Background of Item: The Department of Housing and Community Development ("Department") receives various types of repayments from loans provided to developers and homeowners in the past, such funds referred to as program income, are required to be used for eligible program activities. From February 1, 2021 to August 31, 2021, the Department of Housing and Community Development has collected an amount of $182,617.11 in Community Development Block Grant ("CDBG') program income. Pursuant to CDBG regulations 24 CFR Part 570.504, program income must be used for eligible CDBG activities. The Department recommends the allocation of the program income generated from February 1, 2021 to August 31, 2021, in the total amount of $182,617.11 to the activities specified in Exhibit "A" attached and incorporated, which are eligible CDBG activities. WHEREAS, the Department of Housing and Community Development ("HCD") receives various types of repayments from loans provided to developers and homeowners; and WHEREAS, from February 1, 2021 to August 31, 2021, HCD collected $182,617.11 in Community Development Block Grant ("CDBG") program income; and WHEREAS, pursuant to CDBG regulation 24 CFR Part 570.504, program income must be used for eligible CDBG activities; and WHEREAS, HCD recommends the allocation of the program income generated from February 1, 2021 to August 31, 2021 in the total amount of $182,617.11 to the activities specified in Exhibit "A," attached and incorporated, which are eligible CDBG activities; NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY OF MIAMI, FLORIDA: Section 1. The recitals and findings contained in the Preamble to this Resolution are adopted by reference and incorporated as if fully set forth in this Section. Section 2. The allocation of CDBG program income generated from February 1, 2021 to August 31, 2021 in the amount of $182,617.11 to the categories specified in Exhibit "A," attached and incorporated, is authorized.' Section 3. The City Manager is authorized' to negotiate and execute any and all necessary documents, all in forms acceptable to the City Attorney, for said purpose. Section 4. This Resolution shall become effective immediately upon its adoption. ' The herein authorization is further subject to compliance with all legal requirements that may be imposed, including but not limited to those prescribed by applicable City Charter and City Code provisions.
