The Development Agreement recorded at Official Record Book 29976, Pages 189-228, of the Public Records of Miami -Dade County, Florida, was executed and entered into by the City and the appropriate parties on February 24, 2016. The Commission approval was based, in part, on a Project traffic study, conducted by Kimley-Horn, dated August 2014, which proposed the conversion of a segment of SW 3rd Avenue between SW 6th Street and SW 7th Street ("SW 3rd Segment") from a one-way street that allows only northbound traffic to a two-way street that would permit traffic north and south bound. The conversion of this SW 3rd Segment was included in the Project's approved conceptual plan, as well as in the Development Agreement as one of the required traffic infrastructure improvements identified as a community benefit; and in furtherance of the Project requirements, the City Commission desires to support the conversion of the SW 3rd Segment as a two-way street, subject to review and approval by Miami -Dade County and implementation by the Project developer, as duly permitted by the City. Background of Item: The City of Miami Commission supports the conversion of a certain segment of Southwest 3rd Avenue located between its intersections with Southwest 7th and Southwest 6th Streets into a "two-way" street, permitting traffic to flow in northerly and southerly directions, starting at the intersection of Southwest 3rd Avenue and Southwest 7th Street and ending at the intersection of Southwest 3rd Avenue and Southwest 6th Street. It is recognized that to accomplish the conversion of the SW 3rd Segment, the Project developer shall obtain approval from Miami -Dade County and design, permit, and construct, or cause to be designed, permitted, and construct, road and other streetscape improvements, in accordance with Project approvals and City requirements; authorizing the City Manager to take such further action as may be necessary to implement the purpose and provisions of this Resolution. WHEREAS, pursuant to Ordinance No. 13571 adopted October 22, 2015, the City Commission approved the "Miami River Special Area Plan," a mixed -use development bounded on the North by the Miami River, on the South by Southwest 7th Street, on the East by Southwest 2nd Avenue, and on the West by Southwest 3rd Avenue, Miami, Florida ("Project"); and WHEREAS, the City Commission's approval authorized the City Manager to execute a development agreement to memorialize the terms of the Project ("Development Agreement") as required by Ordinance No. 13114, the Zoning Ordinance of the City of Miami, Florida, as amended ("Miami 21 Code"); and WHEREAS, the Development Agreement was executed and entered into by the City of Miami ("City") and the appropriate parties on February 24, 2016 and was recorded at Official Record Book 29976, Pages 189-228 of the Public Records of Miami -Dade County, Florida; and WHEREAS, the City Commission's approval was based, in part, on a Project traffic study conducted by Kimley-Horn dated August 2014, which proposed the conversion of a segment of Southwest 3rd Avenue between Southwest 61" Street and Southwest 71" Street, Miami, Florida ("SW 3rd Segment") from a one-way street that allows only northbound traffic to a two-way street that would permit traffic north and south bound; and WHEREAS, the conversion of the SW 3rd Segment was included in the Project's approved conceptual plan and in the Development Agreement as one of the required traffic infrastructure improvements identified as a community benefit; and WHEREAS, in furtherance of the Project's requirements, the City Commission desires to support the conversion of the SW 3rd Segment as a two-way street, subject to review and approval by the County and implementation by the Project's developer as duly permitted by the City; NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY OF MIAMI, FLORIDA, AS FOLLOWS: Section 1. The recitals and findings contained in the Preamble to this Resolution are adopted by reference and incorporated herein as if fully set forth in this Section. Section 2. The City Commission supports the conversion of the SW 3rd Segment into a two-way street, permitting traffic to flow in northerly and southerly directions, starting at the intersection of Southwest 3rd Avenue and Southwest 7th Street, Miami, Florida and ending at the intersection of Southwest 3rd Avenue and Southwest 6th Street, Miami, Florida. Section 3. The Project's developer shall obtain approval from Miami -Dade County and design, permit, and construct, or cause to be designed, permitted, and construct, road and other streetscape improvements in accordance with Project approvals and City requirements to accomplish the conversion of the SW 3rd Segment. Section 4. The City Manager is authorized' to take such further actions as may be necessary to implement the purpose and provisions of this Resolution. Section 5. This Resolution shall be effective immediately upon adoption.
