Purpose of Item:
To de -appropriate, re -appropriate and appropriate funding for existing and added
projects which will amend the Fiscal Year 2021-22 Multi -Year Capital Plan adopted with
modifications on September 13, 2021 pursuant to Resolution No. 21-0353
Background of Item:
The Office of Management and Budget and the Office of Capital Improvements have
reviewed capital projects that are complete with balances or are of a lower priority and
recommended reprogramming of funds to projects that are of a higher priority and
appropriates new funding, requiring the existing Capital Plan, adopted as Resolution
No. 21-0353 be further amended to reflect these changes.

A RESOLUTION OF THE MIAMI CITY COMMISSION, WITH ATTACHMENT(S),
ADDING CAPITAL PROJECTS TO THE CITY OF MIAMI'S ("CITY") FISCAL YEAR
2021-2022 MULTI -YEAR CAPITAL PLAN ADOPTED ON SEPTEMBER 13, 2021
PURSUANT TO RESOLUTION NO. R-21-0353 AS SUBSEQUENTLY AMENDED ON
OCTOBER 1, 2021 PURSUANT TO RESOLUTION NO. R-21-0408; FURTHER RE -
APPROPRIATING, DE -APPROPRIATING, AND APPROPRIATING FUNDING FOR
THE EXISTING AND ADDED PROJECTS; RATIFYING, APPROVING, AND
CONFIRMING CERTAIN NECESSARY ACTIONS BY THE CITY MANAGER AND
DESIGNATED CITY OFFICIALS AND DEPARTMENTS IN ORDER TO UPDATE THE
RELEVANT FINANCIAL CONTROLS AND COMPUTER SYSTEMS IN CONNECTION
THEREWITH AND FOR GRANTS AND OTHER FUNDING SOURCES IN PROGRESS;
PROVIDING AN EFFECTIVE DATE.
WHEREAS, except for such changes as set forth herein, all previous appropriations
remain authorized to continue as previously approved City of Miami ("City") capital projects
(new, revised, and continued projects collectively, "Projects") according to the Fiscal Year 2021-
2022 Multi -Year Capital Plan adopted on September 13, 2021 pursuant to Resolution No. R-21-
0353 and as subsequently amended on October 1, 2021 pursuant to Resolution No. R-21-0408
(collectively, "Fiscal Year 2021-2022 Capital Plan"); and
WHEREAS, the proposed appropriations, de -appropriations, and re -appropriations for
the Fiscal Year 2021-2022 Capital Plan are set forth in the November 15, 2021 memorandum
titled Explanation of Capital Appropriations and Re -Appropriations and the exhibits thereto, all of
which are attached and incorporated herein as Exhibit "A" ("Amendment #2 Explanations
Memorandum"); and
WHEREAS, pursuant to Resolution No. R-21-0479 adopted on November 18, 2021, the
City Commission approved a General Fund contribution to the Capital Fund in the amount of the
$8 million as an amendment and closing out of the operating budget for all funds for the fiscal
year ending September 30, 2021; and
WHEREAS, as set forth in the Amendment #2 Explanations Memorandum, a
contribution from the City's General Fund is established in the amount of $8,000,000 to fund
various capital projects; and
WHEREAS, as set forth in the Amendment #2 Explanations Memorandum, it is
necessary to accept new funding and appropriate an amount of $230,000 from the Miami
Downtown Development Authority of the City of Miami, Florida ("DDA") to fund two (2) capital
projects in the downtown area, subject to the negotiation and execution by the City Manager, in
a form acceptable to the City Attorney, of a related project agreement between the DDA and the
City for the project to be undertaken by the City's Office of Capital Improvements; and
WHEREAS, City Commission also added an appropriation of the Sea -Level Rise and
Flood Prevention portion of the Miami Forever Bond Funds in the amount of ten million dollars
($10,000,000.00) to partially fund the Auburndale flood mitigation project which is located within
the boundaries of Southwest 32 Avenue to Southwest 37 Avenue and West Flagler Street to
Southwest 8 Street and an appropriation of the Sea -Level Rise and Flood Prevention portion of
the Miami Forever Bond Funds in the amount of fifteen million dollars ($15,000,000.00) to
partially fund the East Flagami flood mitigation project which is located within the boundaries of
Northwest 38 Court to Northwest 42 Avenue and Northwest 1 Street to Northwest 7 Street and
directed the City Manager to bring an intent to reimburse resolution for these projects at the
December 9, 2021 or January 13, 2022 Commission Meeting and to assist the District 4
Commissioner to fully fund the projects in order to comply with the provisions of Chapter
18/Article 9 of the Code of the City of Miami, as amended ("City Code"); and
WHEREAS, also as set forth in the Amendment #2 Explanations Memorandum, it is
necessary to close-out projects, reprogram projects, approve additional projects, and approve
additional appropriations, de -appropriations, and re -appropriations, all as detailed in the exhibits
to the Amendment #2 Explanations Memorandum for existing sources of revenues for the Fiscal
Year 2021-2022 Capital Plan and to add to available balances in Capital Project Funds as set
forth below:

NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY OF
MIAMI, FLORIDA:
Section 1. The recitals and findings contained in the Preamble to this Resolution are
adopted by reference and incorporated as if fully set forth in this Section.
Section 2. The City Commission hereby approves and authorizes' the City Manager to
(a) add capital projects to the Fiscal Year 2021-2022 Capital Plan; (b) revise current
appropriations among approved projects; (c) and further de -appropriate, re -appropriate, and
appropriate funding for existing and added projects, all as set forth in the attached and
incorporated Amendment #2 Explanations Memorandum and the Exhibits thereto.
Section 3. Certain necessary actions by the City Manager and designated City officials
and departments made in order to update the City's relevant financial controls and computer
systems for project close-outs and for grants and other funding sources in progress in
connection with the Fiscal Year 2021-22 Capital Plan, the Amendment #2 Explanations
' The herein authorization is further subject to compliance with all legal requirements that may be
imposed, including but not limited to, those prescribed by applicable City Charter and City Code
provisions.
Memorandum, and the Final Budget to implement the Projects in connection herewith are
ratified, approved, and confirmed.
Section 4. This Resolution shall become effective immediately upon its adoption and
signature by the Mayor.2
