20-0231 ADOPTED ON JULY 23, 2020 AND RESOLUTION NO. R-21-0021 ADOPTED
ON JANUARY 14, 2021 FROM SEPTEMBER 30, 2021 TO DECEMBER 31, 2021 IN
ORDER TO CONTINUE TO ASSIST STRUGGLING BUSINESSES AFFECTED BY
THE NOVEL CORONAVIRUS PANDEMIC WITH ALL OTHER PROVISIONS OF SUCH
PRIOR RESOLUTIONS TO REMAIN THE SAME; DIRECTING THE CITY CLERK TO
TRANSMIT A CERTIFIED COPY OF THIS RESOLUTION TO THE OFFICIALS

A RESOLUTION OF THE MIAMI CITY COMMISSION EXTENDING THE TEMPORARY
OUTDOOR DINING PROGRAM ESTABLISHED PURSUANT TO RESOLUTION NO.
R-20-0156 ADOPTED ON MAY 14, 2020 AND EXTENDED BY RESOLUTION NO. R-
20-0231 ADOPTED ON JULY 23, 2020 AND RESOLUTION NO. R-21-0021 ADOPTED
ON JANUARY 14, 2021 FROM SEPTEMBER 30, 2021 TO DECEMBER 31, 2021 IN
ORDER TO CONTINUE TO ASSIST STRUGGLING BUSINESSES AFFECTED BY
THE NOVEL CORONAVIRUS PANDEMIC WITH ALL OTHER PROVISIONS OF SUCH
PRIOR RESOLUTIONS TO REMAIN THE SAME; DIRECTING THE CITY CLERK TO
TRANSMIT A CERTIFIED COPY OF THIS RESOLUTION TO THE OFFICIALS

WHEREAS, under the provisions of law and Sections 252.31 - 252.60, Florida Statutes,
Mayor Francis X. Suarez ("Mayor") of the City of Miami ("City") declared on March 12, 2020 that
a State of Local Emergency exists within the City in response to the Novel Coronavirus
("COVID-19") pandemic; and
WHEREAS, in accordance with the provisions of Section 252.38(3)(a), Florida Statutes,
the Mayor extended the State of Local Emergency; and
WHEREAS, as a result of the State of Local Emergency, many businesses were closed,
and residents were directed to stay at home; and
WHEREAS, pursuant to Resolution No. R-20-0156 adopted on May 14, 2020, the City
Commission authorized the City Manager to identify feasible portions of City rights -of -way that
may be repurposed for pedestrian and Sidewalk Cafe usage ("Outdoor Dining Program") and to
take any and all steps necessary to effectuate such repurposing until August 20, 2020 in order
to assist businesses negatively affected by the COVID-19 pandemic; and
WHEREAS, pursuant to Resolution No. R-20-0231 adopted on July 23, 2020, the City
Commission extended the Outdoor Dining Program to further assist struggling businesses; and
WHEREAS, pursuant to Resolution No. R-21-0021 adopted on January 14, 2021, the
City Commission further extended the Outdoor Dining Program until September 30, 2021; and
WHEREAS, pursuant to Resolution No. R-21-0176 adopted on April 22, 2021, the City
Commission directed the City Manager to take any and all steps necessary to make the
temporary Outdoor Dining Program permanent; and
WHEREAS, the City continues to work toward a permanent Outdoor Dining Program;
and
WHEREAS, as the COVID-19 pandemic continues and the City works on a permanent
Outdoor Dining Program, the City Commission wishes to extend the program until December
31, 2021 in order to continue to assist struggling businesses;
NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY OF
MIAMI, FLORIDA:
Section 1. The recitals and findings set forth in the Preamble to this Resolution are
hereby adopted by reference thereto and incorporated herein as if fully set forth in this Section.
Section 2. The Outdoor Dining Program created by Resolution R-20-0156 adopted on
May 14, 2020 and extended by Resolution No. R-20-0231 adopted on July 23, 2020 and
Resolution No. R-221-0021 adopted on January 14, 2021 is hereby extended from September
30, 2021 until December 31, 2021 with all other provisions of such prior Resolutions to remain
the same.
Section 3. The City Clerk is directed to transmit a certified copy of this Resolution to the
Miami -Dade County ("County") Board of County Commissioners, the County Mayor, and the
Director of the County's Department of Transportation and Public Works.
Section 4. The Resolution shall become effective immediately upon its adoption.
