WHEREAS, from time -to -time it becomes necessary to amend the zoning regulations of the City of Miami ("City") and WHEREAS, many parts of the City, including Coconut Grove, are known and loved for their lush landscapes and verdant character; and WHEREAS, open air trellises and pergolas encourage such character and, when placed over residential driveways, provide useful shade; and WHEREAS, existing land development regulations limit such application of trellises and pergolas; and WHEREAS, in accordance with Section 2-33(f) of the Code of the City of Miami, Florida, as amended, the City Commission, by a majority vote, hereby deems this Resolution to be of an emergency nature; NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY OF MIAMI, FLORIDA: Section 1. The recitals and findings contained in the Preamble to this Resolution are adopted by reference and incorporated herein as if fully set forth in this Section. Section 2. The City Manager is directed to immediately draft legislation to amend the Zoning Ordinance of the City of Miami, Florida, as amended, to authorize the construction of open-air trellises and pergolas over residential driveways and submit such legislation to the Planning, Zoning, and Appeals Board and City Commission for consideration. Section 3. In the event that any portion or section of this Resolution is determined to be invalid, illegal, or unconstitutional by a court or agency of competent jurisdiction, such decision shall in no manner affect the remaining portions of this Resolution, which shall remain in full force and effect. Section 4. This Resolution shall become effective immediately upon its adoption.
