A RESOLUTION OF THE MIAMI CITY COMMISSION, WITH ATTACHMENT(S),
ACCEPTING EMERGENCY RENTAL ASSISTANCE 2 FUNDS IN THE
AMOUNT OF $22,779,317.10 FROM THE UNITED STATES DEPARTMENT OF
THE TREASURY; FURTHER AUTHORIZING THE CITY MANAGER TO
NEGOTIATE AND EXECUTE ANY AND ALL NECESSARY DOCUMENTS, ALL
IN FORMS ACCEPTABLE TO THE CITY ATTORNEY, FOR SAID PURPOSE,
SUBJECT TO ALL FEDERAL, STATE, AND LOCAL LAWS THAT REGULATE
THE USE OF SUCH FUNDS.
WHEREAS, on February 11, 2021, pursuant to Resolution No. R-21-0065, the City of
Miami ("City") accepted $14,130,464.60 from the United States Department of the Treasury
("Treasury") to establish an Emergency Rental Assistance Program; and
WHEREAS, on May 7, 2021, the President of the United States, Joseph R. Biden,
announced the allocation of $21.6 billion under the American Rescue Plan for Emergency
Rental Assistance ("ERA 2") that was allocated to the Treasury for distribution to states and
units of local government with more than 200,000 residents; and
WHEREAS, on May 7, 2021, the Treasury published the allocations with the City being
allocated an amount of $11,180,775.30 for a regular allocation and an additional allocation of
$11,598,541.80 due to the City's status as a high -need City for a total amount of
$22,779,317.10 ("Funds"); and
WHEREAS, on May 22, 2021, the City received an allocation from the Treasury in the
amount of $4,472,310.12 as a regular allocation and an amount of $4,639,416.72 as a high -
need allocation; and
WHEREAS, all funds received must be used to continue promoting housing stability for
eligible households as stipulated in the guidance from the Treasury and as described in Exhibit
"A," attached and incorporated; and
WHEREAS, ERA 2 funds must be committed by September 30, 2025; and
WHEREAS, the City's Administration recommends the acceptance of the Funds from the
Treasury;
NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY OF
MIAMI, FLORIDA:
Section 1. The recitals and findings contained in the Preamble to this Resolution are
adopted by reference and incorporated as if fully set forth in this Section.
Section 2. The ERA 2 Funds from the Treasury are accepted.

Section 3. The City Manager is authorized' to negotiate and execute any and all
necessary documents, all in forms acceptable to the City Attorney, for said purpose, subject to
all federal, state, and local laws that regulate the use of such funds.
Section 4. This Resolution shall become effective immediately upon its adoption and
signature of the Mayor.2

' The herein authorization is further subject to compliance with all legal requirements that may be
imposed, including but not limited to, those prescribed by applicable City Charter and City Code
provisions.
2 If the Mayor does not sign this Resolution, it shall become effective at the end of ten (10) calendar days
from the date it was passed and adopted. If the Mayor vetoes this Resolution, it shall become effective
immediately upon override of the veto by the City Commission.
