Subject: Interlocal Agreement - Morningside Security Roving Guard Special Taxing

Purpose of Item:
A Resolution of the Miami City Commission, with attachment(s), authorizing the City
Manager to enter into a revised Interlocal Agreement with Miami -Dade County, Florida,
for the continuance of Special Revenue Fund Titled, "Morningside Security Guard
Special Taxing District" and appropriating said funds for police services within the
Morningside Security Guard Special Taxing District; further authorizing the City
Manager to negotiate and execute, in a form acceptable to the City Attorney, any and all
supplements and amendments to the interlocal agreement.
Background of Item:
Pursuant to Chapter 18 of the Code of Miami -Dade County, Florida, and Section 1.01(a)
of the Miami -Dade County Home Rule Charter, and approval by the Miami -Dade County
Board of County Commissioners by adoption of Ordinance, authorizes the creation of
the Morningside Security Guard Special Taxing District ("Taxing District") on March 20,
1997. The Board of County Commissioners authorized the County Manager to execute
a revised Interlocal Agreement with the City of Miami ("City"), for the continued provision
of police roving patrol services for said Taxing District. Section 163.01, Florida Statutes
and the Miami -Dade County Home Rule Charter, as amended, permit the County and
the City to enter into interlocal agreements. The City and the County desire to enter into
this Interlocal Agreement to provide for police services in the Morningside Security
Guard Special Taxing District consisting of services management, supervision,
manpower, equipment, vehicles and supplies as required.

A RESOLUTION OF THE MIAMI CITY COMMISSION, WITH ATTACHMENT(S),
AUTHORIZING THE CITY MANAGER TO ENTER INTO AN INTERLOCAL
AGREEMENT, IN SUBSTANTIALLY THE ATTACHED FORM, BETWEEN THE CITY
OF MIAMI AND MIAMI-DADE COUNTY FOR THE PROVISION OF POLICE ROVING
PATROL SERVICES WITHIN THE MORNINGSIDE SPECIAL TAXING DISTRICT
("DISTRICT") AND APPROPRIATING RESOURCES TO THE SPECIAL REVENUE
FUND TITLED, "MORNINGSIDE ROVING SECURITY GUARD SPECIAL TAXING
DISTRICT"; FURTHER APPROPRIATING SAID FUNDS FOR POLICE SERVICES
AND EXPENDITURES WITHIN THE DISTRICT; FURTHER AUTHORIZING THE CITY
MANAGER TO NEGOTIATE AND EXECUTE, ALL IN FORMS ACCEPTABLE TO THE
CITY ATTORNEY, ANY AND ALL SUPPLEMENTS AND AMENDMENTS TO THE
INTERLOCAL AGREEMENT AS MAY BE NECESSARY.
WHEREAS, Chapter 18 of the Code of Miami -Dade County, Florida; Section 1.01(a) of
the Miami -Dade County Home Rule Charter ("County Charter'); and Ordinance No. 11460
adopted by the Miami -Dade County ("County") Board of County Commissioners ("County
Commission") authorized the creation of the Morningside Security Guard Special Taxing District
("Taxing District") on March 20, 1997; and
WHEREAS, the County Commission authorized the County Manager to execute a
revised Interlocal Agreement with the City of Miami ("City") for the continued provision of police
roving patrol services for the Taxing District; and
WHEREAS, Section 163.01, Florida Statutes, and the County Charter permit the County
and the City (collectively, "Parties") to enter into interlocal agreements; and
WHEREAS, the Parties desire to enter into the Interlocal Agreement, attached and
incorporated as Exhibit "A", to provide for police services in the Taxing District consisting of
services management, supervision, manpower, equipment, vehicles, and supplies as required;
NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY OF
MIAMI, FLORIDA:
Section 1. The recitals and findings contained in the Preamble to this Resolution are
adopted by reference and incorporated as if fully set forth in this Section.
Section 2. The City Manager is authorized' to enter into a revised Interlocal Agreement,
in substantially the attached form, with the County for the continued provision of police roving
patrol services for the Taxing District.
Section 3. The following Special Revenue Project is established and resources are
appropriated as described below:
FUND TITLE: MORNINGSIDE SECURITY GUARD
SPECIAL TAXING DISTRICT
RESOURCES: Miami -Dade County $224,043.00
Budgeted Amount for Fiscal Year ("FY") 2021-2022
APPROPRIATIONS: Special Taxing Districts $224,043.00
Budgeted Amount for FY 2021-2022
Section 4. The City Manager is further authorized' to negotiate and execute any and all
supplements and amendments to the Interlocal Agreement, all in forms acceptable to the City
Attorney, as may be necessary.
Section 5. This Resolution shall become effective immediately upon its adoption.
