A RESOLUTION OF THE MIAMI PLANNING, ZONING, AND APPEALS BOARD
("PZAB") RECOMMENDING APPROVAL OF AN ORDINANCE OF THE MIAMI CITY
COMMISSION, TO AMEND ORDINANCE NO. 13114, THE ZONING ORDINANCE OF
THE CITY OF MIAMI, FLORIDA, AS AMENDED, MORE SPECIFICALLY BY
AMENDING ARTICLE 6, TABLE 13, TITLED "SUPPLEMENTAL REGULATIONS",
TO DISALLOW PUBLIC STORAGE FACILITIES IN THE 75" - URBAN CENTER
ZONE AND 76" — URBAN CORE ZONE; CONTAINING A SEVERABILITY CLAUSE;
AND PROVIDING FOR AN EFFECTIVE DATE.
WHEREAS, on October 22, 2009, the City of Miami ("City") adopted Ordinance No.
13114, the Zoning Ordinance of the City of Miami, Florida ("Miami 21 Code"); and
WHEREAS, on January 26, 2012, the City Commission adopted Ordinance No. 13307,
which modified the Miami 21 Code regulations regarding Public Storage Facilities to alter
parking requirements, remove the 55,000 square foot maximum floor area requirement, and
remove the 2,500 feet distance separation requirement in T5, "Urban Center Zones," and T6,
"Urban Core Zones;" and
WHEREAS, on March 23, 2017, the City Commission adopted Ordinance No. 13674,
which modified the Miami 21 Code to require that Public Storage Facilities in the T5, "Urban
Center Zones," and T6, "Urban Core Zones" contain ground floor retail uses and mandating a
2,500-foot distance separation between Public Storage Facilities; and
November 21, 2019, the City passed on first reading a proposed Ordinance to add
supplemental regulations for Public Storage Facilities including but not limited to requiring on -
site bulk waste disposal and providing for allowance by warrant, design review, separation/
distance requirements, and regulations within transect zones and that on -site bulky waste
disposal not be separately charged to existing clients with a limited exception; and
WHEREAS, Public Storage Facilities are generally designed with a lack of architectural
diversity and inactive ground floors; and
WHEREAS, Public Storage Facilities have been detrimental to commercial corridors;
and
WHEREAS, it is desirous to disallow Public Storage Facilities in the T5, "Urban Center
Zones," and T6, "Urban Core Zones"; and
WHEREAS, the Planning, Zoning, and Appeals Board ("PZAB") has considered whether
the proposed change will further the goals, objectives, and policies of the Comprehensive Plan,
the Miami 21 Code, and other City regulations; and

WHEREAS, due consideration has been given to the need and justification for the
proposed change, including changed conditions that make the passage of the proposed change
necessary;
NOW, THEREFORE, BE IT RESOLVED BY THE PLANNING, ZONING, AND APPEALS
BOARD OF THE CITY OF MIAMI, FLORIDA:
Section 1. The recitals and findings contained in the Preamble to this Resolution are
adopted by reference and incorporated as if fully set forth in this Section.
Section 2. The Planning, Zoning, and Appeals Board hereby recommends to the City
Commission that the Miami 21 Code, as amended, be amended by making modifications to
Article 6, Table 13, in the following particulars:'

Section 3. If any section, part of a section, paragraph, clause, phrase, or word of this
Resolution is declared invalid, the remaining provisions of this Resolution should not be
affected.

Section 4. This Resolution shall become effective immediately upon its adoption.
