PZ-20-7970 The Applicant's request is appropriate and consistent with the Goals, 03/02/21 Policies of the Miami Comprehensive Neighborhood Plan (the "Comprehensive Plan' below is our analysis of the Goals, Objectives and Policies that support the Applicant's amendment. LAND USE GOALS Goal LU-1: Maintain a land use pattern that (1) protects and enhances the quality of life in the City's neighborhoods; (2) fosters redevelopment and revitalization of blighted or declining areas; (3) promotes and facilitates economic development and the growth of job opportunities in the city; (4) fosters the growth and development of downtown as a regional center of domestic and international commerce, culture and entertainment; (5) promotes the efficient use of land and minimizes land use conflicts while protecting and preserving residential sections within neighborhoods; (6) protects and conserves the city's significant natural and coastal resources; and (7) protects the integrity and quality of the City's existing neighborhoods by insuring public notice, input and appellant rights regarding changes in existing zoning and land use regulations. The requested FLUM amendment would promote a more consistent and appropriate "transitional buffer"between the "Duplex Residential" land use designation, located to the west and south of the Property, from the "Restricted Commercial" land use designation found to the east of the Property. This proposed land use amendment will essentially act as a "transitional buffer" in shielding the low density residential land uses located to the west and south of the Property from the office, retail, high density residential, and commercial designated uses located to the east of the Property. In addition, the redevelopment of this property will not create any adverse effects to the surrounding community. Objective LU-1.1: Ensure that land and development regulations are consistent with fostering a high quality of life in all areas, including the timely provision of public facilities that meet or exceed the minimum level of service (LOS) standards adopted in the Capital Improvements Element (CIE) of the Miami Comprehensive Neighborhood Plan. Policy LU-1.1.3: The City's zoning ordinance provides for protection of all areas of the city from: (1) the encroachment of incompatible land uses; (2) the adverse impacts of future land uses in adjacent areas that disrupt or degrade public health and safety, or natural or man-made amenities; (3) transportation policies that divide or fragment established neighborhoods; and (4) degradation of public open space, environment, and ecology. Strategies to further protect existing neighborhoods through the development of appropriate transition standards and buffering requirements will be incorporated into the City's land development regulations. Policy LU-1.3.15: The City will continue to encourage a development pattern that enhances existing neighborhoods by developing a balanced mix of uses including areas for employment, shopping, housing, and recreation in close proximity to each other. PZ-20-7970 The proposed FLUM amendment of "Low Density Restricted Com 03/02/21 promote and encourage a development of the kind that would a balanced mix of different uses other than just residential uses without c any negative impact on the neighboring residential areas. The Property's current land use designation of "Duplex Residential" does not maximize the best use of the Property, and is not the most compatible or appropriate designation with the surrounding area. The proposed "Low Density Restricted Commercial" FLUM designation promotes the policies mentioned above by allowing commercial, office, and higher density residential development. The proposed FLUM designation is the most appropriate designation, as it does not create an encroachment on the established residential areas to the west or south. Furthermore, the proposed FLUM designation to "Low Density Restricted Commercial", is consistent with the long term planning for this corridor as well as consistent with other land use designated areas surrounding the Property. Goal LU-3: Encourage urban redevelopment in identified Urban Infill Areas and Urban Redevelopment Areas. Objective LU-3-1: Promptly review and act on petitions for land use plan amendments and rezoning of property in Urban Infill Areas or Urban Redevelopment Areas to facilitate redevelopment. Policy LU-3.1.1: Continue review of existing zoning regulations to determine if they provide adequate flexibility to promote redevelopment with a mix of uses in Urban Infill Areas or Urban Redevelopment Areas and, if not, revise said existing zoning regulations or adopt new zoning regulations to promote redevelopment. The proposed FLUM amendment to "Low Density Restricted Commercial" would be consistent with the surrounding area and promote urban infill and urban redevelopment. Currently, the Property is underdeveloped with an existing and outdated duplex. The proposed FLUM amendment will allow for the redevelopment of the Property that is supportive to a range of uses such as office, commercial, and residential, which is currently needed in close proximity to the existing residential, commercial, retail, and office uses in the surrounding area. TRANSPORTATION GOALS Goal TR-1: Maintain an effective and cost efficient traffic circulation network within the City of Miami that provides transportation for all persons and facilitates commercial activity, and which is consistent with, and furthers, neighborhood plans, supports economic development, conserves energy, and protects and enhances the natural environment.
