("Bioresponse"), JRP & Sons Corp dba, FL Cleanup ("FL Cleanup"), and Muma SA, LLC ("Muma"), for Group 5, a pre -qualified pool of vendor's list, for the provision of Bio-Hazardous Waste, Spills, and Decontamination Services, on an as needed basis. For an initial contract term of two (2) years, with the option to renew for two (2) additional two (2) year periods; allocating funds from the end user department, and other sources of funds; subject to the availability of funds and budgetary approval, at the time of need. Further authorizing the City Manager to negotiate and execute any and all documents, including any amendments, renewals, and extensions, subject to all allocations, appropriations, prior budgetary approvals, compliance with all applicable provisions of the Code of the City of Miami, Florida, as amended, ("City Code"), including the City's Procurement Ordinance, Anti -Deficiency Act, and Financial Integrity Principles, all as set forth in Chapter 18 of the City Code, in a form acceptable to the City Attorney, and in compliance with all applicable laws, rules, and regulations, as may be deemed necessary for said purpose. Background of Item: On January 14, 2021, the Department of Procurement ("Procurement") issued IFB No. 1254386 under full and open competition, to obtain bids from experienced and qualified firms for the provision of Bio-Hazardous Waste, Spills and Decontamination Services, Citywide. As required by the Procurement Code, the IFB was advertised and issued on- line. On February 18, 2021, at the bid closing, five (5) bids were received. All Bidders were deemed non -responsive for Groups 1-4, and only three (3) Bidders were deemed responsive and responsible for Group 5. Procurement is recommending award to Bioresponse, FL Cleanup, and Muma, for Group 5, all three (3) met the minimum qualifications per the bid specifications. In 2020, during the Covid-19 pandemic the City spent an estimated amount of approximately $300,000 for said services. Should there be another Force Majure such as the Covid Pandemic the City will spend accordingly, on an as needed basis. WHEREAS, the City of Miami ("City") has a need for the provision of bio-hazardous waste, spills, and decontamination services (collectively, "Services"); and WHEREAS, on January 14, 2021, the City's Department of Procurement ("Procurement") issued Invitation for Bid ("IFB") No. 1254386 to obtain bids from experienced and qualified firms for the Services on an as needed basis Citywide; and WHEREAS, the IFB was advertised and issued on-line under full and open competition as required by the City's Procurement Ordinance; and WHEREAS, on February 18, 2021, at the IFB bid closing, five (5) bids were received, all of which were deemed non -responsive for IFB Groups 1-4, with three (3) of the same deemed responsive and responsible for IFB Group 5 pre -qualified pool of vendors; and WHEREAS, Procurement is recommending to award three (3) responsive and responsible bids received from BioResponse, Corp., a Florida profit corporation ("BioResponse"), JRP & Sons Corporation d/b/a FL Cleanup, a Florida profit corporation (I'FL Cleanup"), and Muma SA LLC, a Florida limited liability company ("Muma"); NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY OF MIAMI, FLORIDA: Section 1. The recitals and findings contained in the Preamble to this Resolution are adopted by reference and incorporated as if fully set forth in this Section. Section 2. The bids received on February 18, 2021 pursuant to IFB No. 1254386 from responsive and responsible bidders BioResponse, FL Cleanup, and Muma for the IFB Group 5 pre -qualified pool of vendors for the Services on an as needed basis Citywide for an initial term of two (2) years with the option to renew for two (2) additional two (2) year periods are accepted. Section 3. Funds are allocated from the end user departments and such other sources of funds, subject to the availability of funds and budgetary approval at the time of need. Section 4. The City Manager is authorized' to negotiate and execute any and all documents, including any amendments, renewals, and extensions, subject to all allocations, appropriations, prior budgetary approvals, compliance with all applicable provisions of the Code of the City of Miami, Florida, as amended ("City Code"), including the City's Procurement Ordinance, Anti -Deficiency Act, and Financial Integrity Principles, all as set forth in Chapter 18 of the City Code, in forms acceptable to the City Attorney, and in compliance with all applicable laws, rules, and regulations, as may be deemed necessary for said purpose. Section 5. This Resolution shall become effective immediately upon its adoption.
