WHEREAS, on October 22, 2009, the City Commission adopted Ordinance No. 13114 as the Zoning Ordinance for the City of Miami ("Miami 21 Code"); and WHEREAS, the City of Miami ("City") regulates parking through land development regulations and parking requirements for Uses established in the Miami 21 Code and through Chapter 35 of the Code of the City of Miami, Florida, as amended ("City Code"); and WHEREAS, there is a need to provide options for loading in Downtown Miami in order to address traffic flow and loading issues; and WHEREAS, Chapter 35 of the City Code is being amended to create a Downtown Flagler District Parking and Loading Improvement Program and Trust Fund ("Program") for Downtown Miami as described in Exhibit "A", attached and incorporated; and WHEREAS, this proposed amendment is needed to incorporate off -site loading consistent with the Program; and WHEREAS, on October 20, 2021, the Planning, Zoning and Appeals Board (TZAB"), at a duly noticed public hearing, considered PZAB Item No. 9 and adopted PZAB Resolution No. R-21-046 by a vote of eight to zero (8-0), recommending approval to the City Commission of the proposed amendment as stated herein; and WHEREAS, consideration has been given as to whether this proposed amendment will further the goals, objectives, and policies of the Miami Comprehensive Neighborhood Plan, the Miami 21 Code, and other City regulations; and WHEREAS, consideration has been given to the need and justification for this proposed amendment, including changed or changing conditions that make the passage of this proposed amendment necessary;and City of Miami File ID: 10665 (Revision: 8) Printed On: 21412022 WHEREAS, the City Commission, after careful consideration of this matter, deems it advisable and in the best interest of the general welfare of the City and its residents to amend the Miami 21 Code as hereinafter set forth; NOW, THEREFORE, BE IT ORDAINED BY THE COMMISSION OF THE CITY OF MIAMI, FLORIDA, AS FOLLOWS: Section 1. The recitals and findings contained in the Preamble to this Ordinance are hereby adopted by reference thereto and incorporated herein as if fully set forth in this Section. Section 2. Article 3 of the Miami 21 Code is hereby amended by making modifications in the following particulars:' "ARTICLE 3. Section 4. If any section, part of a section, paragraph, clause, phrase, or word of this Ordinance is declared invalid, the remaining provisions of this Ordinance shall not be affected. Section 5. It is the intention of the City Commission that the provisions of this Ordinance shall become and be made a part of the Miami 21 Code, which provisions may be renumbered or relettered and that the word "ordinance" may be changed to "section", "article", or other appropriate word to accomplish such intention. Section 6.
