HomeMy WebLinkAboutR-21-0353City of Miami f Legislation Resolution: R-21-0353 File Number: 9457 City Hall 3500 Pan American Drive Miami, FL 33133 www.miamigov.com Final Action Date: 9/13/2021 A RESOLUTION OF THE MIAMI CITY COMMISSION, WITH ATTACHMENTS, APPROVING THE CITY OF MIAMI'S ("CITY") FISCAL YEAR 2021-22 MULTI- YEAR CAPITAL PLAN ("PLAN") AS REQUIRED PURSUANT TO THE COMMUNITY PLANNING ACT, SPECIFICALLY SECTIONS 163.3161 AND 163.3177, FLORIDA STATUTES (2020), AND CHAPTER 18/ARTICLE IX/DIVISIONS 1 AND 2 OF THE CODE OF THE CITY OF MIAMI, FLORIDA, AS AMENDED, TITLED "FINANCIAL/FINANCIAL POLICIES/ANTI-DEFICIENCY ACT/FINANCIAL INTEGRITY PRINCIPLES," TO SET FORTH THE CITY'S FISCAL NEEDS FOR CAPITAL IMPROVEMENTS, SUBJECT TO AN ANNUAL PLAN REVIEW, TO DETERMINE PROJECT PRIORITIES, TO ADD NEW CAPITAL PROJECTS, AND TO MODIFY FUNDING ALLOCATIONS AS NECESSARY; PROVIDING FOR INCORPORATION OF SUBSEQUENT AMENDMENTS TO THE PLAN; AND PROVIDING FOR AN EFFECTIVE DATE. WHEREAS, a capital improvement programming process to support the Miami Neighborhood Comprehensive Plan is required pursuant to the Community Planning Act, specifically, Sections 163.3161 and 163.3177, Florida Statutes (2020), and Chapter 18/Article IX/Divisions 1 and 2 of the Code of the City of Miami, Florida, as amended, titled "Finance/Financial Policies/Anti-Deficiency Act/Financial Integrity Principles" (collectively, "Laws"); and WHEREAS, the City of Miami's ("City") Fiscal Year (TY") 2021-22 Proposed Multi -Year Capital Plan as presented to the City Commission, filed with the City Clerk, and posted on the City's website on July 12, 2021 incorporates the FY 2020-21 Multi -Year Capital Plan set forth in Resolution No. R-20-0307 adopted September 24, 2020, Resolution No. R-20-0387 adopted November 19, 2020, Resolution No. R-20-0409 adopted December 10, 2020, Resolution No. R- 21-0044 adopted January 28, 2021, Resolution No. R-21-0175 adopted April 22, 2021, Resolution No. R-21-0224 adopted June 10, 2021, and Resolution No. R-21-0264 adopted June 24, 2021 (collectively, "Proposed Plan"); and WHEREAS, during the current FY, new capital appropriations totaling $40.685 million will be used to fund 63 projects as detailed in Exhibit "A," attached and incorporated; and WHEREAS, the Proposed Plan is a policy and management tool to plan municipal borrowing and indebtedness over a period of time, to establish annual expenditures within a framework of long-range fiscal requirements, and to serve as an official statement of the City's development plans; and WHEREAS, this Resolution is adopted as amended by incorporating the applicable changes listed in the memorandum dated August 31, 2021 and signed by the City Manager, attached and incorporated as Exhibit "B"; and WHEREAS, the Proposed Plan shall incorporate all amendments thereto; City of Miami Page 1 of 2 File ID: 9457 (Revision: A) Printed On: 101512021 File ID: 9457 Enactment Number: R-21-0353 NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY OF MIAMI, FLORIDA: Section 1. The recitals and findings contained in the Preamble to this Resolution are adopted by reference and incorporated as if fully set forth in this Section. Section 2. The Proposed Plan as presented to the City Commission, filed with the City Clerk, posted on the City's website on July 12, 2021, and as amended by Exhibit "B", attached and incorporated, is approved as required pursuant to the Laws to set forth the City's fiscal needs for capital improvements, subject to an annual plan review, to determine project priorities, to add new capital projects, and to modify funding allocations as necessary. Section 3. This Resolution shall become effective immediately upon its adoption and signature of the Mayor.'
