Lin International 201 Alhambra Circle, Suite 900 Coral Gables, FL 33134 VIA EMAIL: Francisco.Alonso(a)tylin.com RE: Vendor Non -Performance concerns regarding Contract No. 12-13-004, Miscellaneous Civil Engineering Services Dear Mr. Alonso: This letter serves as the written summary of the Vendor Non -Performance Meeting held via Microsoft Teams on February 16, 2021 at 4:00 P.M. A tape recording of the meeting is available upon request. The purpose of the meeting was to discuss the various non-performance issues with Contract No. 12-13-004, in particular those related to specific work orders for Golden Pines Office of Capital Improvements ("OCI") Projects B-50412, B-50413, B50414, B50420, and B-50421. The meeting was attended by representatives of T.Y. Lin International ("T.Y. Lin"), the Directors of the City of Miami ("City") departments for Procurement, "OCI", and Resilience & Public Works ("R&PW'), Assistant City Managers, and the Chief of Staff for the District 4 Commission Office. During the meeting, the City notified T.Y. Lin that any deficiencies related to missed deadlines in achieving plan submittal milestones must be cured immediately. As a result, T.Y. Lin is to provide one hundred percent (100%) completed plans for each of the following projects related to Golden Pines OCI Projects B-50412, B-50413, B-50414 and B-50421, as listed in the City of Miami letter to T.Y. Lin dated December 22, 2020, and is to submit the same to R&PW and OCI by close of business on March 1, 2021. Please be advised that no time extensions will be granted. In order to achieve this, T.Y. Lin has committed to increasing its current staff assigned to these deliverables in a manner sufficient to meet the agreed upon deadline. Furthermore, T.Y. Lin is hereby notified that any revisions to the plans directed by the City on or after March 1, 2021, must be completed and returned to R&PW and OCI within seventy-two (72) hours of receipt of those comments. T.Y. Lin has indicated its commitment to curing these deficiencies. Should the City find that these deficiencies described above are not cured within the specified timeframe of March 1 st, 2021 as set forth in this letter, the vendor may be found in default, terminated, and the City may seek other options. Procurement will follow up with R&PW and OCI as needed prior to the March 1, 2021 deadline in order to evaluate T.Y. Lin's progress. Non -Performance Review Meeting, T.Y.
