A RESOLUTION OF THE MIAMI CITY COMMISSION, WITH ATTACHMENT(S),
BY A FOUR -FIFTHS (4/5THS) AFFIRMATIVE VOTE, RATIFYING,
CONFIRMING, AND APPROVING THE CITY MANAGER'S EMERGENCY
FINDING, ATTACHED AND INCORPORATED AS EXHIBIT "A", THAT IT IS
MOST ADVANTAGEOUS OR PRACTICABLE FOR THE CITY OF MIAMI
("CITY") TO WAIVE THE COMPETITIVE SEALED BIDDING REQUIREMENTS
PURSUANT TO SECTION 18-90 OF THE CODE OF THE CITY OF MIAMI,
FLORIDA, AS AMENDED ("CITY CODE"), AND RETROACTIVELY
APPROVING THE SELECTION OF BROUSS ELEVATORS INC., A FLORIDA
PROFIT CORPORATION, FOR THE PROVISION OF EMERGENCY
RENOVATION OF THE ELEVATORS HOUSED AT THE CITY'S OLYMPIA
THEATER RESIDENTIAL TOWER FOR THE CITY'S DEPARTMENT OF REAL
ESTATE AND ASSET MANAGEMENT FOR AN ESTIMATED EXPENDITURE
AMOUNT OF SIX HUNDRED NINETY EIGHT THOUSAND SEVEN HUNDRED
DOLLARS ($698,700.00); AUTHORIZING THE CITY MANAGER TO
NEGOTIATE AND EXECUTE ANY AND ALL DOCUMENTS, INCLUDING ANY
AMENDMENTS, RENEWALS, AND EXTENSIONS, SUBJECT TO ALL
ALLOCATIONS, APPROPRIATIONS, PRIOR BUDGETARY APPROVALS,
COMPLIANCE WITH ALL APPLICABLE PROVISIONS OF THE CITY CODE,
INCLUDING THE CITY'S PROCUREMENT ORDINANCE, ANTI -DEFICIENCY
ACT, AND FINANCIAL INTEGRITY PRINCIPLES, ALL AS SET FORTH IN
CHAPTER 18 OF THE CITY CODE, IN FORMS ACCEPTABLE TO THE CITY
ATTORNEY, AND IN COMPLIANCE WITH ALL APPLICABLE LAWS, RULES,
AND REGULATIONS, AS MAY BE DEEMED NECESSARY FOR SAID
PURPOSE.
WHEREAS, the City of Miami ("City") owns the Olympia Theater Residential Tower
("Olympia Tower"), a ten (10) story, eighty (80) unit, affordable housing complex located at 8
Southeast 2nd Avenue, Miami, Florida 33131; and
WHEREAS, the two (2) elevators housed at the Olympia Tower are required to operate
twenty-four (24) hours a day, seven (7) days a week and are vital to ongoing operations in
providing daily service to the residential tenants as well as the facility's maintenance employees;
and
WHEREAS, the emergency renovation of the Olympia Tower's elevators was essential
to life, health, welfare, and safety for the City and its residents; and
WHEREAS, the City Manager, pursuant to Section 18-90 of the Code of the City of
Miami, Florida, as amended ("City Code"), approved an emergency purchase for procurement of
services from Brouss Elevators Inc., a Florida profit corporation ("Brouss"), for the emergency

renovations of the Olympia Tower's elevators for the City's Department of Real Estate and
Asset Management ("DREAM");
NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY OF
MIAMI, FLORIDA:
Section 1. The recitals and findings contained in the Preamble to this Resolution are
adopted by reference and incorporated as if fully set forth in this Section.
Section 2. By a four -fifths (4/5ths) affirmative vote, the City Manager's emergency
finding, attached and incorporated as Exhibit "A", that it is most advantageous or practicable for
the City to waive competitive sealed bidding requirements pursuant to Section 18-90 of the City
Code, and retroactively approving the selection of Brouss for the emergency renovations of the
elevators housed at the City's Olympia Tower for DREAM for an estimated expenditure amount
of Six Hundred Ninety Eight Thousand Seven Hundred Dollars ($698,700.00) is hereby ratified,
confirmed, and approved.
Section 3. The City Manager is authorized' to negotiate and execute any and all
documents, including any amendments, renewals, and extensions, subject to all allocations,
appropriations, prior budgetary approvals, compliance with all applicable provisions of the City
Code, including the City's Procurement Ordinance, Anti -Deficiency Act, and Financial Integrity
Principles, all as set forth in Chapter 18 of the City Code, in forms acceptable to the City
Attorney, and in compliance with all applicable laws, rules, and regulations, as may be deemed
necessary for said purpose.
Section 4. This Resolution shall become effective immediately upon its adoption.
