A PUBLIC HEARING, DIRECTING THE CITY MANAGER TO TAKE ANY AND ALL
ACTIONS NECESSARY TO EXPEDITIOUSLY REQUEST THAT THE MIAMI-DADE
COUNTY TRANSPORTATION & PUBLIC WORKS DEPARTMENT ("DTPW')
CONSIDER PROPOSED TRAFFIC FLOW MODIFICATIONS REGARDING THE CITY
OF MIAMI'S OFFICE OF CAPITAL IMPROVEMENTS PROJECT NO. 40-13193615 AND
WAIVE THE REQUIRED RESIDENT CONCURRENCE AND EXEMPT THE
BALLOTING PROCESS IN ORDER TO EXPEDITIOUSLY PROCEED WITH THE
DESIGN AND CONSTRUCTION OF SEVEN TRAFFIC CALMING DEVICES AT THE
FOLLOWING INTERSECTIONS: 1) NW 40TH STREET BETWEEN NW MIAMI
AVENUE AND NW 1ST AVENUE; 2) NW 49TH STREET BETWEEN NW 1ST
AVENUE AND NW 2ND AVENUE; 3) NW 50TH STREET BETWEEN N MIAMI
AVENUE AND NW 2ND AVENUE; 4) NW 51ST STREET BETWEEN N MIAMI
AVENUE AND NW 1ST AVENUE; 5) INTERSECTION OF NW 1ST AVENUE AND NW
39TH STREET; 6) INTERSECTION OF NW 1ST AVENUE AND NW 53RD STREET;
and 7) INTERSECTION OF NE 42ND STREET AND NE 1 ST AVENUE; DIRECTING
THE CITY CLERK TO SEND A CERTIFIED COPY OF THIS RESOLUTION TO THE
DTPW DIRECTOR.
Background of Item:
As directed in City of Miami Resolution R-18-0396, approving the FY 2018-219 multi-
year capital plan, the Commission authorized and directed the City Manager to design
and construct traffic calming devices at the Buena Vista neighborhood, under 40-
B193615 Traffic Calming Devices - Phase II D5 Roadway Project. The area for the
project is bounded by NW 54th St on the north, NW 2nd Ave on the west, NW 36th St
on the south and N. Miami Ave on the east.
This is related to the agreement between the City of Miami and Miami Dade County
executed on July 21, 2015 to perform traffic engineering studies to install and maintain
designated traffic circles, speed humps, historic street name signs, an in -street
pedestrian crossing signs and/or traffic calming devices.

AFTER A PUBLIC HEARING, AUTHORIZING AND DIRECTING THE CITY MANAGER
TO TAKE ANY AND ALL ACTIONS NECESSARY TO EXPEDITIOUSLY REQUEST
THAT THE MIAMI-DADE COUNTY TRANSPORTATION & PUBLIC WORKS
DEPARTMENT ("DTPW') CONSIDER PROPOSED TRAFFIC FLOW MODIFICATIONS
REGARDING THE CITY OF MIAMI'S OFFICE OF CAPITAL IMPROVEMENTS
PROJECT NO. 40-13193615, WAIVE THE REQUIRED RESIDENT CONCURRENCE,
AND EXEMPT THE BALLOTING PROCESS IN ORDER TO EXPEDITIOUSLY
PROCEED WITH THE DESIGN AND CONSTRUCTION OF TRAFFIC CALMING
DEVICES AT SEVEN (7) LOCATIONS IN THE BUENA VISTA RESIDENTIAL
NEIGHBORHOOD OF DISTRICT 5; DIRECTING THE CITY CLERK TO SEND A
CERTIFIED COPY OF THIS RESOLUTION TO THE DTPW DIRECTOR.
WHEREAS, several locations in the City of Miami's ("City") Buena Vista residential
neighborhood experience significant cut -through traffic and speeding during rush hour periods;
and
WHEREAS, such cut -through traffic and speeding on a local residential street not
designed for such volume diminishes the residents' quality of life; and
WHEREAS, in addition to quality -of -life problems such as noise and general congestion,
such cut -through traffic and speeding creates significant life -safety risks as the residential
streets are narrower than nearby arterial roadways, increasing the risk of vehicular accidents
including those involving pedestrians; and
WHEREAS, rush hour cut -through traffic tends to disobey posted speed limits and
signage in order to gain an advantage over using arterial roadways meant for such traffic; and
WHEREAS, in order to address these quality -of -life issues, the City took all necessary
and required actions to approve traffic calming devices at the following seven (7) locations as
part of Office of Capital Improvements Project No. 40-13193515 ("Project"): (1) Northwest 40
Street between Northwest Miami Avenue and Northwest 1 Avenue; (2) Northwest 49 Street
between Northwest 1 Avenue and Northwest 2 Avenue; (3) Northwest 50 Street between North
Miami Avenue and Northwest 2 Avenue; (4) Northwest 51 Street between North Miami Avenue
and Northwest 1 Avenue; (5) Northwest 1 Avenue and Northwest 39 Street; (6) Northwest 1
Avenue and Northwest 53 Street; and (7) Northeast 42 Street and Northeast 1 Avenue; and
WHEREAS, Section 1.6 of the Miami -Dade County Traffic Flow Modification(s)/Street
Closure(s) Procedure ("County Procedure") as revised by the Miami -Dade County Public Works
Department's (TWD") Traffic Engineering Division in January 2009, attached and incorporated
as Exhibit "A", states that the construction of traffic flow modifications other than traffic circles
"[r]equires concurrence of two-thirds (2/3) of the affected residents and/or property owners, who
elected to vote (ballots received)"; and
WHEREAS, Section 1.6 of the County Procedure, attached and incorporated as Exhibit
"A", also states that "[i]n lieu of concurrence from the affected residents and/or property owners,
a municipality may pass a resolution after a public hearing requesting PWD to consider the
proposed traffic flow modification(s)/street closure(s)"; and
WHEREAS, it is in the best interest of the City's residents to waive the required resident
concurrence and request that PWD consider the proposed traffic flow modifications at the seven
(7) previously identified locations;
NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY OF
MIAMI, FLORIDA:
Section 1. The recitals and findings contained in the Preamble to this Resolution are
adopted by reference and incorporated as if fully set forth in this Section.
Section 2. The City Commission, after a public hearing, authorizes' and directs the City
Manager to take any and all actions necessary to expeditiously request that PWD consider the
proposed traffic flow modifications regarding the following locations: (1) Northwest 40 Street
between Northwest Miami Avenue and Northwest 1 Avenue; (2) Northwest 49 Street between
Northwest 1 Avenue and Northwest 2 Avenue; (3) Northwest 50 Street between North Miami
Avenue and Northwest 2 Avenue; (4) Northwest 51 Street between North Miami Avenue and
Northwest 1 Avenue; (5) Northwest 1 Avenue and Northwest 39 Street; (6) Northwest 1 Avenue
and Northwest 53 Street; and (7) Northeast 42 Street and Northeast 1 Avenue.
Section 3. The City Clerk is directed to send a certified copy of this Resolution to
Director of Miami -Dade County's Department of Transportation & Public Works.
Section 4. This Resolution shall become effective immediately upon its adoption.
