V op City of Miami Legislation d4 n �e Resolution Enactment Number: R-21-0476 File Number: 10990 City Hall 3500 Pan American Drive Miami, FL 33133 www.miamigov.com Final Action Date:11/18/2021 A RESOLUTION OF THE MIAMI CITY COMMISSION REAPPOINTING VICTORIA MENDEZ AS CITY ATTORNEY OF THE CITY OF MIAMI, FLORIDA TO HOLD OFFICE AS PROVIDED FOR IN THE CHARTER OF THE CITY OF MIAMI, FLORIDA, AS AMENDED, WITH COMPENSATION AND EMOLUMENTS AS INDICATED HEREIN. WHEREAS, pursuant to Section 4(e) of the Charter of the City of Miami, Florida, as amended ("City Charter'), the City Commission is obligated to elect and appoint a City Attorney; and WHEREAS, pursuant to Resolution No. 13-0361 adopted September 12, 2013, the City Commission elected and appointed Victoria Mendez ("Mendez") as the City Attorney; and WHEREAS, Section 21 of the City Charter requires the City Attorney to be reappointed after each general municipal election; and WHEREAS, Mendez has performed her duties as City Attorney in an exemplary and professional manner; and WHEREAS, Mendez has been an employee of the City of Miami ("City") since March 22, 2004; and WHEREAS, due to her dedicated service as an employee of the City as well as her exemplary service as City Attorney, Mendez should accrue vacation and sick leave (collectively, "Leave") in the same capacity as similarly situated executive employees of the City; and WHEREAS, Mendez should be reappointed as City Attorney with the same compensation and emoluments she currently receive except for the modification to Leave accrual as stated herein; NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY OF MIAMI, FLORIDA: Section 1. The recitals and findings contained in the Preamble to this Resolution are adopted by referenced and incorporated as if fully set forth in this Section. Section 2. Mendez is reappointed as City Attorney of the City of Miami, Florida to serve until the first City Commission meeting following the next general municipal election with compensation and emoluments to remain the same except for Leave accrual as stated herein. Section 3. This Resolution shall become effective immediately upon its adoption. APPROVED AS TO FORM AND CORRECTNESS: Barnaby L.
