Subject: Accept Bid - IFB No. 1270388 Playground Equipment Installation and Repair

Purpose of Item:
The nature of this item is to authorize a resolution of the Miami City Commission,
accepting the bids received on September 17, 2021 pursuant to Invitation for Bid ("IFB")
No. 1270388 from the two (2) lowest responsive and responsible Bidders on a Primary
and Secondary basis, Leadex Corporation ("Leadex") Primary, and Industrial
Shadeports, Inc., ("Industrial Shadeports") Secondary, for the provision of playground
equipment installation and repair services, Citywide, on an as needed basis, for an
initial contract term of three (3) years, with the option to renew for one (1) additional
three (3) year period, allocating funds from the Parks and Recreation Department's
General/Repair and Maintenance Fund, and/or other sources of funds, subject to the
availability of funds and budgetary approval, at the time of need. Further authorizing the
City Manager to negotiate and execute any and all documents, including any
amendments, renewals, and extensions, subject to all allocations, appropriations, and
budgetary approvals having been previously made, in compliance with applicable
provisions of the Code of the City of Miami, Florida, as amended, ("City Code"),
including, the City of Miami's Procurement Ordinance, Anti -deficiency Act, and
Financial Integrity Principles, all as set forth in Chapter 18 of the City Code, in a form
acceptable to the City Attorney, and in compliance with all applicable laws, rules, and
regulations, as may be deemed necessary for said purpose.
Background of Item:
On August 17, 2021, the Department of Procurement ("Procurement"), on behalf of
Parks, issued IFB No. 1270388, Playground Equipment Installation and Repair
Services, Citywide, on an as needed basis. As required by the Procurement Code, the
IFB was issued online via the City of Miami's BidSync Electronic Portal ("BidSync"). On
September 17, 2021, at the bid closing, two (2) bids were received. The bids were
evaluated and tabulated following the guidelines published in the bid. Procurement is
recommending award on a Primary and Secondary basis, to Leadex (Primary) and
Industrial Shadeports (Secondary), which met all requirements, per the bid
specifications, and are the responsive and responsible Bidders. The estimated contract
amount is $100,000 annually (approximately $600,000 for all six (6) years in the
aggregate).

A RESOLUTION OF THE MIAMI CITY COMMISSION ACCEPTING THE BIDS
RECEIVED ON SEPTEMBER 17, 2021 PURSUANT TO INVITATION FOR BID NO.
1270388 FROM THE TWO (2) LOWEST RESPONSIVE AND RESPONSIBLE
BIDDERS, ON A PRIMARY AND SECONDARY VENDOR BASIS, WITH LEADEX
CORPORATION, A FLORIDA PROFIT CORPORATION, AS THE PRIMARY VENDOR
AND INDUSTRIAL SHADEPORTS, INC., A FLORIDA PROFIT CORPORATION, AS
THE SECONDARY VENDOR, FOR THE PROVISION OF PLAYGROUND
EQUIPMENT INSTALLATION AND REPAIR SERVICES, CITYWIDE, ON AN AS
NEEDED BASIS FOR AN INITIAL TERM OF THREE (3) YEARS WITH THE OPTION
TO RENEW FOR ONE (1) ADDITIONAL THREE (3) YEAR PERIOD; ALLOCATING
FUNDS FROM THE CITY OF MIAMI'S ("CITY") PARKS AND RECREATION
DEPARTMENT'S GENERAL/REPAIR AND MAINTENANCE FUND AND/OR SUCH
OTHER SOURCES OF FUNDS, SUBJECT TO THE AVAILABILITY OF FUNDS AND
BUDGETARY APPROVAL AT THE TIME OF NEED; AUTHORIZING THE CITY
MANAGER TO NEGOTIATE AND EXECUTE ANY AND ALL DOCUMENTS,
INCLUDING ANY AMENDMENTS, RENEWALS, AND EXTENSIONS, SUBJECT TO
ALL ALLOCATIONS, APPROPRIATIONS, PRIOR BUDGETARY APPROVALS,
COMPLIANCE WITH ALL APPLICABLE PROVISIONS OF THE CODE OF THE CITY
OF MIAMI, FLORIDA, AS AMENDED ("CITY CODE"), INCLUDING THE CITY'S
PROCUREMENT ORDINANCE, ANTI -DEFICIENCY ACT, AND FINANCIAL
INTEGRITY PRINCIPLES, ALL AS SET FORTH IN CHAPTER 18 OF THE CITY
CODE, IN FORMS ACCEPTABLE TO THE CITY ATTORNEY, AND IN COMPLIANCE
WITH ALL APPLICABLE LAWS, RULES, AND REGULATIONS, AS MAY BE DEEMED
NECESSARY FOR SAID PURPOSE.
WHEREAS, on August 17, 2021, the City of Miami's ("City") Department of Procurement
("Procurement"), on behalf of the Parks and Recreation Department ("Parks"), issued Invitation
for Bids ("IFB") No. 1270388 to establish a contract for the provision of playground equipment
installation and repair services, Citywide, on an as needed basis to be awarded on a primary
and secondary vendor basis for an initial term of three (3) years with the option to renew for one
(1) additional three (3) year period; and
WHEREAS, on September 17, 2021, Procurement received two (2) bid responses to the
IFB that were evaluated and tabulated following the required guidelines of the IFB; and
WHEREAS, these two (2) lowest responsive and responsible Bidders were Leadex
Corporation, a Florida profit corporation ("Leadex"), as the primary vendor and Industrial
Shadeports, Inc., a Florida profit corporation ("Industrial Shadeports"), as the secondary vendor;
NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY OF
MIAMI, FLORIDA:
Section 1. The recitals and findings contained in the Preamble to this Resolution are
adopted by reference and incorporated as if fully set forth in this Section.
Section 2. The bids received on September 17, 2021 pursuant to IFB No. 1270388,
from the two (2) lowest responsive and responsible Bidders on a primary and secondary vendor
basis, with Leadex as the primary vendor and Industrial Shadeports as the secondary vendor,
for the provision of playground equipment installation and repair services, Citywide, on an as
needed basis for an initial term of three (3) years with the option to renew for one (1) additional
three (3) year period are hereby accepted.
Section 3. Funds are allocated from Parks' General/Repair and Maintenance Fund
and/or such other sources of funds, subject to the availability of funds and budgetary approval at
the time of need.
Section 4. The City Manager is authorized' to negotiate and execute any and all
documents, including any amendments, renewals, and extensions, subject to all allocations,
appropriations, prior budgetary approvals, compliance with all applicable provisions of the Code
of the City of Miami, Florida, as amended ("City Code"), including the City's Procurement
Ordinance, Anti -Deficiency Act, and Financial Integrity Principles, all as set forth in Chapter 18
of the City Code, in forms acceptable to the City Attorney, and in compliance with all applicable
laws, rules, and regulations, as may be deemed necessary for said purpose.
Section 5. This Resolution shall become effective immediately upon its adoption.
