The proposed rezoning is simply a request to change from restricted uses ("R") to limited uses ("L"). The abutting properties to the East, also owned by the Applicant, are zoned T4-L and therefore the proposed rezoning complies with Section 7.1.2.8(c)(1) of Miami 21. Furthermore, the Applicant is seeking a Comprehensive Plan Amendment from Medium Density Multifamily to Medium Density Restricted Commercial pursuant to the small scale amendment procedures of Florida Statutes, Section 163.3187. PROPERTY INFORMATION The Property is located within the Little Haiti neighborhood, with the Buena Vista East neighborhood to the South, the former Archbishop Curley campus to the East, the Miami Jewish Health Systems medical campus to the North, and a multifamily residential structure immediately to the West. The Property's location provides convenient access to varied transportation options including NE 2nd Avenue, a major North/South corridor, and NE 54th Street, a major East/West corridor. A complete legal description for the Property is provided in the enclosed survey prepared by American Surveying and Mapping, Inc. (the "Survey"). According to the Survey, the Subject Property's lot area consists of approximately 6,874 square feet or 0.158 acres. The Applicant requests to rezone the Subject Property to the next Building Function category within the same Transect Zone, T4-L Limited (L), pursuant to the successional zoning requirements of Article 7, Section 7.1.2.8 of Miami 21. The proposed rezoning will facilitate the creation of a single Story Office development along a major corridor (NE 2nd Avenue) and in close proximity to public transit without increasing Density, Intensity, or building height. For the reasons outlined below, the proposed rezoning is appropriate for the Property, meets the criteria established in Article 7, Section 7.1.2.8 of Miami 21 and, therefore, should be approved. 1. The proposed rezoning is compatible with the surrounding zoning districts and provides a transition in density and intensity which is consistent with the goals of Miami 21. Article 7, Section 7.1.2.8(f)(2) of Miami 21 requires zoning changes to maintain the goals of Miami 21 and to provide transitions in intensity and Building Height. As depicted in the portion of the City's GIS provided below, the Property is currently located within a T4 Transect Zone, with T4 Transect Zones located immediately to the East, West, North, and South. As stated above, the requested rezoning is merely for the Building Function, and does not change the Density, Intensity, or Height permitted at the Property. REQUEST FOR COMPREHENSIVE MAP LAND USE CHANGE Per the Miami Neighborhood Comprehensive Plan, the current designation for the Property is Medium Density Multifamily Residential (MDMR). The Applicant requests to change the Property to Medium Density Restricted Commercial (MDRC) in order to allow for Office Uses.
