A RESOLUTION OF THE MIAMI CITY COMMISSION DIRECTING THE CITY
ATTORNEY TO BEGIN THE PROCESS OF PREPARING A RESOLUTION FOR THE
CITY COMMISSION'S CONSIDERATION AT A FUTURE DATE CONSISTENT WITH
SECTION 2-64 OF THE CODE OF THE CITY OF MIAMI, FLORIDA, AS AMENDED,
THAT WILL DIRECT THE CITY ATTORNEY TO PREPARE AN AMENDMENT TO THE
CHARTER OF THE CITY OF MIAMI, FLORIDA, AS AMENDED, FOR THE
PURPOSES OF THE APPOINTMENT BY THE CITY MANAGER OF THE CHIEF OF
THE POLICE DEPARTMENT AND THE CHIEF OF THE FIRE -RESCUE
DEPARTMENT BY A COMMITTEE PROCESS AND FOR PLACEMENT ON THE
NEXT CITY OF MIAMI GENERAL ELECTION.

A RESOLUTION OF THE MIAMI CITY COMMISSION DIRECTING THE CITY
ATTORNEY TO BEGIN THE PROCESS OF PREPARING A RESOLUTION FOR THE
CITY COMMISSION'S CONSIDERATION AT A FUTURE DATE CONSISTENT WITH
SECTION 2-64 OF THE CODE OF THE CITY OF MIAMI, FLORIDA, AS AMENDED,
THAT WILL DIRECT THE CITY ATTORNEY TO PREPARE AN AMENDMENT TO THE
CHARTER OF THE CITY OF MIAMI, FLORIDA, AS AMENDED, FOR THE
PURPOSES OF THE APPOINTMENT BY THE CITY MANAGER OF THE CHIEF OF
THE POLICE DEPARTMENT AND THE CHIEF OF THE FIRE -RESCUE
DEPARTMENT BY A COMMITTEE PROCESS AND FOR PLACEMENT ON THE
NEXT CITY OF MIAMI GENERAL ELECTION.
WHEREAS, Section 16 of the Charter of the City of Miami, Florida, as amended
("Charter"), provides that the City Manager is empowered with the authority to appoint and
remove, except as otherwise provided in the Charter, all directors of the departments of the City
of Miami ("City"); and
WHEREAS, certain appointments, including the Chief of the Police Department and the
Chief of the Fire -Rescue Department are of critical importance to the City and should have an
additional level of review and scrutiny before those particular appointments are finalized by the
City Manager (collectively, "Appointments"); and
WHEREAS, the City Commission is desirous of improving the selection and appointment
process to ensure that it is fully transparent and open and one that provides the public with
confidence that the very best persons are selected; and
WHEREAS, to that end, an amendment to the Charter is required; and
WHEREAS, Section 2-64 of the Code of the City of Miami, Florida, as amended ("City
Code"), sets forth the required procedure for amendments to the Charter; and
NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY OF
MIAMI, FLORIDA:
Section 1. The recitals and findings contained in the Preamble to the Resolution are
adopted by reference and incorporated as if fully set forth in this Section.
Section 2. The City Attorney is directed to begin the process of preparing a Resolution
for the City Commission's consideration at a future date pursuant to Section 2-64 of the City
Code that will direct the City Attorney to prepare an amendment to the Charter for the purposes
of appointment by the City Manager of the Chief of the Police Department and the Chief of the
Fire -Rescue Department by a committee process and for placement on the next City of Miami
general election.
Section 3. This Resolution shall become effective immediately upon its adoption.
