HomeMy WebLinkAboutR-22-0012City of Miami f Legislation Resolution: R-22-0012 File Number: 11159 City Hall 3500 Pan American Drive Miami, FL 33133 www.miamigov.com Final Action Date: 1/13/2022 A RESOLUTION OF THE MIAMI CITY COMMISSION, WITH ATTACHMENT(S), AUTHORIZING THE CITY MANAGER TO ACCEPT, ALLOCATE, BUDGET, AND APPROPRIATE GRANT FUNDS FROM THE FLORIDA DIVISION OF EMERGENCY MANAGEMENT ("FDEM") IN AN AMOUNT NOT TO EXCEED THREE HUNDRED EIGHTY-THREE THOUSAND FOUR HUNDRED SEVENTY- SIX DOLLARS AND EIGHTY-TWO CENTS ($383,476.82) ("GRANT FUNDS") FOR THE BRICKELL BAY DRIVE LINEAR PARK AND SEAWALL FLOOD CONTROL PROJECT ASSOCITATED WITH CITY OF MIAMI OFFICE OF CAPITAL IMPROVEMENTS' PROJECT NO. 40-13193802; FURTHER AUTHORIZING THE CITY MANAGER TO EXECUTE THE ATTACHED HAZARD MITIGATION GRANT PROGRAM FEDERALLY -FUNDED SUBAWARD AND GRANT AGREEMENT ("AGREEMENT"), IN SUBSTANTIALLY THE ATTACHED FORM, WITH FDEM TO IMPLEMENT THE ACCEPTANCE AND ADMINISTRATION OF THE GRANT FUNDS; FURTHER AUTHORIZING THE CITY MANAGER TO NEGOTIATE AND EXECUTE ANY AND ALL OTHER NECESSARY DOCUMENTS, INCLUDING BUT NOT LIMITED TO, AMENDMENTS, EXTENSIONS, RENEWALS, AND MODIFICATIONS, ALL IN FORMS ACCEPTABLE TO THE CITY ATTORNEY, FOR THE ACCEPTANCE, IMPLEMENTATION OF, AND COMPLIANCE WITH THE AGREEMENT FOR THE GRANT FUNDS. WHEREAS, the City of Miami ("City") applied for and was awarded a federal grant for design activities related to the Brickell Bay Drive Linear Park and Seawall Flood Control Project as part of Office of Capital Improvements' Project No. 40-13193801 ("Project"); and WHEREAS, the City is seeking to increase resiliency to sea level rise and flooding risks along Brickell Bay Drive; and WHEREAS, the Florida Department of Emergency Management ("FDEM") is serving as the pass -through agency for the federal funds through the attached Hazard Mitigation Grant Program Federally -Funded Subaward and Grant Agreement ("Agreement"); and WHEREAS, grant funds were awarded for the Project in an amount not to exceed Three Hundred Eighty -Three Thousand Four Hundred Seventy -Six Dollars and Eighty -Two Cents ($383,476.82) ("Grant Funds") to for the Project; and WHEREAS, pursuant to the proposed terms of the Agreement, the purpose of the Grant Funds shall be to conduct Phase I of the Project, which includes the preliminary engineering designs and calculations, surveys, permitting, and notices, but does not include any construction activities; and City of Miami Page 1 of 2 File ID: 11159 (Revision:) Printed On: 112612022 File ID: 11159 Enactment Number: R-22-0012 WHEREAS, it is recommended that City Commission accept, allocate, budget, and appropriate the Grant Funds; authorize the City Manager to execute the Agreement, in substantially the attached form; and authorize the City Manager to negotiate and execute any and all renewals, extension, modifications, and amendments to the Agreement, all in forms acceptable to the City Attorney, for the Project; NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY OF MIAMI, FLORIDA: Section 1. The recitals and findings contained in the Preamble to this Resolution are adopted by reference and incorporated as fully set forth in this Section. Section 2. The Grant Funds from the FDEM HMPG are accepted, allocated, budgeted, and appropriated for the Project. Section 3. The City Manager is authorized' to execute the Agreement, in substantially the attached form, for the Project. Section 4. The City Manager is further authorized' to negotiate and execute any and all renewals, extensions, modifications, and amendments, all in forms acceptable to the City Attorney, for said purpose. Section 5. This Resolution shall become effective immediately upon its adoption and signature of the Mayor.2 APPROVED AS TO FORM AND CORRECTNESS: i ria i ndez, Cify Nttor iey 1/3/2022 ' The herein authorization is further subject to compliance with all legal requirements that may be imposed, including but not limited to those prescribed by applicable City Charter and City Code provisions. 2 If the Mayor does not sign this Resolution, it shall become effective at the end of ten (10) calendar days from the date it was passed and adopted.
