTIVELY,
"BILLS") PROPOSED DURING THE CURRENT LEGISLATIVE SESSION AS
THE BILLS WOULD HARM THE ADVANCEMENT OF CONSUMER SOLAR
ENERGY PRODUCTION AND USAGE WITHIN THE STATE OF FLORIDA;
DIRECTING THE CITY MANAGER TO INCLUDE OPPOSITION TO SB 1024
AND HB 741 AS ONE OF THE CITY'S 2022 LEGISLATIVE PRIORITIES;
DIRECTING THE CITY CLERK TO TRANSMIT A CERTIFIED COPY OF THIS
RESOLUTION TO THE OFFICIALS NAMED HEREIN.
SPONSOR(S): Commissioner Ken Russell
WHEREAS, Net Energy Metering ("NEM") is designed to support the installation of
customer -sited renewable energy generation; and
WHEREAS, NEM allows customers to receive bill credits for power generated by their
solar systems and shared with the power grid, which ultimately results in consumers saving
money on their utility bills; and
WHEREAS, NEM is what has allowed solar to become increasingly accessible to low
and moderate income households in Florida and empowers Floridians to have choices in how
they receive and pay for electricity; and
WHEREAS, at least two (2) bills have been introduced during the 2022 Florida State
legislative session, Senate Bill 1024 ("SB 1024") and House Bill 741 ("HB 741") (collectively,
"Bills"), that call for drastic changes to NEM that would hinder the expansion of rooftop solar
installations; and
WHEREAS, these Bills, as introduced, would drastically decrease the credits that
customers receive for sharing their excess electricity with the power grid, thereby making
customer -sited renewable energy generation more expensive, increasing the amount of time it
takes for customers to pay off their solar systems, and significantly diminishing the installation of
distributed solar in Florida; and
WHEREAS, a climate crisis exists and there is a significant need to make the transition
to clean energy more accessible; and
WHEREAS, the City of Miami ("City") cannot meet the goals stated in Miami Forever
Carbon Neutral and Resolution R-21-0472 of sixty percent (60%) reduction in greenhouse gas
emissions below 2018 levels by the year 2035 and one hundred percent (100%) carbon -free
electricity by year 2035 without increasing the amount of rooftop solar; and

WHEREAS, current NEM rules have supported the rooftop solar industry's generation of
$18.3 billion in State economic impact, as reported by Conservatives for Clean Energy Florida,
which supports the City's stated New Green Economy goals; and
WHEREAS, the Florida solar industry provides over 11,000 jobs, as reported by the 11th
Annual National Solar Jobs Census; and
WHEREAS, the leading voice of Florida's solar energy industry, the Florida Solar Energy
Industries Association, and its workers, oppose these Bills and believe that the Bills would
decimate Florida's growing rooftop solar industry and result in the loss of thousands of solar
jobs; and
WHEREAS, expanding access to rooftop solar in the City will support community
resilience especially post -disaster, provide environmental and public health benefits by reducing
air emissions, lessen the impacts of the climate crisis, avoid the need to build costly power
generation, add value directly to the local economy by supporting local job creation, and
contribute to the achievement of reliability and clean energy goals; and
WHEREAS, on February 8, 2022, the City's Climate Resilience Committee passed a
Resolution urging the City Commission to oppose the Bills as they would harm the
advancement of consumer solar energy production and usage within the State of Florida; and
WHEREAS, the City Commission supports expanding carbon -free energy access by
making it easier, not more difficult, for people to adopt rooftop solar in all communities and
households, particularly those struggling to pay for electricity.
NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY OF
MIAMI, FLORIDA:
Section 1. The recitals and findings contained in the Preamble to this Resolution are
adopted by reference and incorporated as if fully set forth in this Section.
Section 2. The City Commission hereby opposes SB 1024 and HB 741 proposed during
the current legislative session as the Bills would harm the advancement of consumer solar
energy production and usage within the State of Florida.
Section 3. The City Manager is hereby directed to include opposition to SB 1024 and
HB 741 as one of the City's 2020 Legislative Priorities.
Section 4. The City Clerk is directed to submit a copy of this Resolution to the
Governor Ron DeSantis; President of the Senate Wilton Simpson; Speaker Chris Sprowls;
Senator Jennifer Bradley, Sponsor of SB 1024; Representative Lawrence McClure, Sponsor of
HB 741; Representative Robert Alexander Andrade, Co -Sponsor of HB 741; and the members
of the Miami -Dade County Legislative Delegation.
Section 5. This Resolution shall become effective immediately upon adoption.
